1. Approve the Payment procedure of the first five days of temporary disability owing to disease or the injury which is not connected with labor accident at the expense of means of the employer who is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine soglasnoperechnyu which is applied.

Payment procedure of the first five days of temporary disability owing to disease or the injury which is not connected with labor accident at the expense of means of the employer

1. This Procedure determines payment terms of the first five days of temporary disability owing to disease or the injury which is not connected with labor accident, to insured person (further - days of temporary disability) at the expense of means of the employer.

2. Payment of days of temporary disability is performed on principle place of employment of insured person and on place of employment in combination in the form of material security which fully or partially offsets loss of the salary (income).

3. The basis for payment of days of temporary disability is the disability leaf issued in accordance with the established procedure, and in case of part-time job - the copy of leaf of disability certified by the signature of the head, under seal on principle place of employment.

4. Days of temporary disability are not paid for the bases, the stipulated in Article 16 Laws of Ukraine "About obligatory national social insurance".

5. Days of temporary disability are paid depending on insurance years of service in the sizes determined by part one of article 17 of the Law of Ukraine "About obligatory national social insurance".

Insured persons whose insurance years of service for the last 12 months before loss occurrence constitute, according to the State register of obligatory national social insurance, less than six months have the right to payment of days of temporary disability in the amount of, determined proceeding from accrued payroll with which insurance premiums are paid, but does not exceed per month of the size of the minimum wage established by the law in month of loss occurrence.

The payment amount of days of temporary disability per month shall not exceed the size of the maximum size of accrual base of single fee with which insurance premiums were paid.

6. Calculation of the average salary for implementation of payment of days of temporary disability is carried out according to the Procedure for calculation of the average salary (the income, cash cover) for calculation of payments for obligatory national social insurance approved by the resolution of the Cabinet of Ministers of Ukraine of September 26, 2001 No. 1266 (The Official Bulletin of Ukraine, 2001, No. 40, the Art. 1802).

7. The expenses connected with payment of days of temporary disability belong to expenses of the companies, organizations, organizations, and for budgetary institutions - to their expenses by the corresponding code of economic classification of expenses of the budget.
