About approval of the Procedure for representation of the generalized materials to prospecting bodies of Ukraine

According to the Laws of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction", "About prospecting bodies of Ukraine", "About operational search activities" and "About fight against terrorism" and for the purpose of determination of procedure for provision by Public service of financial monitoring of Ukraine of the generalized materials we ORDER to prospecting bodies of Ukraine:

1. Approve the Procedure for provision of the generalized materials to prospecting bodies of Ukraine which is applied.

2. Declare invalid the joint order of the Ministry of Finance of Ukraine, Service of foreign intelligence of Ukraine, the Ministry of Defence of Ukraine, Administration of the State Border Service of Ukraine of May 16, 2012 No. 549/123/332/340 "About approval of the Procedure for representation of the generalized materials to prospecting bodies of Ukraine", registered in the Ministry of Justice of Ukraine on June 6, 2012 at No. 915/21227.

3. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Chmeruk N. A.) and (Hilyuk V. P.) to submit to Department of financial investigations of Public service of financial monitoring of Ukraine this order in accordance with the established procedure on state registration to the Ministry of Justice of Ukraine.

4. To heads of the relevant structural and territorial subdivisions of Service of foreign intelligence of Ukraine, Head department of investigation of the Ministry of Defence of Ukraine, Management of investigation of Administration of the State Border Service of Ukraine and Public service of financial monitoring of Ukraine to bring this order to the attention of employees and to establish control of its accomplishment according to requirements of the legislation of Ukraine.

5. To heads of Service of foreign intelligence of Ukraine, Head department of investigation of the Ministry of Defence of Ukraine, Management of investigation of Administration of the State Border Service of Ukraine to appoint authorized employees for the organization on permanent basis of interaction with Public service of financial monitoring of Ukraine in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction.

6. This order becomes effective from the date of its official publication.

Procedure for representation of the generalized materials to prospecting bodies of Ukraine

I. General provisions

1. This Procedure determines form, structure, content of the generalized materials of Public service of financial monitoring of Ukraine, and also the mechanism and system:

submissions by Gosfinmonitoring of the generalized materials to Service of foreign intelligence of Ukraine, Head department of investigation of the Ministry of Defence of Ukraine, Management of investigation of Administration of the State Border Service of Ukraine (further - prospecting bodies of Ukraine);

registration and considerations of the generalized materials by prospecting bodies of Ukraine;

receipts by Gosfinmonitoring of information on the course of processing of the generalized materials and acceptance of adequate measures by results of their consideration by prospecting bodies of Ukraine;

prevention of disclosure of information containing in the generalized materials.

2. Terms and concepts which are used in this Procedure are applied in the values given in the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction" (further the Law), the laws of Ukraine "About prospecting bodies of Ukraine", "About operational search activities", "About fight against terrorism".

II. Preparation of the generalized materials for transfer to prospecting bodies of Ukraine

1. Information on financial transaction or set of the financial transactions connected among themselves which are subject to financial monitoring, and also on the client, received by Gosfinmonitoring in the procedure established by the legislation is processed and analyzed regarding availability of good causes:

consider that transaction or set of the transactions connected among themselves can be connected with legalization (washing) of income gained in the criminal way, financing of terrorism and financing of distribution of weapons of mass destruction;

suspect that financial transaction or the client are connected with making of the act determined by the Criminal code of Ukraine that does not concern legalization (washing) of income gained in the criminal way, financings of terrorism and financing of distribution of weapons of mass destruction.

In case of establishment of the specified bases Gosfinmonitoring submits within the terms established by this Procedure within prospecting bodies of Ukraine the corresponding generalized materials.

2. The generalized materials prepare Gosfinmonitoring in written and/or electronic form.
