About approval of the Regulations on the Ukrainian center of planning of use of airspace of Ukraine and regulation of air traffic
According to Item 6 of the Regulations on the joint civil and military system of air traffic management of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 19, 1999 No. 1281, we ORDER:
1. Approve Regulations on the Ukrainian center of planning of use of airspace of Ukraine and regulation of air traffic which is applied.
2. To provide to department of the air transportation of the Ministry of infrastructure of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.
3. This order becomes effective from the date of its official publication.
4. To impose control over the implementation of this order on the deputy minister of infrastructure of Ukraine - the chief of staff of Romensky D. V. and the First Deputy Minister of Defence of Ukraine Rusnak I. S.

1. This Provision determines the general principles of activities of the Ukrainian center of planning of use of airspace of Ukraine and regulation of air traffic (further - Ukraerotsentr), its main objectives and functions.
2. Ukraerotsentr is structural division of the State company of air traffic maintenance of Ukraine (Ukraerorukh) and enters the joint civil and military system of air traffic management of Ukraine (further - OGVS).
3. Ukraerotsentr is the main operational division of OGVS, power and which functioning within competence are connected with continuous round-the-clock accomplishment of tasks on the organization of use of airspace and the operational notification of the central executive bodies, the companies, organizations, the organizations determined by regulatory legal acts and organizational and administrative documents concerning the organization of use of airspace (further - IVP), regulations of air traffic and functioning of divisions of OGVS.
4. Ukraerotsentr directly submits to Ukraerorukh's director, and on the questions connected with accomplishment of tasks for the benefit of defense of the state and its safety - the chief of the General Staff - to the Commander-in-chief of the Armed Forces of Ukraine.
5. In peace time and the special period the management of Ukraerotsentr on the questions connected with defense of the state and its safety is performed by the General Staff of the Armed Forces of Ukraine (further - the General Staff). The procedure for management is determined by the order of the chief of the General Staff - the Commander-in-chief of the Armed Forces of Ukraine.
6. With transition to work in the conditions of warlike situation the organization of functioning and Ukraerotsentr's activities in organizational and regular structure and states of warlike situation is determined by the relevant orders and orders of the Minister of Defence of Ukraine and the General Staff.
7. Ukraerotsentr's decision according to its competence and powers assigned to it are obligatory for execution by the legal entities and physical persons performing the activities connected with the IVP organization and air traffic maintenance (air traffic control) in airspace of Ukraine.
8. Ukraerotsentr in the activities is guided by the Air code of Ukraine, Regulations on use of airspace of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 29, 2002 No. 401 (with changes), the Regulations on the joint civil and military system of air traffic management of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 19, 1999 No. 1281 (with changes), the General agreement between the Ministry of transport of Ukraine and the Ministry of Defence of Ukraine concluded on July 20, 1999, other regulatory legal acts which regulate activities in the field of aircraft and use of airspace of Ukraine, organizational and administrative documents and this Provision.
9. Material and other types of ensuring functioning of Ukraerotsentr for accomplishment of the assigned tasks are performed by the Ministry of Defence and Ukraerorukh.
10. Material logistics and maintenance of operability of the equipment, technical systems, training of personnel of Ukraerotsentr are performed by the relevant services and Ukraerorukh's divisions, the Ministry of Defence, the General Staff within their competence.
11. Control and check of activities of Ukraerotsentr are performed according to the order of the director Ukraerorukh and the chief of the General Staff - the Commander-in-chief of the Armed Forces of Ukraine.
Supervision of aviation safety in the part concerning the organization and use of airspace is performed by State aviaservice according to the order of the Chairman.
12. The chief Ukraerotsentra reports to Ukraerorukh's director and the chief of the General Staff - the Commander-in-chief of the Armed Forces of Ukraine on activities Ukraerotsentra.
13. Ukraerotsentr is located on floor spaces of Ukraerorukh, has necessary service spaces and property, and also the technical means of automation and telecommunication necessary for accomplishment of the tasks assigned to it.
