Regulations on import and export of seeds and landing material

This provision establishes conditions and import procedure and export of seeds and landing material (further - seeds) for the purpose of protection of the domestic market against import of not certified seeds and low biological quality, the unregistered grades and hybrids for cultivation, and also for protection of the rights of selectors (sokhranitel) of domestic grades.

I. Main conditions of import and export of seeds

1. Only seeds of the following biological categories are allowed for import and export:

superelite;

elite;

certified (only the first reproduction).

2. Import or export of seeds of other biological categories or seeds which are not corresponding to qualitative indexes is allowed with the permission of authorized bodies in this area of the importing country.

3. Import and export of grades of the seeds and hybrids protected by patents or certificates for plant varieties is made only with the consent of their owners.

4. The seeds intended for import or export are subject to obligatory check and certification by the National agency on safety of foodstuff according to the existing instructions and technical regulations.

II. Import of seeds

5. It is allowed to import only the registered high-quality and hybrid seeds entered in the Register of grades and hybrids of plants.

6. Import of the high-quality and hybrid seeds which are not brought in the Register of grades and hybrids of plants is allowed in the presence of the conclusion of the Ministry of Agriculture, regional development and the environment according to the provided competences under direct supervision of State commission on testing of plant varieties in the following purposes:

a) for research works within exchange between research institutions and higher educational institutions of agricultural profile;

b) for the state testing which are carried out by State commission on testing of plant varieties;

c) for reproduction on the basis of agreements for the purpose of export in full both as seeds, and as commercial product.

7. Import of the high-quality and hybrid seeds which are not brought in the Register of grades and hybrids of plants for the purpose of their cleaning and conversion is performed based on the conclusion of the Ministry of Agriculture, regional development and the environment, according to the provided competences. These seeds are re-exported in full under direct supervision by the National agency on safety of foodstuff.

When importing these seeds will be certified on viability indicator.

8. The imported seeds are implemented within the terms specified in the quality certificates issued by the National agency on safety of foodstuff. In case of the expiration of the specified term seeds are subject to repeated check with issue of the new document.

9. Start-up in turnover of the imported seeds without quality certificate issued in accordance with the established procedure by the National agency on safety of foodstuff is forbidden.

10. Economic agents perform import of seeds on the basis of the following documents:

a) No. 51 is excluded according to the Order of the Government of the Republic of Moldova of 16.01.2013

b) the quarantine import permit of seeds issued by the National agency on safety of foodstuff and the accompanying quarantine certificate issued by the export state;

c) the conclusions of the Ministry of Agriculture, regional development and the environment, according to the provided competences for the import of seeds approved with State commission on testing of plant varieties;

d) the temporary quality certificate for the imported seeds on the form of the green color (for landing material - on the white form) received in the National agency on safety of foodstuff based on the quality certificate issued by authorized body of the export state for each job lot of seeds.

11. In 10-day time after import of seeds based on the temporary certificate by the National agency on safety of foodstuff exercises control and certification of batches of seeds with issue of the appropriate certificate of quality.

III. Export of seeds

12. Export and re-export of seeds is allowed to be made only after check of batches of seeds on all indicators of quality according to existing rules.

13. Economic agents perform export of seeds of landing material based on the following documents:

a) licenses for the right of production and the realization of seeds issued according to the current legislation;

b) the phytosanitary certificate of the international sample on the exported seeds issued by the National agency on safety of foodstuff;

c) the quality certificate for seeds (the orange form) and for the landing material (the white form) issued by the National agency on safety of foodstuff on the established sample for each batch of the seeds or landing material intended for export.

IV. Marking, packaging and control of import (export) of seeds

14. Import and export of seeds are performed by the packed batches marked and which are sealed up according to the existing regulations.

15. Customs authorities resolve import or export of seeds in case of submission of the documents necessary for taxation by duty, and after calculations for the import export right according to the current legislation.

16. In case of absence at the importer of necessary documents for import of the seeds provided by the National agency on safety of foodstuff, the chief of inspection can prohibit import of the corresponding batches of seeds.

17. The economic agents performing import or export of seeds annually represent to the National agency on safety of food produktovotcht the established form of import or export of seeds:

on grain winter crops - till November 30;

on other cultures - till June 10.
