About measures for further enhancement of special information portal of JSC Uzbek Republican Commodity and Raw Exchange and processes of implementation of the public and corporate procurements

For the purpose of increase in level of transparency and competition of the public and corporate procurements, the Cabinet of Ministers decides implementations in process of their implementation of modern information and communication technologies and warning of offenses in the course of purchases:

1. Determine that:

the conclusion of the agreement on the public and corporate procurements without preliminary placement of the declaration of their implementation on special information portal of JSC Uzbek Republican Commodity and Raw Exchange, except as specified, stipulated by the legislation is not allowed;

the conclusion of the agreement on the public and corporate procurements with the suppliers entered in the register of unfair suppliers is forbidden;

the heads and officials responsible for the organization of the public and corporate procurements bear the personal responsibility for strict observance of requirements of the legislation on the public and corporate procurements.

2. To provide JSC Uzbek Republican Commodity and Raw Exchange together with the interested ministries and departments:

development and deployment since January 1, 2017 of the software module providing forming and provision in open entry to all users of special information portal of JSC Uzbek Republican Commodity and Raw Exchange of information on price level, developed by results of the exchange biddings, the public and corporate procurements;

implementation during 2017 of the National qualifier of goods (works and services) for needs of the public and corporate procurements, electronic commerce;

during 2017-2018 step-by-step implementation of the mechanism of the organization of calculations for payment and delivery of products within agreements on the public and corporate procurements through clearing house with the organization of monitoring and control of execution of contractual commitments, and also provision to participants of purchases of services in remote control of means on their personal accounts in clearing house.

3. Approve Regulations on procedure for placement and disclosure of information on the public and corporate procurements on special information portal of JSC Uzbek Republican Commodity and Raw Exchange according to appendix.

4. To provide to JSC Uzbek Republican Commodity and Raw Exchange together with Training center on preparation and retraining of employees of financial bodies and financial and accounting divisions of state-financed organizations under the Ministry of Finance of the Republic of Uzbekistan carrying out on regular basis of advanced training of participants of process of the public and corporate procurements, with use of opportunities of the module of online training at special information portal of JSC Uzbek Republican Commodity and Raw Exchange.

5. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.

Regulations on procedure for placement and disclosure of information on special information portal of JSC Uzbek Republican Commodity and Raw Exchange

I. General provisions

1. This Provision determines procedure for placement and disclosure of information on special information portal of the joint-stock company "The Uzbek Republican commodity and raw exchange (further - UZRTSB).

2. Action of this provision extends to state-financed organizations, receivers of budgetary funds, receivers of means of off-budget Republican trust book fund under the Ministry of Finance of the Republic of Uzbekistan, Fund of development of children's sport under the Ministry of national education of the Republic of Uzbekistan, subjects of natural monopolies, the state unitary enterprises and economic societies with the state share in authorized fund more than 50 percent, to bodies of the public and economic board, and also other authorized bodies and users of special information portal of UZRTSB.

3. For the purpose of this provision the following determinations are used:

the agent - the legal entity who underwent the procedure of accreditation in UZRTSB, rendering to customers and suppliers professional services on ensuring their participation in the public and corporate procurements based on the agreement of the order;

public procurements - the purchases of goods (works, services) performed at the expense of means of budgets of budget system and other centralized sources;

the customer - the legal entity conducting the public and corporate procurements of goods (works, services);

the closed part of the portal - part of the portal where confidential information of the client, access to which certain categories of users according to this Provision have, is stored;

information on purchase implementation results - the information message about the signed agreement to deliver goods (works, services) in the public or corporate procurements;

the client - person placing information on the portal according to the legislation;

corporate purchases - the purchases of goods (works, services) performed by subjects of natural monopolies, the state unitary enterprises and economic societies with the state share in authorized fund more than 50 percent;

the declaration of implementation of purchases - the information message of the customer about terms and requirements of the public or corporate procurements placed on the portal;

open part of the portal - the public part of the portal providing provision to users of access to part of information placed by clients according to the procedure, determined by this Provision;

personal departmental office - the individual page of bodies of the public and economic board, other authorized bodies on special information portal of UZRTSB by means of whom access to necessary information in case of application is provided by them of the corresponding individual logins and passwords;

personal office - the individual page of customers or suppliers (their agents) on special information portal of UZRTSB by means of whom access to necessary information in case of application is provided by them of the corresponding individual logins and passwords;

the schedule - the document providing amounts and terms (annually or quarterly) order placements, goods (works, services);

users - bodies of the public and economic board, other authorized bodies, legal entities and physical persons to which according to this Provision the information access, placed on the portal is provided;

the supplier - business entity, including the individual entrepreneur performing delivery of goods (work, service) based on the agreement on the public or corporate procurements;
