According to article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the sphere of protection of plants is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service for safety issues of foodstuff and consumer protection, according to appendix is determined.

2. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of May 27, 2009 "About approval of criteria by which the risk degree from implementation of economic activity in the sphere of protection of plants is estimated and is determined No. 513 frequency of implementation of planned actions of the state supervision (control)" (The Official Bulletin of Ukraine, 2009, No. 39, the Art. 1313);

Item of 24 changes which are made to resolutions of the Cabinet of Ministers of Ukraine concerning activities of the Public veterinary and phytosanitary service, approved by the resolution of the Cabinet of Ministers of Ukraine of August 10, 2011 No. 853 (The Official Bulletin of Ukraine, 2011, No. 61, the Art. 2439).

Criteria by which the risk degree from implementation of economic activity in the sphere of protection of plants is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service for safety issues of foodstuff and consumer protection is determined

1. Risk degree assessment from implementation of economic activity in the sphere of protection of plants is performed by the following criteria:

class of danger of pesticides in storage time, transportations, trade and/or application of remedies of plants;

availability of the facts of violation of requirements of the legislation in the sphere of protection of plants.

2. Taking into account criteria for evaluation of risk degree from implementation of economic activity in the sphere of protection of plants subjects of managing treat one of three risk degrees - high, average or insignificant.

3. With high risk concern subjects which to subjects of managing:

store, transport, perform trade and/or apply danger class pesticides I and II;

allowed violations of requirements of the legislation in the sphere of protection of plants.

4. Subjects which store concern to subjects of managing with average risk degree, transport, perform trade and/or apply danger class pesticides III.

5. With insignificant risk degree concern subjects which to subjects of managing:

store, transport, perform trade and/or apply danger class pesticides IV;

do not treat subjects of managing with high and average risk degree.

6. If subjects of managing with average or insignificant risk degree, treat high risk based on the elicited facts of violations of requirements of the legislation in the sphere of protection of plants, and by results of at least two following planned events of the state supervision (control) the facts of the corresponding violations are not elicited, such subjects treat average or insignificant risk degree.

7. Planned actions of the state supervision (control) of activities of subjects of managing in the sphere of protection of plants are performed concerning subjects:

with high risk - not more often than every two years;

with average risk degree - not more often than once in three years;

with insignificant risk degree - not more often than once in five years.

8. If by results of planned and unplanned actions of the state supervision (control) (in the presence) within the last six years for subjects of managing which are carried to average risk degree and within the last ten years for subjects of managing which are carried to insignificant risk degree, at the subject of managing violations of requirements of the legislation in the sphere of protection of plants are not revealed, the following planned event of the state supervision (control) concerning such subject of managing is held not earlier than through the period of time established for the corresponding risk degree, increased in time 1,5.

If from the date of adoption of such decision by results of unscheduled inspections violations by the subject of managing of requirements of the legislation in the respective sphere are revealed, the following planned event of the state supervision (control) concerning such subject of managing is performed in the next planning period.

9. If the subject of managing can be carried at the same time to several risk degrees, such subject belongs to more high risk from to what it can be carried.
