About approval of the Regulations on procedure for transportation of the imported oil products

According to the Law on the market of N 461-XV oil products of July 30, 2001. (The official monitor of the Republic of Moldova, 2001, N 107, the Art. 821) and the Order of the Government of the Republic of Moldova N 1027 of October 1, 2001. "About some measures for accomplishment of the Law on the market of oil products" (The official monitor of the Republic of Moldova, 2001, N 120, the Art. 1074), with subsequent changes and amendments, DECIDES: the Government of the Republic of Moldova

1. Approve:

1) Regulations on procedure for transportation of the imported oil products according to appendix No. 1;

2) the List of Items of crossing for import of the imported oil products according to appendix No. 2.

2. Control over the implementation of requirements of the above-stated provision to assign to the Ministry of Finance, National regulation agency in power.

3. To the Ministry of Finance to submit to the Government to the 15th day of every month the report on the imported oil products for the last month.

Appendix №1

Regulations on procedure for transportation of the imported oil products

I. General provisions

1. This provision establishes general rules and the organizational principles of transportation of oil products with the subsequent realization by their importers from the producer to the consumer.

2. The concepts used in this provision have the following value:

the importer - the participant of the market of oil products having the license and importing oil products - the fact noted in case of their transportation through border which are warehoused and are subject to wholesale;

import - customs regime in case of which the goods entered on customs area of the Republic of Moldova receive the status of the goods introduced into economic circulation only after customs clearance;

carrier - the economic agent having special vehicles and performing oil transportation on customs area of the Republic of Moldova;

the vehicle - the rail, road and water transport used when transporting oil products;

border - Frontier of the Republic of Moldova, perimeter of free zones and customs warehouses;

transition Items through frontier - the customs clearance stations which are on crossing established by the order of the Government;

the customs legislation - set of regulations in the field of placement of goods and vehicles under any customs regime, including prohibitive, rationing and supervising arrangements, and also regulations adopted by Customs Service within the competence;

physical control - check of goods on compliance of manifest quantity of goods provided.

II. The organization of customs clearance of the imported oil products

3. All oil products imported on the territory of the Republic of Moldova are subject to declaring and customs clearance.

4. Execution of customs papers when importing oil products includes interaction of employees of the central industry bodies.

The procedure for activities of customs authorities is established by the customs legislation.

The procedure for activities of divisions of the Railroad of Moldova when implementing international carriages is established by the Agreement on the international transportation of goods (ATIM), regulations of Council for rail haulings of the CIS countries and the Charter of the Railroad of Moldova.

The order of interaction of customs authorities and the railroad is established in Regulations on interaction of customs authorities of Customs department and the Railroad of Moldova in case of execution of customs papers on the goods transported by rail.

5. Execution of customs papers on the oil products entered on customs area of the Republic of Moldova is performed by economic agents in places and in the terms established by the customs legislation.

6. Execution of customs papers on the oil products entered on customs area of the Republic of Moldova begins at the time of informing the employees of Customs Service who are in case of execution of the obligations on import of such products and by transfer by workers of the border railway station of accompanying documents on goods.

7. The term of the parking of vehicles is established by customs authority depending on time necessary for customs clearance, implementation customs and other types of control according to the customs legislation.

8. Creation of the customs declaration is performed according to rules of filling, the address and use of customs declaration forms.

9. Calculation and collection of customs payments when importing oil products are performed according to legislation provisions.

10. The vehicle can leave the parking lot only with the permission of Customs Service after implementation of all necessary transactions on customs clearance and after sampling of main types of oil products by the bodies of inspectorate recognized by authorized body of the Republic of Moldova (further - acknowledged bodies of inspectorate).

When importing main types of the oil products coming from member countries of the European Union (EU) sampling by acknowledged bodies of inspectorate in case of availability of the documents confirming quality of these oil products is not required (the declaration of conformity and reports of the inspections / test reports issued by the bodies of inspectorate or laboratories accredited in the EU).

If the main types of oil products arriving from EU Member States are not followed by the declaration of conformity and the report the inspection / test report issued by the laboratories accredited in the EU, receipt of the report of inspectorate from acknowledged bodies of inspectorate is obligatory.

10-1. The oil products intended to economic agents from east regions of the Republic of Moldova, registered in Public institution "Agency of the state services" which cross frontier at the check point (rail transport) Kuchurgan and at the check point through frontier Pervomaisk-Kuchurgan will be exempted from the obligation of sampling of oil products provided in Item 10.

11. The procedure for execution of customs papers in case of readdressing of goods is established by Regulations on interaction of divisions of the Customs Service subordinated to the Ministry of Finance and the Railroad of Moldova in case of execution of customs papers on the goods transported by rail.

12. The oil products imported by the waterway through customs clearance station of Dzhyurdzhyulesht - Port, can be delivered to the importer at the destination by the railway transport or vehicles meeting the requirements established by the Rules of motor transportation transportations of dangerous goods approved by the Order of the Government No. 589/2017, and which had technical inspection at the stations of technical inspection authorized according to Chapter 6 of the Section V of the Code of road transport No. 150/2014.
