According to part seven of Article 20 of the Budget code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for use of the means provided in the government budget for accomplishment of the state target programs of reforming and development of defense industry complex, development, development and implementation of new technologies, building-up of the available production capacities for production of defense products which is applied.

1-1. In partial change of Item 2 of the Procedure for the suspension of transactions with budgetary funds approved by the resolution of the Cabinet of Ministers of Ukraine of January 19, 2011 No. 21 (Official Bulletin of Ukraine, 2011, No. 4, Art. 205), to determine that suspension of transactions with budgetary funds in connection with violation of the budget legislation in case of execution of the contract No. 11 of December 15, 2017 is not applied to the state company "The Ukrainian center "Bezopasnost" which belongs to the sphere of management of the Ministry of questions of strategic industries, for action of the Voluntary settlement which is signed with the purpose of elimination of such violation between the specified company and the State-owned joint-stock holding company "Artyom" in legal case No. 910/18796/19, on condition of proper accomplishment of the Voluntary settlement.

To the ministry of questions of strategic industries:

exercise constant control behind accomplishment of the Voluntary settlement;

to monthly inform the Cabinet of Ministers on accomplishment of the Voluntary settlement.

1-2. the period of action of warlike situation is not set off in time on which the state company "The Ukrainian center "bezopasnost" performed advance payment under the contract of rather technical retrofitting and reconstruction of the operating productions, production and implementation of special means of technological equipment, concluded in 2020 with the state company "ANTONOV".

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for use of the means provided in the government budget for accomplishment of the state target programs of reforming and development of defense industry complex, development, development and implementations of new technologies, building-ups of the available production capacities for production of defense products

1. This Procedure determines the mechanism of use of the means provided in the government budget according to the "Accomplishment of the State Target Programs of Reforming and Development of Defense Industry Complex, Development, Development and Implementation of New Technologies, Building-ups of the Available Production Capacities for Production of Defense Products" program (further - budgetary funds).

In the conditions of warlike situation the implementation of actions according to this budget program is enabled according to features of implementation of the defensive purchases for action of legal regime of warlike situation approved by the resolution of the Cabinet of Ministers of Ukraine of November 11, 2022 No. 1275.

2. The main manager of budgetary funds and the executive in charge of the budget program is Minstrategprom.

3. Receivers of budgetary funds are business entities which correspond to the following criteria:

availability of the sufficient financial plan the current year, finansovoekonomichesky calculations (reasons) of implementation of measures for the budget program;

not unprofitable activities in the last two years, lack of overdue debt on the loans granted by banks;

availability of the license for implementation of the corresponding type of economic activity in case it is subject to licensing according to the legislation;

availability of the special operating authority, connected with the state secret.

The business entity which has debt on salary payment, on tax payment, charges (obligatory payments) in the budget and the Pension fund of Ukraine which is declared in accordance with the established procedure by bankrupt against whom proceedings on bankruptcy or being in liquidation stage are initiated cannot be the receiver of budgetary funds.

Requirements of this Item are not applied to receivers of the budgetary funds authorized on implementation of actions for mitigation of consequences of fighting and to renewal of productive activity of the companies of defense industry complex. The receivers of budgetary funds authorized on implementation of actions for mitigation of consequences of fighting and renewal of productive activity of the companies of defense industry complex can be subjects of managing who are contractors of public contracts (agreements) on defensive purchases for needs of the state customers in the sphere of defense and/or are involved in implementation of actions of the state target programs of reforming and development of defense industry complex in development, development and implementation of new technologies, building-up of the available production capacities for production of defense products, on condition of provision of reasons by them on damage of their production infrastructure owing to fighting during the armed aggression of the Russian Federation.

The list of the subjects of managing authorized on implementation at the expense of budgetary funds of actions for mitigation of consequences of fighting and to renewal of productive activity of the companies of defense industry complex and the list of actions for which implementation budgetary funds are allocated are determined by Minstrategprom.

4. The activities for accomplishment of the state target programs of reforming and development of defense industry complex, development of missile armament, creation of antiballistic missile system, development, development and implementation of new technologies, building-ups of the available production capacities for production of defense products connected with the state secret are made with observance of requirements of the legislation on the state secret.
