According to Item 5 of Rules of registration, issue, replacement, delivery, withdrawal and destruction of the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the residence permit of the foreigner in the Republic of Kazakhstan, certificates of the stateless person, the certificate of the refugee and the travel document approved by the order of the Government of the Republic of Kazakhstan of August 26, 2013 No. 852, I order:

1. Approve:

1) form form for production of identity documents (except the certificate of the refugee), according to appendix 1 to this order;

2) rules of registration, filling, accounting, storage, transfer, expenditure, destruction of the form for production of identity documents (except the certificate of the refugee), according to appendix 2 to this order.

2. Declare invalid the order of the deputy. The Minister of Internal Affairs of the Republic of Kazakhstan of July 31, 2015 No. 649 "About approval of form and Rules of registration, filling, accounting, storage, transfer, expenditure, destruction of the form for production of identity documents of the citizen of the Republic of Kazakhstan" (No. registered in the Register of state registration of regulatory legal acts 12054, the "Republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" published on November 19, 2015 in information system of law of Ad_let of the republican state company on the right of economic maintaining).

3. To provide to department of migratory police of the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within five working days from the date of obtaining to send the copy of this order which underwent state registration in the Ministry of Justice of the Republic of Kazakhstan to the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan police major general Turgumbayev E. Z. and Department of migratory police (Sainov S. S). Ministries of Internal Affairs of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of registration, filling, accounting, storage, transfer, expenditure, destruction of the form for production of identity documents (except the certificate of the refugee)

Chapter 1. General provisions

1. These rules of registration, filling, accounting, storage, transfer, expenditure, destruction of the form certificates of the stateless person, the certificate of the refugee and the travel document approved by the order of the Government of the Republic of Kazakhstan of August 26, 2013 No. 852 are developed for production of identity documents (except the certificate of the refugee) (further - Rules) according to Item 5 of Rules of registration, issue, replacement, delivery, withdrawal and destruction of the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the residence permit of the foreigner in the Republic of Kazakhstan (further - the Resolution) and determine procedure for registration, filling, accounting, storage, transfer, expenditure, destruction of the form for production of identity documents (except the certificate of the refugee).

2. In these rules the following basic concepts are used:

1) the form - the typographical form of the strict reporting with number and bar code which is the data carrier which is introduced in the centralized information database of the documentary population of the Republic of Kazakhstan (further - the database) and is used further for the purpose of identification of the personality with the issued documents.

2) the electronic form - the form with number and bar code for production of identity documents (except the certificate of the refugee), is drawn up and filled in by means of information systems "The registration Item "Documentation and Registration of the Population" (further - RP DRN) and "The registration Item "Documentation and Registration of Foreigners" (further - RP DRI);

3) the refugee - the foreigner who owing to reasonable concerns to fall victim of prosecutions on the basis of race, nationalities, religions, nationality, belonging to certain social group or political convictions is out of the country of the civil accessory and cannot use protection of the country or does not wish to use such protection owing to such concerns or the stateless person, being out of the country of the permanent residence or civil accessory which cannot or do not wish to return to it owing to these concerns.

Chapter 2. Procedure for registration, filling, accounting, expenditure of forms of forms for production of identity documents (except the certificate of the refugee)

Paragraph 1. Registration, filling, accounting, expenditure of forms of forms for production of identity documents (except the certificate of the refugee)

3. Registration and filling of the form is performed by the authorized employee of division of migratory service (further – the authorized employee) in case of the personal address of the documented face for identification of his personality and putting down of the personal signature.

4. The form on receipt of the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan is filled in with the authorized employee in the place of permanent registration of the documented face, and also the actual stay in case of replacement of the passport and (or) the identity certificate in connection with loss, expiration, change of surname according to the conclusion, annulment of marriage, unfitness to further use, modification of documents, receipt of the passport of the citizen of the Republic of Kazakhstan for the first time based on the identity certificate of the citizen of the Republic of Kazakhstan, receipt of the passport and (or) the identity certificate of the citizen of the Republic of Kazakhstan for the first time by minor children based on the certificate of birth.

In the absence of the permanent residence of the documented face (except for foreigners and stateless persons), the form is filled in with the authorized employee in the place of its actual stay confirmed by law-enforcement bodies (the center of adaptation and rehabilitation for persons which are not taking certain residence, organization of criminal executive system, pre-trial detention centers, temporary detention centers, receivers distributors for persons of no fixed abode).

The form on receipt of the residence permit of the foreigner in the Republic of Kazakhstan and certificates of the stateless person is filled in with the authorized employee strictly in the place of permanent registration of the documented face.

On the form the form is filled in in the following cases:

1) to the investigative arrested and persons serving sentence in places of detention;

2) to persons having complete or partial loss of capability or opportunity to perform self-service, to move, be guided independently, with departure at the place of residence by means of the address through Single contact center 1414;

3) to citizens of the Republic of Kazakhstan, stateless persons whose belonging to nationality of the Republic of Kazakhstan, or to nationality of any state is not established by law-enforcement bodies, addressed in connection with the exchange of passports of the former USSR of sample of 1974 and their loss and also which addressed out of time for receipt for the first time of identity documents, based on certificates of birth;

4) in the absence of registration Items RP DRN and RP DRI;

5) in case of failures of communication channels with RP DRN, RP DRI or breakdown of their equipment;

6) to the citizens of the Republic of Kazakhstan who are constantly living beyond its limits and temporarily being in its territory and also in case of the appeal of citizens of the Republic of Kazakhstan to Committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan (further - KMS Ministry of Internal Affairs) concerning documentation (filling of forms and issue of ready documents, is made by KMS Ministry of Internal Affairs).

5. Forms of forms are considered and spent on sequence numbers in books of form No. 2 of accounting of forms for production of the documents proving the identity in form, according to appendix 1 to these rules (further - the book of form - 2).

6. The form is filled in with ball pen black, dark blue or violet paste. About correction of data in the form record on empty seat of the back of the form "corrected in the field of No. is made... trust (with indication of right data)", certified by the signature of the authorized employee and official stamp.

7. When filling paper forms from the documented faces presentation of two color photos by the size 3, 5kh is required to 4,5 of the centimeters corresponding to their age at the time of execution of the document.

Photos are carried out by photo printing method from one negative on dense photographic paper, is strict in fullface on light background, with neutral look and the closed mouth in which person occupies about 75% of total area of the photo. Use of the images made by method of computer scanning, modeling or photocopying is not allowed.

Photos are pasted on:

to the form face in the specially allotted place;

on the back the form near the field 18, the photo is certified by official stamp, with accurate impress of a seal, at the same time number of seal is located on the form (not in the photo).

8. The signature of the documented face in the form is carried out by it with own hand ball pen paste of black, blue or violet color. Use of ink and capillary (gel) handles is not allowed.

When filling forms the signature of the documented face can not be made:

persons which did not reach 16-year age;

incapacitated, on disability, illiteracy;

in exceptional cases, when the documented person refuses putting down of the personal signature (investigative arrested, persons under investigation of person).

In the specified cases of the graph for the signature remains free, the copy of the supporting document (the document on disability, the protocol of law enforcement agency, the document of body of health care) issued according to forms of accounting documentation in the field of health care, the approved order of the acting minister of health care of the Republic of Kazakhstan of October 30, 2020 No. KR DSM-175/2020 (registered in the Register of state registration of regulatory legal acts No. 21579) is accepted. On empty seat of the back of the form the signature absence reason certified by the signature of the authorized employee and official stamp is specified.

9. When filling the form, surname, name, middle name (in case of its availability) (further - First name, middle initial, last name (in case of its availability) and other data, the name of areas, body of issue of documents register according to entries in the documents which are the basis for filling of the form, at the same time names of the areas located in the territory of the Republic of Kazakhstan register according to the operating administrative-territorial division.

10. In case of document creation, proving the identity, the surname and name of the documented face are printed in the English writing necessary for it according to the submitted documents (the national passport of the foreigner, the invitation challenge, the marriage certficate, scientific works, monograms). The written application is submitted by the documented face in any form to law-enforcement body with indication of in it writing of surname and name in English, according to above-mentioned documents. The statement with the visa of the head of territorial authority of internal affairs – "transcription", is pasted from the back of the form and goes to KMS Ministry of Internal Affairs for production of documents.

The surname and name in necessary transcription are specified in the form under fields 2, 3. Registration number and date of the statement of the documented face are specified the form on the back and is certified by official stamp.

11. All codes, and also registration addresses and the reducings accepted in them are specified according to the reference book of reducings and codes on form, according to appendix 2 to these rules (further - the reference book).

In fields 6, of 10, of 13, of 14, of 15, of 16, of 17, of 18, 19 are dated by figures in the following sequence: year, month, number.

When filling the form:

The field without number "PASSPORT, IDENTITY CERTIFICATE" is filled according to type of the ordered document by putting down of capital Latin letter for the identity certificate and the passport of the citizen of the Republic of Kazakhstan - "N", for the certificate of the stateless person - "And", for the sake of appearances on the foreigner's residence in the Republic of Kazakhstan - "I". If the citizen of the Republic of Kazakhstan receives only the identity certificate or only the passport, in the second field the crossed out section is put down.

In the field 1 "the PASSPORT, the IDENTITY CERTIFICATE is ISSUED" the code of one or several reasons (to 7 codes) fillings of the form, for example, change of surname - "04", loss of the identity document - "09", change of legal address - "10" or other codes is specified.

12. Codes in information field 1 are specified in the following procedure:

1) in case of documentation of citizens of the Republic of Kazakhstan:

"the 00 code is specified when filling the form issue of the passport of the citizen of the Republic of Kazakhstan, to the children who did not reach 16-year age, at the same time in fields 9, of 10, 11 these certificates of birth, individual identification number register (further - IIN) according to which check on availability of registration of the child at the place of residence was made, is specified on empty seat of the back of the form.

Carrying out identification of the identity of children requires their personal presence.

To the children who did not reach 16-year age, not having identity documents and in certificates of birth which IIN is not specified its generation is made by means of information systems RP DRN.

For generation of IIN to children, one of parents (legal representative) shows the certificate of birth of the child, the identity document of one of parents (legal representative). For confirmation of nationality of the child, the authorized employee performs check under identity documents of both parents (legal representatives) in the database of the documentary population, and also according to data on the child's birth in RP DRN by means of integration interaction with the information system "Registration Item REGISTRY OFFICE" (further - IS ZAGS) for confirmation of the fact of its birth in the territory of the Republic of Kazakhstan. In case of lack of data on the birth in RP DRN check is performed according to the shown original certificate about the birth, at the same time within two working days in the registering body performing state registration of acts of civil status (further – body of RAGS), the inquiry for receipt of the copy of the birth record is sent.

The documents constituted in foreign language is subject to the translation on state or Russian. Authenticity of the signature of the translator notarially makes sure.

Adjusting data of children register according to the certificate of birth, date, number and body of its issue is specified.

For generation of IIN the certificate of birth which is drawn up according to the Law of the Republic of Kazakhstan of December 30, 1999 "About accession of the Republic of Kazakhstan to the Convention canceling the requirement of legalization of foreign official documents" (further – the Convention), except for the certificates of birth granted by foreign institutions of the Republic of Kazakhstan is provided to persons who were born outside the republic.

Generation of IIN is made by the Republican state company "Information and Production Center" of the Ministry of Internal Affairs of the Republic of Kazakhstan (further – RGP "IPTs") in time two working days from the date of application in RP DRN.

For the purpose of prevention of duplication of IIN, RGP "IPTs" carries out reconciliation in the database, in case of lack of data, the generated IIN goes to RP DRN.

Number of the generated IIN is specified in the insert to the certificate of birth with the appropriated IIN in form, according to appendix 3 to these rules, is signed by the authorized employee and certified by official stamp. Adjustments in IIN in connection with change of adjusting these children, in case of lack of identity documents, are made by RGP "IPTs" in case of receipt of data on change of adjusting data from IS ZAGS;

the 01 code in case of execution of the form is specified for persons which reached 16-year age, at the same time in fields 9, of 10, 11 these certificates of birth register, in case of execution of the identity certificate and passport of the Republic of Kazakhstan.

If the documented face before achievement of 16-year age by it received the identity document, in fields 9, of 10, 11 data of earlier issued document register.

In case of execution of the form by the code "00" or "01":

for confirmation of nationality of the child, the authorized employee performs check under identity documents of both parents (legal representatives) in the database of the documentary population, and also according to data on the child's birth in RP DRN by means of integration interaction with IS ZAGS for confirmation of the fact of its birth in the territory of the Republic of Kazakhstan. In case of lack of data on the birth in RP DRN check is performed according to the shown original certificate about the birth, at the same time within two working days the inquiry for receipt of the copy of the birth record is sent to body of RAGS. Number, date and body of certification of the identity of one of parents (personal presence of the legal representative is required) are specified on empty seat of the back of the form;

in case of various nationality of parents the notarized statement consent from the foreigner's parent on receipt of the citizen of the Republic of Kazakhstan by the child of identity documents (in case of the child's birth outside the Republic of Kazakhstan and various nationality of parents, one of whom by the time of the birth of the child consisted in nationality of the Republic of Kazakhstan and both parents had the permanent residence outside the Republic of Kazakhstan at this time) is submitted;

filling of forms to persons who were born outside the republic is made based on the certificates of birth which are drawn up according to the Convention, except for certificates of birth, granted by foreign institutions of the Republic of Kazakhstan;

the 04 code when filling the form is specified in case of change First name, middle initial, last name (in case of its availability), at the same time in fields 9, of 10, 11 data of the former document, in the field 5 - former surname, and under fields 3 and 4 - former name, middle name register.

The surname chosen in case of the conclusion or annulment of marriage is specified according to entry in the certificate on the conclusion (termination) of the scrap, the judgment which took legal effect which data register on empty seat of the back of the form;

the 05 code is specified in case of change of birth date, at the same time in fields 9, of 10, 11 data of the former document proving the identity register. On empty seat of the back of the form these certificates of birth are specified.

Data on change of adjusting data, the birthplaces the authorized employee receives by means of integration interaction from IS ZAGS. In case of their absence in RP DRN, filling of the form on issue of the passport, identity certificate of the citizen of the Republic of Kazakhstan on change of adjusting data, the birthplaces it is made based on the certificate of birth after pronouncement of the conclusion about change of adjusting data on form, according to appendix 4 to these rules (further - the conclusion about change of adjusting data), except as specified changes of surname according to the conclusion (termination) of scrap (matrimony), surnames and middle names to persons of the Kazakh nationality according to national traditions.

For establishment of reliability of change of adjusting data, the authorized employee creates checking material:

the petition from the citizen in any form of change of adjusting data;

the copy of the certificate on change of adjusting data (in case of its availability);

the copy of the repeated certificate of birth (in case of its availability);

the copy of the birth record (in case of presentation by the citizen of the repeated certificate of birth).

In case of confirmation of justification of the statement for change of adjusting data, the authorized employee in time two working days are taken out the conclusion about change of adjusting data which affirms the head of department (department) of internal affairs or his deputy. Registration of the conclusion is made in the magazine of registration of the conclusions about change of adjusting data, nationality, the birthplaces, on check of the personality and issue of identity documents, about loss of the passport of sample of 1974 in form, according to appendix 5 to these rules (further - the magazine of registration of the conclusions). Checking material is created in separate nomenclature case;

the 06 code is specified in case of detection of inaccuracies in entries in the issued documents proving the identity. In fields 9, of 10, 11 data of the document in which inaccuracy is found register.

If in the made identity documents, the manufacturing defect is allowed, then with again drawn up form the former form and the document with the made mistake, and production of repeated identity documents goes to KMS Ministry of Internal Affairs the separate register without inclusion in general lists, it is made at the expense of RGP "IPTs". After production of the new document former (with mistake) it is destroyed in RGP "IPTs" as manufacturing defect, and both forms with the made document return in the place of their filling. If inaccuracies in records are allowed because of authorized employees when filling the form, again drawn up form with application of a copy of the document validating the entered data goes to KMS Ministry of Internal Affairs. On the back the form record with indication of the field in which the error certified by official stamp was found is made, the document with the made mistake is destroyed according to Items 47, 48 Resolutions.

In case of detection of discrepancy of the photo of the documented face in the database with the facsimile in the document proving the identity, the authorized employee fills in the form by the 06 code after the conducting check of the personality documented and the reasons of discrepancy in documents.

For confirmation of the personality the protocol of identification of the identity of the citizen in form, according to appendix 6 to these rules is constituted (further - the protocol of identification of the personality). The protocol of identification of the personality is constituted on its photograph shown along with photographs of other persons whenever possible similar on appearance with identified, in number of at least three, with involvement of the close relatives or persons knowing the citizen at least 10 years.

Within two working days the conclusion is taken out and goes to KMS Ministry of Internal Affairs together with the form and the act of destruction of invalid identity documents, passports of sample of 1974, certificates of the inhabitant of border zone, forms of the forms damaged when filling in form according to appendix 5 to these rules (further - the act of destruction), with indication of the reasons of invalidity of the document according to the list of the reasons of destruction of invalid identity documents according to appendix 8 to these rules, registration of the conclusion is made in the magazine of registration of the conclusions;

the 07 code is specified in cases of unfitness of the document to use (spoil, decay, technical defects, use of all pages of the passport, absence of IIN in the identity document, etc.).

The document, unsuitable to use, in connection with spoil, decay, impossibility of identification of the personality is withdrawn when filling the form.

Also, the 07 code is specified in case of execution of the form based on the document entered into the category invalid in the database on the reason "unclaimed;";

the 08 code is specified in case of change by the citizen of the Republic of Kazakhstan of the nationality.

In case of execution of the form by the 08 code in connection with change of nationality it is necessary to be guided by the following:

change of record about nationality, in passports and identity certificates of citizens, is made according to their written application based on the certificate of birth and other documents confirming justification of the petition;

record about nationality in the passport and the identity certificate is made according to nationality of parents. In case of various nationalities of parents the citizen of the Republic of Kazakhstan voluntarily chooses nationality on the father or mother;

further according to the statement, the nationality changes only on nationality of other parent.

Change of record about nationality in passports, identity certificates of the citizens of the Republic of Kazakhstan who are violently moved during repressions on the territory of the Republic of Kazakhstan is by way of exception allowed. Change of nationality is made based on the certificates of rehabilitation issued according to the Law of the Republic of Kazakhstan of April 14, 1993 "About recovery of victims of mass political repressions".

Disputes on change of record about nationality in passports and identity certificates of citizens are permitted according to the legislation of the Republic of Kazakhstan judicially.

The form is filled in after the confirmation of justification of the statement for change of nationality and the conclusion which is taken out in time two working days on change of nationality approved by the head of department (department) of police or his deputy and registered in the magazine of registration of the conclusions. Checking material is created in separate nomenclature case.

In fields 9, of 10, of the 11th form data of the former identity certificate register (or passports - for living abroad), and on empty seat of the back of the form number and date of the conclusion on change of nationality which are certified by passport official stamp register. In the field 8 the new nationality of the citizen, and under the field 8 - former nationality registers.

At the same time in case of execution of the form by the 08 code by the authorized employee to the citizen issues the certificate of change of record about nationality which is shown in body of RAGS for the permanent address for modification of data on nationality in the corresponding civil registrations.

The same 08 code is specified when filling the form when the citizen changes identity documents, in connection with desire not to specify in them nationality. The field 8 is not filled, in it the 999 code is put down;

the 09 code is specified when filling the form because of loss of the identity document (except the passport of the citizen of the Republic of Kazakhstan).

Persons which lost identity documents submit to law-enforcement bodies the written application with indication of where when and under what circumstances the document in form, according to appendix 9 to these rules is lost.

Check on confirmation of the personality and issue of data on the lost identity document, is made by the authorized employee in the database.

In the absence of the form in card-index, the statement of loss (absence) of the form in form, according to appendix 10 to these rules is drawn up.

For confirmation of the personality and data on the lost identity document, from KMS Ministry of Internal Affairs information from the database with the photo certified by official stamp of KMS Ministry of Internal Affairs is requested.

In case of the address of persons, the lost identity documents which are received in other regions divisions of migratory service in which there are no RP DRN send inquiry for provision of the copy of the form (forms - 1) in form, according to appendix 11 to these rules with the photo for confirmation of its identity to the owner of the document and issue of data on the lost document.

The requests connected with loss of identity documents of passports of the former USSR of sample of 1974 go no later than the next working day after receipt of statements, and reply to the request about provision of the copy of the form (forms - 1) in form, according to appendix 12 to these rules are sent to initiators of requests no later than 48 hours after their receipt.

In fields 9, of 10, of the 11th form data lost or available, the identity document register. On the back the form number and date of the statement of the documented face on recovery of the lost document registers;

the 10 code is specified in case of change by the documented faces of registration address when in the identity document, the complete address of registration (the area, the city, the area, the street, the house, the apartment) which does not correspond to new registration address is specified.

In fields 9, of 10, 11 data of the identity document register, and the field 14 (the former residence) is filled.
