About approval of the Regulations on storage and wholesale trade (through the automated system) the identified oil products

(as amended on 18-01-2023)

According to the Law on the market of oil products No. 461-XV of July 30, 2001. (The official monitor of the Republic of Moldova, 2001, No. 107, the Art. 821) and the Order of the Government of the Republic of Moldova No. 1027 of October 1, 2001. "About some measures for accomplishment of the Law on the market of oil products" (The official monitor of the Republic of Moldova, 2001, No. 120, Art. 1074; 2001, No. 147-149, of Art. 1367; 2002, 519) the Government of the Republic of Moldova DECIDES: Art. No. 50-52,

1. Approve Regulations on storage and wholesale trade (through the automated system) by the identified oil products according to appendix.

2. To the ministries, departments and National regulation agency in power to make changes and additions to departmental regulations for their reduction in compliance with the specified provision in a month.

3. The identified oil products to assign constant control behind observance of requirements of the Regulations on storage and wholesale trade (through the automated system) to the Ministry of Economy and Infrastructure, the Ministry of Finance (State Tax Administration), the Ministry of Internal Affairs and National regulation agency in power within their competence.

4. To provide to the ministry of the environment and Inspectorate for environmental protection control of emissions of the volatile organic compounds which are formed as a result of storage and distribution of gasoline of terminals at the station on filling with oil products according to provisions of the Order of the Government No. 587/2020.

5. To the state inspectorate for supervision of non-food products and consumer protection to provide quality control of main types of oil products and observance of the corresponding regulations.

Regulations on storage and wholesale trade (through the automated system) the identified oil products

I. General provisions

This Provision shifts Items 1 and 2 of Article 2, of Article 3, of 4, of the 7 and 8 appendix I-II to the Directive 98/70/SE of the European Parliament and Council of October 13, 1998 about quality of gasoline and diesel fuel and change of the Directive 93/12/SEE of Council published in the Official magazine of the European Community L350 of December 28, 1998, thus, as it was changed by the Directive (UE) 2015/1513 of the European Parliament and Council of September 9, 2015 last time.

1. This provision is developed according to the Law on the market of oil products No. 461-XV of July 30, 2001. (The official monitor of the Republic of Moldova, 2001, No. 107, the Art. 821) (with subsequent changes and amendments) and the Order of the Government of the Republic of Moldova No. 1027 of October 1, 2001. "About some measures for accomplishment of the Law on the market of oil products" (The official monitor of the Republic of Moldova, 2001, No. 120, the Art. 1074) (with subsequent changes and amendments) also regulates storage and wholesale trade by the identified oil products: gasoline, diesel fuel, kerosene, fuel for jet engines, the oven fuel liquefied by gas, fuel oil, oil and fuels and lubricants (further - oil products) during which importers will organize supply of the specified oil products to sellers at retail and to wholesale buyers.

For the purpose of this provision concepts from the Law No. 461/2001 on the market of oil products with the following amendments are used:

gasoline - any easily evaporating mineral oil product intended for functioning of internal combustion engines with ignition from spark used for movement of motor transport and classified according to goods items 271012410, of 271012450, of 271012490, 271012510 and 271012590;

diesel fuel - the oil fuel used for motor transport with internal combustion engines with ignition by compression (diesel engines), classified according to goods items 271019430, of 271019460, 271019470 and 271019480 or 271020110, of 271020150, of 271020170, 271020190;

activities for selection - sampling of gasoline and diesel fuel and carrying out testing for determination of the parameters of specifications set in regulations;

At the same time this provision does not regulate import, storage and realization of fuel for air transport.

2. The wholesale trade by oil products regulated by this provision includes:

a) supply of oil products to sellers at retail and to wholesale buyers;

b) storage of oil products.

3. Wholesale trade by oil products the trading activity performed on oil tankages and also the activities connected with leave of oil products for the purpose of their further sale to consumers or use in productive activity is considered.

4. Transit of oil products across customs area of the republic is performed under customs control according to the procedure, established by the customs legislation.

5. In case of the announcement of warlike or emergency state the current legislation allows introduction of special procedure for wholesale trade by oil products.

II. Stores organization and wholesale trade by oil products

6. Wholesale trade by oil products can be performed on the basis of the agreement signed by importers and wholesale buyers in writing without quantitative restrictions and with obligatory specifying in the accompanying document (the commodity transport delivery note registered in the State Tax Administration as the document of the strict reporting, the certificate of origin and the report of inspectorate issued by the body of inspectorate recognized by competent authority of the Republic of Moldova (further - acknowledged body of inspectorate), or, in case of main types of the oil products coming from member countries of the European Union (EU) - the declaration of conformity and the report the inspection/test report issued accredited in the EU by body of inspectorate or laboratory) on implementable oil products of license numbers for import and wholesale trade by oil products.

Acquisition of oil products at the subject of wholesale trade by oil products which does not have the corresponding import license and wholesale trade by oil products is forbidden.

In case of transportation, warehousings and realization of oil products without accompanying documents are in accordance with the established procedure applied to economic agents the sanctions providing confiscation of not documented fuel, and also the vehicles used for this purpose.

Owners of the import license and wholesale of gasoline, diesel fuel and/or the liquefied gas have the right to acquire oil products in the territory of the country for their sale.

7. The paragraph one is excluded.

It is forbidden to use for warehousing of liquid oil products as storage vehicles (the cistern car, truck tank).
