Chapter 1. General provisions

Article 1. Subject of regulation of this Law

1. This Law governs the public relations between carriers, state bodies, passengers, consignors (senders), consignees (receivers), physical persons and legal entities when implementing public conveyance, baggage, loads, cargo baggage and mailings by rail.

2. Rail transport is constituent of single transport system of the Kyrgyz Republic. Rail transport consists of rail transport public, rail transport of uncommon use, and also technological rail transport.

Article 1-1. Purposes, tasks and principles of this Law

1. The purposes of this Law are ensuring functioning of rail transport in interaction with other modes of transport, timely ensuring needs of the state, legal entities and physical persons in transportations by railway transport, creation of conditions for development of economy and ensuring unity of economic space in the territory of the Kyrgyz Republic.

2. Tasks of this Law are:

1) ensuring balance of interests of the state and users of services of rail transport;

2) protection of legitimate rights and interests of physical persons and legal entities, and also national interests of the Kyrgyz Republic;

3) providing priority of public concerns, protection of the domestic market of railway services;

4) creation of conditions for safe accomplishment of rail haulings.

3. Functioning of rail transport is performed proceeding from the following principles:

1) preserving integrity and ensuring smooth functioning of infrastructure and centralized dispatcher control with transportation process within infrastructure;

2) development of the high-level railway net and railway vehicles of rail transport;

3) stability of work and dynamic development of rail transport;

4) development of transportations;

5) availability and quality of the rendered services;

6) safety control of rail transport;

7) development of the competition and forming of the developed market of services of rail transport;

8) ensuring territorial integrity of the state;

9) coordination of functioning of single transport system of the state;

10) creation of conditions for free entrepreneurship for the purpose of investment attraction in development of rail transport and non-admission of illegal intervention of state bodies in economic activity;

11) ensuring environmental protection;

12) maintenance of mobilization readiness of rail transport.

Article 2. Legislation of the Kyrgyz Republic on rail transport

The legislation of the Kyrgyz Republic on rail transport is based on the Constitution of the Kyrgyz Republic and consists of this Law, other regulatory legal acts of the Kyrgyz Republic and come in the procedure established by the law into force of international treaties which participant is the Kyrgyz Republic.

Operation of this Law extends on the physical persons and legal entity performing activities in the field of rail transport, using services of rail transport irrespective of their pattern of ownership.

Features of the organization of ensuring military rail haulings are determined by separate regulatory legal acts of the Kyrgyz Republic in the field of armed forces and defense.
