About enforcement of the Law on production and turnover of ethyl alcohol and alcoholic products

In pursuance of provisions of the Law N 1100-XIV of June 30, 2000. "About production and turnover of ethyl alcohol and alcoholic products" (The official monitor, 2000, N 130-132, Art. 917) DECIDES: the Government of the Republic of Moldova

1. Approve:

Regulations on the State inspectorate for supervision of alcoholic products according to the appendix N1;

Regulations on the mode of specialized warehouses and procedure for their registration according to the appendix N2;

Regulations on procedure for determination of quality of the alcoholic products which are subject to marking easily soiled qualities according to the appendix N3.

2. Determine that the economic agents having the license for activities for production and turnover of ethyl alcohol and alcoholic products shall carry out inventory count of remaining balance of ethyl alcohol and hard alcoholic drinks as of May 1, 2001 on the basis of the existing regulations and to provide data on quantity of remaining balance of ethyl alcohol and hard alcoholic drinks to the Ministry of Agriculture, Water Resources and Processing Industry.

3. To impose control of carrying out inventory count on the Ministry of Agriculture, Water Resources and Processing Industry.

4. Determine that conversion or destruction of the confiscated alcoholic products, not the corresponding regulating documentation, and also the alcoholic products containing the ethyl alcohol received from non-food raw materials or the additives forbidden for its production are performed according to Regulations on procedure for the termination of release and (or) realization (accomplishment, rendering) of non-standard, low-quality products (processes, services), withdrawals from turnover of counterfeited products and destruction of products (processes, services), life-threatening and health of consumers and the environment, the approved Order of the Government of the Republic of Moldova N 1300 of December 31, 1998. (The official monitor, 1999, N 5-6, Art. 49) and the relevant provision approved by the Ministry of Agriculture and the food industry.

5. To the Ministry of Agriculture, Water Resources and Processing Industry till June 1, 2001:

together with the Ministry of Finance and Department on technical supervision, standardization and metrology to create the commission for check and sealing of devices for measurement of amount of the made products and spirtoizmeryayushchy devices established on the processing equipment used for production of ethyl alcohol and hard alcoholic drinks at all economic agents irrespective of type of property and legal form of the organization which perform activities in the field;

provide registration of the capital processing equipment used for production of ethyl alcohol and hard alcoholic drinks according to the provision approved by the ministry;

perform complex check of warehouses for storage and wholesale of alcoholic products concerning their compliance to provisions of the Law on production and turnover of ethyl alcohol and alcoholic products and to make relevant decisions on their activities.

6. To the Ministry of Internal Affairs in 2-month time:

develop and submit to the Government for approval Regulations on the State register of turnover of ethyl alcohol and alcoholic products;

perform registration of economic agents, owners of licenses in the field of production and turnover of alcoholic products in the State register of turnover of ethyl alcohol and alcoholic products.

7. To the Ministry of Finance till June 1, 2001:

create permanent tax posts at the companies making ethyl alcohol and hard alcoholic drinks according to the provision approved by the ministry and provide offers on procedure for financing of such posts;

provide offers on financing of creation of the State register of turnover of ethyl alcohol and alcoholic products, acquisition of the necessary equipment for the computerized system of accounting and maintaining the specified register.

8. To the Ministry of Finance to grant licenses for the right of import of ethyl alcohol to economic agents with indication of in the license of import volumes on the basis of pre-trial detention of the Ministry of Agriculture, Water Resources and Processing Industry.

9. To the Ministry of Finance together with the Ministry of Agriculture, Water Resources and Processing Industry to consider procedure for financing from non-budgetary sources of development of material and technical resources of the State inspectorate for supervision of alcoholic products.

10. To the Ministry of Agriculture, Water Resources and Processing Industry, the Ministry of Justice and the Ministry of Internal Affairs in 2-month time to develop and submit to the Government for consideration the bill on modification and amendments in the Criminal code and the Code of Administrative Offences regarding responsibility for violation of the Law on production and turnover of ethyl alcohol and alcoholic products.

11. Declare invalid Item 2 of the Order of the Government of the Republic of Moldova N 363 of June 5, 1995. "About creation of the State inspectorate for supervision of alcoholic products" (The official monitor, 1995, N 38-39, Art. 293; N 71-72, of the Art. 579).

12. To impose control over the implementation of this resolution on Valeriu Kosarchuk, the deputy prime minister.

I. General provisions

1. The state inspectorate for supervision of alcoholic products (further - Inspection) is effective based on the Law N1100-XIV of June 30, 2000.
