Based on part three of Item 127 and part one of Item 201 of the Regulations on accounting treatment, storage, estimates and the realization of the property withdrawn, arrested or turned into the income of the state approved by the Presidential decree of the Republic of Belarus of February 19, 2016 No. 63, Council of Ministers of the Republic of Belarus DECIDES:

1. Approve:

Regulations on procedure, methods and places of destruction of pyrotechnic and mercury-containing products, other dangerous substances (are applied);

for office use.

2. This resolution becomes effective since August 27, 2016.

Regulations on procedure, methods and places of destruction of pyrotechnic and mercury-containing products, other dangerous substances

1. This Provision determines procedure, methods and places of destruction of pyrotechnic and mercury-containing products, other dangerous substances which are liable to destruction according to the legislation (further, unless otherwise specified, – property).

2. For the purposes of this provision terms and their determinations in the values established in appendix 1 to the Presidential decree of the Republic of Belarus of February 19, 2016 No. 63 "About enhancement of work with the property withdrawn, arrested or turned into the income of the state" are used.

3. The decision on destruction of property is made according to the procedure, the established Chapter 9 of the Regulations on accounting treatment, storages, estimates and the realization of the property withdrawn, arrested or turned into the income of the state.

4. Destruction of pyrotechnic products is made by the organizations which list is established by the Ministry of Emergency Situations.

5. Pyrotechnic products are destroyed according to technical documentation on them.

Destruction of pyrotechnic products is made by one of the following methods - burning or dissolution in water.

Dissolution in water destroys not waterproof pyrotechnic products.

In the absence of technical documentation on pyrotechnic products destruction is made by burning in the explosive camera, the bronekabena, bronepech or other similar devices.

6. Destruction of mercury-containing products is made by the organizations which list is established by the Ministry of Natural Resources and Environmental Protection.

7. Destruction of mercury-containing products is made physical and chemical, mechanical and other methods after extraction of mercury or along with its extraction according to the requirements established by regulatory legal acts, including technical regulatory legal acts.

8. Destruction of other dangerous substances is made by the organizations which list is established by the republican state bodies and other organizations subordinated to the Government of the Republic of Belarus, National academy of Sciences of Belarus (concerning the subordinates (who are logging in, structure, being under authority) the organizations performing destruction of other dangerous substances), regional and Minsk city executive committees (concerning the organizations which are not subordinated (not being under authority, not logging in structure) to the republican state bodies and other organizations subordinated to the Government of the Republic of Belarus, National academy of Sciences of Belarus) (further – the interested bodies).

9. The organization to which other dangerous substances are transferred to destruction develops according to the procedure, established by regulatory legal acts, including technical regulatory legal acts, the technological documentation establishing procedure for conducting engineering procedures (complex of the works performed in certain sequence) and (or) transactions on destruction of dangerous substances, operating mode of the equipment, technological methods of destruction, methods, means, regulations, parameters and other indicators of engineering procedures.

Documentation specified in part one of this Item is approved with the relevant interested organ prior to destruction of other dangerous substances.

10. The Ministry of Emergency Situations, the Ministry of Natural Resources and Environmental Protection, the interested body determine the organization destroying property within 5 working days from the date of receipt of the appeal of management of Department to them by humanitarian activities of Administration of the President of the Republic of Belarus for area, Minsk and the Minsk region, including the interdistrict departments created in it (further – divisions of Department), except for the case specified in part three of this Item.

In case of absence in the list established according to Item 8 of this provision, the organization which can transfer other dangerous substances for destruction the Ministry of Emergency Situations, the Ministry of Natural Resources and Environmental Protection, the interested body within 5 working days from the date of receipt of the appeal of division of Department determine the specialized organization which will perform storage of other dangerous substances until their destruction.

The interested body has the right to address other interested body for determination of the organization destroying other dangerous substances and (or) the specialized organization which will perform storage of other dangerous substances until their destruction. At the same time the term of determination of the specified organizations lasts up to 10 working days.

The Ministry of Emergency Situations, the Ministry of Natural Resources and Environmental Protection, the interested body notify divisions of Department and the organization determined for destruction and (or) storage of property on the made decision.

The cession of property is performed based on the property deed according to the procedure, the established Regulations on accounting treatment, storages, estimates and the realization of the property withdrawn, arrested or turned into the income of the state.

11. For the organization of process of destruction of property, and also confirmation of the fact of its destruction in the organizations specified in Items 4, of the 6 and 8 this provision, the order of the head creates the commission.
