About amnesty in connection with the 25 anniversary of independence of the Kyrgyz Republic and the 100 anniversary of national liberation revolt of 1916

Showing respect for the commonly accepted human rights and freedoms, proceeding from the principles of humanity and mercy, and in connection with the 25 anniversary of independence of the Kyrgyz Republic and 100-year-old national liberation revolt of 1916:

Article 1

Exempt from criminal liability and custodial sanction, and also from the punishments which are not connected with imprisonment:

1) minors, for the first time convicts for a period of up to 5 years;

2) men is more senior than 60 years, and also 55 years are more senior than women;

3) persons with limited opportunities of health of I and II groups;

4) the persons who are the single supporter in family, having at least two minor children or children with limited opportunities of health of I and II groups;

5) persons condemned for crimes of small weight and less serious crimes which unexpired part of punishment on the date of the introduction of this Law in force constitutes less than one year;

6) persons who for the first time committed crimes of small weight and less serious crimes.

Article 2

Exempt from criminal liability of persons for the crimes provided by part 1 of Article 336 ("Escape from the place of detention or from custody"), Article 337 ("Evasion from serving sentence in the form of imprisonment"), Article 359 ("Unauthorized leaving of part or the duty station"), part 1 of Article 360 ("Desertion") of the Criminal code of the Kyrgyz Republic if they within 3 months from the date of publication of this Law voluntarily were to places of serving sentence, the place of detention and passing of military service.

Article 3

Reduce the unexpired term of punishment to persons which are not falling under operation of article 1 of this Law:

1) the convict serving punishment sentence in colonies settlements - half;

2) condemned for intentional crimes to imprisonment for a period of up to 10 years inclusive - on one third;

3) condemned for intentional crimes to imprisonment for a period of up to 15 years inclusive - on one fifth;

4) the minor serving sentence in educational colony, condemned for intentional crimes to imprisonment for a period of up to 10 years inclusive - half.

Persons concerning whom according to this Law punishment terms are reduced within a month after publication of this Law shall be officially informed on new calculation of term of punishment and end date of term of serving sentence.

Article 4

1. Operation of article 1 of this Law does not extend:
