1. Approve the enclosed Rules of provision of innovative grants on commercialization of technologies.

2. Declare invalid the order of the Minister of investments and development of the Republic of Kazakhstan of February 27, 2015 No. 210 "About approval of Rules of provision of innovative grants on commercialization of technologies" (registered in the Register of state registration of regulatory legal acts for No. 12067, published on September 18, 2015 in information system of law of Ad_let).

3. To department of technology and innovative development of the Ministry for Investments and Development of the Republic of Kazakhstan () provide A.B. Batyrkozha:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within ten calendar days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 3 of this order.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of provision of innovative grants on commercialization of technologies

1. General provisions

1. These rules of provision of innovative grants on commercialization of technologies (further - Rules) are developed according to the subitem 16) of Item 2 of article 100 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 and determine procedure for provision of innovative grants on commercialization of technologies.

2. In these rules the following basic concepts are used:

1) the grantee – the physical and (or) legal entity who received innovative grant according to these rules;

2) the commission on grant financing (further – the commission) – collegiate organ which part the odd number of members of the commission from representatives of authorized body and other state and public organizations and the corresponding industries (under approval) and the staff of national institute of development in the field of technology development are (further – national institute), created within national institute for decision making on projects of applicants taking into account examination of requests and conditions of provision of the innovative grants established by these rules;

3) implementation (use) of results of scientific and (or) scientific and technical activities – the activities directed to realization of final stage of research and production cycle on production of new products or implementation of new technology;

4) authorized body in the field of the state support of industrial and innovative activities (further – authorized body) – the central executive body performing management in the field of the industry and industrial and innovative development, and also performing in limits, stipulated by the legislation cross-industry coordination and participation in realization of the state support of industrial and innovative activities;

5) innovative grant – the budgetary funds provided to subjects of industrial and innovative activities on a grant basis for implementation of their industrial and innovative projects within the priority directions of provision of innovative grants;

6) the decision of the commission – the protocol containing data on the decision on provision of grant based on results of vote of the members of the commission who are present at meeting, in case of equality of votes is deemed accepted the decision for which the commission chairman voted;

7) the request – the statement with appendix of necessary documents according to requirements of these rules

8) the applicant – physical person, registered as the individual entrepreneur, and (or) the legal entity, performing activities in the territory of the Republic of Kazakhstan, the request for the receipt of innovative grant which provided for consideration according to these rules;

9) technology – process and (or) complex of the equipment working in single production cycle which use provides new or advanced goods, works and services;

10) commercialization of technologies – the activities connected with practical application of results of scientific and (or) scientific and technical activities for the purpose of conclusion to the market of new or advanced goods, processes and services, directed to receipt of positive economic effect;

11) the contract on provision of grant for commercialization of technologies (further – the Agreement) – the agreement signed between national institute and the grantee on provision of grant;

12) national institute of development in the field of technology development – the national institute of development authorized on implementation of measures of the state support of industrial and innovative activities and coordination of processes of innovative development.
