About approval of the Regulations on approval procedure on exit trade

1. Approve and enact since October 15, 2016 Regulations on approval procedure on exit trade according to appendix.

2. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent according to offers of khokimiyats of areas (cities) in a month to approve:

the inventory which can be implemented through objects of exit trade in the territory of the Republic of Karakalpakstan, areas and the city of Tashkent, respectively, the Republics of Karakalpakstan approved with territorial subdivisions of bodies of the State Tax Service, the centers of the state sanitary and epidemiological surveillance, areas and the city of Tashkent;

the schemes of dislocation of objects of exit trade by each area (city) with indication of the number of places, the list of implementable goods and the period of exit trade approved with territorial subdivisions of bodies of the State Tax Service, the Ministry of Internal Affairs, Gosarkhitektstroy of the Republic of Uzbekistan, the centers of the state sanitary and epidemiological surveillance of the Republic of Karakalpakstan, areas and the city of Tashkent respectively.

3. To the State Tax Committee together with the Ministry of Justice of the Republic of Uzbekistan and other interested ministries and departments to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on the changes and amendments in the legislation following from this resolution in a month.

4. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution.

5. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.

Regulations on approval procedure on exit trade

Chapter I. General provisions

1. This Provision according to the laws of the Republic of Uzbekistan "About allowing procedures in the field of business activity", "About consumer protection" and the resolution of the President of the Republic of Uzbekistan of September 28, 2015 No. PP-2412 "About measures for further enhancement of procedure for rendering the state services to subjects of entrepreneurship for the principle "one window" determines approval procedure on exit trade in the territory of the Republic of Uzbekistan.

2. Requirements of this provision do not extend on:

implementation of exit trade based on the signed agreements with legal entities on trade servicing in festive and holiday days, with indication of in the agreement of assortment and goods quantity exposed in case of exit trade;

carrying out exhibition and fair trade based on decisions of the President of the Republic of Uzbekistan and the Cabinet of Ministers of the Republic of Uzbekistan;

retail trade by fruit and vegetable products and potatoes in the places allocated for these purposes and also sales of goods in the territory of the markets;

sales of products of public catering in specially allotted places;

other cases which procedure is provided by separate decisions of the President of the Republic of Uzbekistan and the Cabinet of Ministers of the Republic of Uzbekistan.

3. The right to exit trade in the territory of the Republic of Uzbekistan is granted to legal entities on the basis of the issued permission to exit trade (further - permission) in form according to appendix No. 1 to this Provision, with approval of the scheme of arrangement of object of exit trade.

4. Issue of permission is performed according to the scheme according to appendix No. 2 to this Provision.

5. In this Provision the following basic concepts are used:

exit trade - retail trade food and nonfoods out of stationary outlets with use of objects of exit trade;

objects of exit trade - the portable shopping facilities (trays, counters, tents, autoshops and others) deployed on a temporary basis and having seasonal or special-purpose character, and also requiring after completion of the working day of dismantle and transfer of object;

the place of exit trade - the place of territorial arrangement of object of exit trade specified in permission;

the applicant - the legal entity who submitted the application for issue of permission.

6. Permission, with appendix of the approved scheme of arrangement of object of exit trade, is issued by khokimiyat of the area (city) (further - authorized body) through the Centers of the state services (further - the Center).

7. Khokimiyats of areas (cities) annually till November 1 prepare offers on:

to the inventory which can be implemented through objects of exit trade in the territory of the respective area (city);

to arrangement of objects of exit trade in the territory of the respective area (city) with indication of the number of places, the list of implementable goods and the period of exit trade.

The prepared offers annually till November 10 are submitted for consideration and approval in Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent respectively.

8. The Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent approve provided:

inventories which can be implemented through objects of exit trade in the territory of the respective area (city) - with territorial subdivisions of bodies of the State Tax Service, the centers of the state sanitary and epidemiological surveillance of the Republic of Karakalpakstan, areas and the city of Tashkent respectively;
