Regulations on the central certifying body

1. The central certifying body provides within the powers creation of conditions for functioning of certification centers of executive bodies or other state bodies and the centers of certification of keys (further - the centers).

2. The central certifying body in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine and monitoring body, other regulatory legal acts and this Provision.

2-1. Organizational and methodological, technical and technological conditions of activities of the central certifying body when servicing of the strengthened certificates of open keys (further - certificates of keys) the centers, carrying out registration, accreditation of the centers, and also order of interaction of the centers with the central certifying body in the course of provision of services of the digital signature are determined by regulations of work of the central certifying body which affirm and approved in accordance with the established procedure.

The regulations of work of the central certifying body are obligatory for subjects of legal relations in service industry of the digital signature when servicing by the central certifying body of certificates of keys of the centers and carrying out registration, accreditation of the centers.

3. The main objectives of the central certifying body is servicing of certificates of keys of the centers and their accreditation.

4. The central certifying body according to the tasks assigned to it:

generates vapors of keys (personal and open keys) and creates certificates of own open keys;

creates and issues to the centers certificates of keys;

carries out registration of certification centers of executive bodies or other state bodies;

performs accreditation of the centers, issue, renewal and cancellation of appropriate certificates;

blocks, cancels and renews certificates of keys of the centers in the cases provided by the Law of Ukraine "About the digital signature" what informs monitoring body on;

keeps electronic registers of the certificates of keys of the centers including blocked and cancelled;

keeps certificates of keys of the centers;

provides round the clock access to certificates of keys of the centers and their electronic registers through public telecommunication networks;

provides to the centers of consultation for the questions connected with use of the digital signature;

provides activities of the permanent commission on questions of accreditation of the centers;

accepts on storage certificates of keys, their registers and the documentary information which is subject to obligatory transfer by the centers in case of the termination of their activities;

considers applications and claims about inadequate functioning of the centers and submits relevant proposals to monitoring body;

notifies monitoring body on the circumstances interfering activities of the central certifying body.

5. The central certifying body has the right:

obtain in accordance with the established procedure from the centers information, documents and materials necessary for accomplishment of the tasks assigned to it;

involve in accordance with the established procedure experts central and local executive bodies, the companies, organizations and the organizations (in coordination with their heads) to consideration of the questions which are within its competence;

make suggestions for improvement of the legislation in the respective sphere;

participate in preparation and the conclusion of international treaties of rather mutual recognition of certificates of keys;

hold negotiations with the foreign organizations providing services to the digital signature within the powers, sign the relevant contracts with them.

5-1. Personal keys of the central certifying body are used for forming of certificates of own open keys, certificates of keys of the centers and data on the status of certificates of keys.

Effective period of certificates of open keys of the central certifying body constitutes no more than ten years.

Frequency, procedure for planned replacement and use of personal keys of the central certifying body are determined by Regulations of work of the central certifying body.

6. The central certifying body shall conform to the requirements established by the legislation for the accredited center of certification of keys.

Check of activities of the central certifying body about compliance to the specified requirements is performed by monitoring body.

7. Technical and technological support of accomplishment of functions of the central certifying body is performed by the state company determined by it in accordance with the established procedure, organization or the organization.
