About approval of the Procedure of verification and monitoring of the state payments

According to part two of article 9 of the Law of Ukraine "About verification and monitoring of the state payments" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of verification and monitoring of the state payments which is applied. 

2. Determine that bodies which perform the state payments and also central and the local executive bodies, other state bodies, local government bodies, banks, funds of obligatory national social and pension insurance, organization, the organization and the company falling within the scope of management of state bodies which are owners, managers and/or administrators of the automated information systems, registers, databases of information on recipients provide to the Ministry of Finance the information necessary for implementation of verification and monitoring of the state payments determined by the legislation for appointment, charge and/or implementation of the state payments and influences determination of the right and the amount of such payments, including personal data.

Procedure of verification and monitoring of the state payments

1. This Procedure determines the mechanism of implementation of verification and monitoring of the state payments.

2. In this Procedure terms are used in the value given in the Law of Ukraine "About verification and monitoring of the state payments".

3. For the purpose of implementation of verification and monitoring of the state payments subjects of provision of information submit to the Ministry of Finance the information determined by the legislation for appointment, charge and/or implementation of the state payments and influencing determination of the right and the amount of such payments, personal data, information from the automated information systems, registers, databases, the owner, the manager and/or the administrator of which they are, including information with limited access.

In case of charge and receipt of the state payments intended on family or household, information is provided on each family member or households.

Subjects of provision of information are responsible for completeness, authenticity and timeliness of provision of information.

4. The procedure and terms of the exchange the information determined by the legislation for appointment, charge and/or implementation of the state payments and influencing determination of the right and the amount of such payments between the Ministry of Finance and subjects of provision of information, except banks, are determined by the Ministry of Finance together with subjects of provision of information if other is not provided by the law, taking into account requirements of the Law of Ukraine "About personal data protection".

Provision of information which contains bank secrecy is performed according to the Law of Ukraine "About banks and banking activity".

5. Verification of the state payments is performed in information and analytical platform by application of complex of actions for collection, carrying out the analysis and comparison of parameters of information obtained from subjects of provision of information with each recipient with the subsequent determination of compliance of information to the requirements established by the legislation influencing determination of the right and the amount of the state payments, and also detection of discrepancy of data in the automated information systems, registers, databases.

5-1. By results of preventive check the body performing the state payments in real time receives confirmation of conformity of the payment of the state information to the requirements of the legislation influencing determination of its right and the amount of the state payments, or the recommendation concerning conducting additional verification of information which contains discrepancies, in the presence in information and analytical platform of necessary information provided by the recipient for appointment.

The information access in information and analytical platform of the bodies performing the state payments is performed according to the procedure, established by the Cabinet of Ministers of Ukraine.

6. By results of the current and retrospective check the Ministry of Finance monthly to the 25th provides to the bodies performing the state payments, recommendations relatively:

1) conducting additional verification of information which contains discrepancies;

2) elimination of discrepancies of data in the automated information systems, registers, databases, the owner, the manager and/or the administrator of which is the body which performs the state payments.

The recommendation concerning each recipient is created based on one or several revealed discrepancies.

7. The Ministry of Finance informs on these recommendations quarterly the Cabinet of Ministers of Ukraine.

8. The body which performs the state payments processes the received recommendations in time, not exceeding 15 working days from the date of their obtaining.

9. By results of processing of the recommendations provided by the Ministry of Finance the body performing the state payments makes the decision about:

1) purpose (recalculation) of the state payment;

2) termination of charge and/or implementation of the state payment;

3) renewal of charge and/or implementation of the state payment;

4) elimination of discrepancies of data in the automated information systems, registers, databases, the owner, the manager and/or the administrator of which is the body which performs the state payments.

The body which performs the state payments by results of study of recommendations provides to the Ministry of Finance information on the made decisions within five working days from the date of their acceptance.

10. The Ministry of Finance after receipt of information on the made decisions by results of study of recommendations by the bodies performing the state payments carries out monitoring of study of recommendations, including the analysis of their accounting by the specified bodies, and also uses information obtained by results of the carried-out analysis of results of verification during the budget process.
