Approve the Procedure and conditions of provision in 2016 for subvention from the government budget on debt servicing on the borrowings performed in 2012 in the general fund of city budget of Kiev which are applied.

Procedure and conditions of provision in 2016 of subvention from the government budget on debt servicing on the borrowings performed in 2012 in the general fund of city budget of Kiev

1. These the Procedure and conditions determine procedure for granting in 2016 of subvention from the government budget on debt servicing by the borrowings performed in 2012 in the general fund of city budget of Kiev (further - subvention).

2. Subventions goes for expense recovery of the budget of Kiev, the payments connected with implementation on interest payment on the loans performed in 2012 in the general fund of the budget Kiev for debt repayment by bill calculations for compensation of difference in rates for heat energy (further - borrowings).

The subvention cannot be directed to the repayment of penalties and/or penalty fee added for violation of conditions of borrowings, payment of agency, consulting, rating and/or other commissions and services.

3. The main manager of subvention is the Ministry of Finance, the executive in charge - executive body of the Kiev city council (The Kiev city state administration).

4. The subvention is listed from the government budget to the budget of Kiev in the amount provided by the Law of Ukraine "About the Government budget of Ukraine for 2016".

5. For receipt of stipulated in Item 2 these Procedures and conditions of subvention the executive body of the Kiev city council (The Kiev city state administration) submits in the day following behind day of implementation of payments on interest payment on loans, but no later than the 15th (in December - to the 20th) the corresponding address to which the following documents are attached:

the copies of the prospectus of the issue and the decision of the Kiev city council on approval of conditions of restructuring in 2015 of debt obligations of Kiev certified by the signature of the official of executive body of the Kiev city council (The Kiev city state administration) and under seal (in case of submission of the first address);

the certificate calculation of interest payment on borrowings certified by the signature of the official of executive body of the Kiev city council (The Kiev city state administration) both under seal and copies of payment orders.

6. The Ministry of Finance prepares the order about expense recovery of the budget of Kiev, the payments connected with implementation on interest payment on loans, within three working days after receipt of 5 presents of the Procedure specified in Item and conditions of documents and gives within two working days to Treasury.

7. The treasury lists subvention according to the Procedure for transfer of the interbudget transfers approved by the resolution of the Cabinet of Ministers of Ukraine of December 15, 2010 No. 1132 (The Official Bulletin of Ukraine, 2010, No. 96, Art. 3399; 2015, No. 7, the Art. 161), and to the Procedure for treasurer servicing of the government budget on the expenses approved by the order of the Ministry of Finance.

8. Opening of accounts, registration, accounting of obligations in bodies of Treasury and carrying out the transactions connected with use of subvention are performed in the procedure established by the legislation.

9. Creation and submission of financial and budget reports about use of subvention, and also control of its target and effective use are performed in the procedure established by the legislation.
