1. Approve the enclosed Rules of maintaining the State register of emissions and transfer of pollutants.

2. To provide to department of environmental monitoring and information of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan" within five working days from the date of receipt of the registered order;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the State register of emissions and transfer of pollutants

Chapter 1. General provisions

1. These rules of maintaining the State register of emissions and transfer of pollutants (further - Rules) are developed according to the subitem 29) of article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further - the Code) and determine procedure for maintaining the State register of emissions and transfer of pollutants.

2. According to Item 1 of article 160 of the Code the State register of emissions and transfer of pollutants (further - GRVPZ) - the structured database about condition of issue and environmental pollution placed in open access which is kept by authorized body in the field of environmental protection (further - authorized body) for the purpose of ensuring transparency.

3. GRVPZ contains information on threshold limit values of pollutants, their influence on health and the environment, and also other evidence-based information on emissions and transfers of pollutants and information on users of nature.

4. According to Item 3 of article 160 of the Code information on users of nature contains:

1) name, legal address, type of activity of the user of nature;

2) electronic option of the issued ecological permission;

3) information on amount of the actual issues to the environment;

4) electronic version of the program of production environmental control and reports of environmental monitoring, the actions plan on environmental protection;

5) results of the state environmental control;

6) data on obligatory payments in the budget for issues to the environment, including for the superestablished standard rates.

5. The production site is understood as the protected and protected territory of placement of factory, office, sanitary and household and auxiliary buildings and constructions of the company in which the user of nature performs activities with which issues to the environment are connected.

The terms and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of environmental protection.

Chapter 2. Procedure for maintaining the State register of emissions and transfer of pollutants

6. The users of nature having category objects I (dalee-Prirodopolzovateli) annually till April 1 provide in territorial authority of authorized body on environmental protection (further - territorial authority) on location of each production site, the following information for previous year:

1) general information about the User of nature in form, according to appendix 1 to these rules;

2) electronic option of the issued ecological permission;

3) information:

on amount of the actual emissions of pollutants in atmospheric air in form, according to appendix 2 to these rules;

on amount of the actual emissions of pollutants in water objects in form, according to appendix 3 to these rules;

about the production wastes and consumption formed on the production site in form according to appendix 4 to these rules;
