According to the subitem 29) article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007, PRIKAZYVAYU:

1. Approve the enclosed Rules of application of methods of liquidation of emergency oil spills at the sea and internal reservoirs of the Republic of Kazakhstan.

2. To provide to committee of ecological regulation, control and state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan" within five working days from the date of receipt of the registered order;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of application of methods of liquidation of emergency oil spills at the sea and internal reservoirs of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of application of methods of liquidation of emergency oil spills at the sea and internal reservoirs of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 29) of article 17 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further - the Code) and determine procedure for application of methods of liquidation of emergency oil spills at the sea and internal reservoirs of the Republic of Kazakhstan.

2. These rules extend to the subsoil users performing oil operations (further - the subsoil user), the physical and (or) legal entities performing the activities at the sea and internal reservoirs connected with risk of oil spill (further - physical and (or) legal entities), and also the organizations having resources on the liquidations of oil spills, authorized bodies and local executive bodies participating in mitigation of consequences of emergency oil spill at the sea and internal reservoirs of the Republic of Kazakhstan.

3. In these rules the following terms and determinations are used:

1) the summary analysis of ecological advantage (further - ASEP) - selection process of the most effective methods of liquidation of emergency oil spills at the sea and internal reservoirs of the Republic of Kazakhstan (further - methods of LARN) and assessment of their impact on the environment, and health of the population;

2) controlled burning of oil slick is one of methods of LARN used for burning of floating oil slick which can be localized by means of mechanical means and chemical collectors.

Other terms and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of environmental protection.

4. According to Item 66 of the National plan for the prevention of oil spills and response to them in the sea and internal reservoirs of the Republic of Kazakhstan approved by the order of the Minister of Energy of the Republic of Kazakhstan of February 23, 2015 No. 134 (it is registered in the Register of state registration of regulatory legal acts No. 10908) (further - the National plan) for liquidation of oil spills at the sea and internal reservoirs of the Republic of Kazakhstan the following methods are used:

1) mechanical control and collection of oil from water surface (including variation of oil slick from sensitive resources);

2) controlled burning of oil slick;

3) application of chemical means.

5. According to the subitem 3) of Item 8 and Item 68 of the National plan application and the choice of methods of liquidation of oil spill are determined and performed according to the plan for the prevention and liquidation of oil spills of subsoil users, the physical persons and legal entities performing the activities at the sea connected with risk of oil spill, performed according to the object level of management (further - the object plan) based on risks assessment and the summary analysis of ecological advantage. Application of chemical means or controlled burning of oil slick is allowed in the presence of approval of authorized body in the field of environmental protection.
