About approval of standard forms of the social contract

According to the subitem 26) article 7 of the Law of the Republic of Kazakhstan of April 6, 2016 "About employment of the population" PRIKAZYVAYU:

1. Approve standard forms of the social contract on provision of the state support:

1) in the direction on professional training according to appendix 1 to this order;

2) in the direction on social workplace according to appendix 2 to this order;

3) in the direction on youth practice according to appendix 3 to this order;

4) in the direction on social jobs according to appendix 4 to this order;

5) on assistance to entrepreneurial initiative of citizens and oralmans according to appendix 5 to this order;

6) on assistance to voluntary resettlement for increase in labor force mobility according to appendix 6 to this order;

7) on provision of state grants on professional training according to appendix 7 to this order;

8) on temporary subsidizing of two third of the lost income of skilled workers for the reduced working hours according to appendix 8 to this order.

2. To provide to department of employment of the population of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within five calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) the direction in printing and electronic type within five working days after state registration of this order of its copy in one copy in the state and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

4) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to legal department of service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

4. This order becomes effective after ten calendar days after day of its first official publication.

1. Subject of the contract

1. The jobcenter of the population shall direct the trainee to professional training, and the trainee to pass the type of professional training established for it according to the procedure and on the conditions determined by the legislation of the Republic of Kazakhstan on employment of the population, the contract, the contract for professional training and internal procedure for the organization providing training. Within the Contract also following measures of the state support are provided to the trainee:

6) participates in qualification examination in assessment of professional activity;

7) is performed by monitoring of fulfillment of duties of the employer, the organization providing training and trained determined by the social contract;

8) requests and obtains from the parties information, documents and materials necessary for implementation of monitoring of obligation fulfillment by the parties;

9) demands from the parties of timely and proper execution of the Contract, contract for professional training;

10) is made by recalculation on payment in proportion to amount actually rendered to the organization providing training of services in professional training and also demands from the trained compensation in the budget of cost of this amount of services and paid amounts of financial support on professional training, in cases, stipulated in Item 10 Contracts.

5. Trainee:

1) there takes place professional training;

2) observes requirements of internal procedure for the training organization;

3) does not skip class without valid excuse;

4) timely and in full provides information, documents and materials necessary for implementation of monitoring of obligation fulfillment of the parties, on requests of the parties;

5) honesty fulfills the obligations assigned to the trainee within the measures given him of the state support;

6) refunds in the budget actual expenses on training, including the amounts, to the paid financial support and grant in case of repeated final assessment not of delivery and qualification examination or refusal of the trainee of employment on the workplace declared by the employer, except as specified employments for other permanent job, appeal on military service, imprisonment by a court decision, death, the pregnancy, stay in child care leaves, and also diseases requiring the long-term treatment which is not allowing to master the training program in full;

7) informs the parties no later than three working days on emergence of the circumstances interfering passing of professional training;
