For the purpose of simplification of the customs procedures connected with export, execution of provisions of the Order of the Government No. 904 of November 13, 2013 "About approval of the Regulations on procedure for electronic customs clearance of goods" (The Official Bulletin 258-261 of November 15 2013) I ORDER:

1. Approve "Methodological regulations of the electronic procedure of customs clearance of goods for export" according to appendix to this order.

2. For execution of this order to management of information technologies together with management of information development to provide permanent training of customs officers in processing of the electronic customs declaration.

3. Perform GP "VamServInform" in information systems of Customs Service necessary changes for ensuring effective functioning.

3. To assign execution of this order to management of the organization of customs control, management of information technologies, management of information development and chiefs of customs.

4. To impose control of execution of this order on the head of the department of the income and customs control.

6. This order becomes effective from the moment of its signing.

Methodological regulations of the electronic procedure of customs clearance of goods for export

I. Determinations

1. In case of application of this Regulations the following is meant:

a) the digital signature - the certificate of open key, effectual in law.

b) the user of information system - the legal entity having the right to use information method of declaration of goods and which can be the customs applicant or the customs broker - the user of information system as it is determined in this Chapter.

c) the inspection statement - the electronic document IS "ASYCUDA World" constituted at each stage of information method of declaration of goods on the basis of the conclusions about filling of the customs declaration with the wrong or unconfirmed data concerning tariff compliance, customs value, type, quantity or origin, amount of obligations and procedure for application of customs privileges.

d) the list of the enclosed documents – the electronic document IS "ASYCUDA World" containing the exhaustive list of all documents attached to the customs declaration (invoices, certificates of origin, technical prospectuses, legal acts, etc.), and also their data (series, number, calendar dates).

II. Filling, placement, registration on the server

1. The user of information system performs the following transactions on the workplace:

a) fills in the customs declaration according to technical rules about procedure for seal, use and filling of the customs declaration, having involved the information module made available by customs authority;

b) checks the completed customs declaration and eliminates the errors revealed by the information module relatively of the data concerning customs tariff, the exchange rate of the currencies, customs regimes, additional codes corresponding of the operating regulations, the countries, vehicles, etc.;

c) requests the right of information placement of the customs declaration on the central server, owners of the digital signature surely sign the performed operation; d) requests information registration of the electronic customs declaration, owners of the digital signature surely sign the performed operation then number and registration date are automatically assigned to the customs declaration; this team leads to application of general criterions of selectivity. At the same time IS "ASYCUDA World" carries out distribution of the electronic customs declaration to one of corridors of customs control.

About adoption of the electronic customs declaration it is reported to the customs applicant to whom the message containing identification details, number and date of its registration is sent.

2. According to the statement of the user of information system, the electronic customs declaration can be withdrawn finally or for the period of introduction of amendments to it prior to physical control or before validation of the electronic customs declaration.

III. Execution of the electronic customs declaration

A. Green channel of customs control:

In case of distribution of the electronic customs declaration along the green channel of customs control in IS "ASYCUDA World" the user of information system reports to the economic agent about possibility of delivery of the vehicle with load on the boundary customs post (specified in column 29 of the customs declaration). As a result the vehicle goes to the boundary customs post specified in the electronic customs declaration.

1. The actions performed on boundary customs post

The employee of boundary customs post in case of representation of the vehicle carries out the following transactions:

a) identifies the electronic customs declaration in IS "ASYCUDA World";

b) carries out necessary formalities for vehicle registration in IS "Frontiera";

c) checks if the electronic customs declaration is signed by the digital signature;

d) in the absence of the digital signature the electronic customs declaration is considered invalid;

e) visualizes the customs declaration, having identified it from lists of the chosen declarations for the purpose of determination of corridor of customs control;

f) checks and levies customs payments;

g) applies customs seals (on demand or if it is required according to the current legislation), doing the corresponding mark in the electronic customs declaration;

h) in case goods are transported under cover of the book of TIR (according to the International convention about international delivery of loads using the book of TIR), carries out the customs formalities assigned to customs of departure and appointment at the same time;

i) signs the electronic customs declaration the digital signature;

j) validirut the electronic customs declaration;

k) confirms export by activation of the option "ELIBERARE EXPORT (EXPORT RELEASE)" to IS "ASYCUDA World";

1) puts down customs seals on business and transport documents at the request of the exporter;

m) completes customs formalities by confirmation of departure of the vehicle with goods from the customs control zone in IS "Frontiera".
