About radio-frequency range

Article 1. Purpose of this Law

The purpose of this Law is regulation of legal relations in the field of distribution and use of radio-frequency range.

Article 2. Basic concepts

In this Law the following basic concepts are applied:

radio frequencies (radio wave) - electromagnetic waves with the frequencies which are conditionally accepted lower than three thousand gigahertzes extending in space without artificial wave guide for the purpose of transfer or acceptance of signs, signals, the written text, images and sounds;

radio-frequency range - set of radio frequencies in the interval which is conditionally accepted lower than three thousand gigahertzes;

radio-electronic means - the technical devices or systems intended for radiation and (or) acceptance of radio waves:

high-frequency devices - the equipment or devices intended for generation and use of radio-frequency energy for industrial, scientific, medical, household or other purposes, except for their uses for radiation or acceptance of radio waves:

band of radio frequencies - section of radio-frequency range, held for use radio-electronic means or high-frequency devices under certain conditions;

the table of RF arrangement of the Republic of Uzbekistan - the list of bands of the radio frequencies distributed between different types of radio-services;

radio interference - impact of the electromagnetic energy caused by one or several radiations, on acceptance in system of radio communication, shown in quality degradation, errors or losses of information:

industrial radio interferences - the electromagnetic radiations in the range of radio-frequency range created by the technical means which are not intended for transfer of radio waves:

electromagnetic compatibility - capability of radio-electronic means to function at the same time in actual practice operation with required quality in case of impact of radio interferences on them:

the user of radio-frequency range - the legal entity or physical person having permission of radio-frequency body to operation of radio-electronic means or high-frequency devices;

radio-frequency assignment - the specific radio frequency specified in the corresponding permission issued by radio-frequency body;

monitoring of radio-frequency range - complex of the organizational and technical actions intended for observation of condition of radio-frequency range, assessment of its use, warning and elimination of violations of the law about radio-frequency range.

Article 3. Legislation on radio-frequency range

The legislation on radio-frequency range consists of this Law and other acts of the legislation.

If the international Treaty of the Republic of Uzbekistan establishes other rules, than those which contain in the legislation of the Republic of Uzbekistan on radio-frequency range then are applied rules, the international treaty.

Article 4. Right of distribution and use of radio-frequency range

RF arrangement to users of radio-frequency range within the territory of the Republic of Uzbekistan is exclusive right of authorized state bodies.

Right to use radio-frequency range in the territory of the Republic of Uzbekistan is granted to the users acting on the basis of public and private property.

Article 5. State regulation and management in the field of use of radio-frequency range

State regulation in the field of use of radio-frequency range is performed by certification, licensing, the taxation, forming of single scientific and technical policy, and also others, stipulated by the legislation, by means.

Public administration in the field of use of radio-frequency range is exercised of the radio-frequency range authorized by the Cabinet of Ministers of the Republic of Uzbekistan state body.

Article 6. Powers of state body radio-frequency range

State body radio-frequency range:

performs state policy in the field of distribution and use of radio-frequency range;

develops regulations concerning distribution and use of radio-frequency range, state standards, technical regulations, regulations and service regulations and other normative and technical documents on use of radio-electronic means and high-frequency devices:

distributes bands of radio frequencies between radio-frequency bodies creates the Table of RF arrangement of the Republic of Uzbekistan:

coordinates activities of radio-frequency bodies in the field of use of radio-frequency range;

will organize work on technical expertize of the selected radio frequencies or bands of radio frequencies;

protects the rights and legitimate interests of users of radio-frequency range:

exercises control of compliance with law about radio-frequency range;

represents the interests of the Republic of Uzbekistan in the international organizations for use of radio-frequency range;

performs international cooperation in the field of use of radio-frequency range.

The state body radio-frequency range can have also Inca of power according to the legislation.

Article 7. Radio-frequency bodies

Treat radio-frequency bodies:

Ministry of development of information technologies and communications of the Republic of Uzbekistan;

Ministry of Defence of the Republic of Uzbekistan;

Service of state security of the Republic of Uzbekistan.

Radio-frequency bodies perform the activities according to the legislation on radio-frequency range.

Article 8. Powers of radio-frequency bodies

Radio-frequency bodies:

issue permissions to acquisition (transfer), designing, construction (installation), operation in the territory of the Republic of Uzbekistan and import of radio-electronic means and high-frequency devices within the bands of radio frequencies selected with it state body radio-frequency range from abroad;

prohibit in accordance with the established procedure operation of radio-electronic means and high-frequency devices in case of their mismatch to the established standards and technical regulations, failure to provide of safety of citizens, environmental protection, and also in case of special circumstances;

reveal illegally the operating radio-electronic means and high-frequency devices;

record the radio frequencies appropriated to users, and also exercise control of use of radio-frequency range according to the procedure established by state body radio-frequency range:

eliminate radio interferences to radio-electronic means, including the radio-electronic means of the international organizations and foreign states operating according to international treaties and rules;

develop organizational and technical actions for ensuring electromagnetic compatibility together with other competent authorities.

Radio-frequency bodies can have also other powers in the field of radio-frequency range according to the legislation.
