About approval of the Procedure for submission of the declaration on waste and its forms

According to the Item "g" of part one of article 18 of the Law of Ukraine "About waste" the Cabinet of Ministers of Ukraine decides:

1. Approve:

Procedure for submission of the declaration on waste which is applied;

form of the declaration on waste according to appendix.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for submission of the declaration on waste

1. This Procedure establishes procedure for granting of the declaration on waste.

2. In this Procedure terms are used in the value given in the Economic code of Ukraine, the Law of Ukraine "About waste" and other acts of the legislation of Ukraine.

3. Subjects of managing in the field of the address with waste which activities lead only to formation of waste for which the indicator of the general education of waste constitutes from 50 to 1000 conventional units annually submit the declaration on waste (further - the declaration) in form according to appendix to the resolution of February 18, 2016 to No. 118.

The declaration moves once a year at the same time in paper and electronic form in the center of provision of administrative services which transfers her to executive body of the Autonomous Republic of Crimea on protection of the surrounding environment, of the regional, Kiev and Sevastopol city state administrations (further - allowing body), or through electronic system of implementation of allowing procedures in the field of the address with waste which procedure for functioning is determined the Ministry of the environment, till February 20 of the year following reporting.

If the subject of managing incorporates the branches or other separate divisions without the status of the legal entity performing the activities in different regions (within certain administrative and territorial unit) Ukraine, such subject of managing submits the declaration in the place of implementation of activities by branch or other separate division.

4. The allowing body within five working days from the date of receipt of the declaration considers and performs its registration or draws up the written notice with the exhaustive list of comments of need of correction/refining of the provided information which transfers to the center of provision of administrative services, for transfer to the subject of managing.

The bases for execution of the written notice of need of correction/refining of the provided information is identification in the provided declaration of incomplete and/or false information.

The subject of managing which submitted the declaration from the date of receipt of the notification submits the corrected declaration or the specified information on the questions specified in the message of allowing body in the center of provision of administrative services for its transfer to allowing body within five-day term.

5. Information support on condition of registration of declarations performs allowing body by ensuring functioning of public information resources on which the list of subjects of managing which declarations are registered is weekly staticized.

6. The allowing body monthly to the 10th following reporting sends to Minekoenergo information on the registered declarations together with electronic versions of the registered declarations.

The procedure and form of provision of information affirms the Ministry of the environment.

7. Responsibility for reliability of filling of the declaration is conferred on the companies.
