About citizenship of Ukraine

This Law according to the Constitution of Ukraine determines legal content of citizenship of Ukraine, the basis and procedure for its acquisition and termination, power of the public authorities which are taking part in the solution of questions of citizenship of Ukraine, procedure for appeal of decisions concerning nationality, actions or failure to act of public authorities their official and officials.

Section I. General provisions

Article 1. Determination of terms

In this Law the terms below are used in the following value:

citizenship of Ukraine - the legal bond between physical person and Ukraine finding the expression in their mutual rights and obligations;

person - physical person;

the citizen of Ukraine - person who acquired citizenship of Ukraine according to the procedure, provided by the laws of Ukraine and international treaties of Ukraine;

the foreigner - person who does not consist in citizenship of Ukraine and is citizen (subject) of other state or the states;

the stateless person - person who any state according to the legislation does not consider the citizen;

persons having outstanding merits in front of Ukraine or acceptance of which to citizenship of Ukraine is of state interest to Ukraine, - foreigners and stateless persons which activities in economic, humanitarian spheres, in particular in education, sciences, cultures, arts, sport, the social sphere and/or in the field of health care, public administration, in spheres of homeland security and defense, fight against crime, protection of constitutional rights and freedoms of man and citizen, strengthenings of the international authority of Ukraine, charity and other important spheres of public life of Ukraine, are the basis for preparation by the central executive bodies in the respective sphere of representation addressed to the President of Ukraine that acceptance in citizenship of Ukraine of such persons is of state interest to Ukraine or such persons have outstanding merits in front of Ukraine;

legal representatives are parents, adoptive parents, parents tutors, adoptive parents, guardians, custodians, representatives of organizations who fulfill duties of guardians and custodians;

the child - person aged up to 18 years;

registration of citizenship of Ukraine - entering of information on person into departmental information system of the central executive body realizing state policy in the field of nationality that confirms the fact of acceptance by special representatives by bodies of decisions on acquisition-faced citizenship of Ukraine, the edition of the corresponding presidential decree of Ukraine about acceptance of the foreigner or stateless person in citizenship of Ukraine;

stay in the territory of Ukraine - stay in Ukraine of the foreigner or the stateless person which according to the procedure, established by the legislation of Ukraine, including the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine, drove to Ukraine and constantly or temporarily live in its territory or which are in the territory of Ukraine during action of the visa, or for the period established by the legislation of Ukraine, including the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine or if the term of their stay in the territory of Ukraine is prolonged in accordance with the established procedure;

permanent residence in the territory of Ukraine - residence in Ukraine of the foreigner or stateless person based on the valid types issued in accordance with the established procedure on permanent residence or the certificate of the refugee or the document confirming provision of shelter in Ukraine;

temporary residence in Ukraine - residence in Ukraine of the foreigner or stateless person based on the valid type issued in accordance with the established procedure on temporary residence in Ukraine;

continuous accommodation in the territory of Ukraine - permanent residence in the territory of Ukraine persons if its one-time trip abroad on private affairs did not exceed 90 days, and in the amount in year - 180 days. Departure of person abroad in official journey, on training, on treatment, rehabilitation is not violation of the requirement about continuous accommodation that is confirmed by the relevant document of the company, organization, organization, organization of education, healthcare institution, organization of rehabilitation;

obligations to stop foreign citizenship - in writing issued application of the foreigner that in case of acquisition of citizenship of Ukraine he will stop nationality (citizenship) of other state or nationality (citizenship) of other states and within two years from the moment of acquisition of citizenship of Ukraine by it will file the document on the termination of nationality (citizenship) of other state or grazhdanstvo (citizenship) of other states to body which issued it the temporary certificate of the citizen of Ukraine;

the reason of non receipt of the document independent from the face on the termination of foreign citizenship (citizenship) - lack of distribution to person at whom authorized bodies of the state of his nationality (citizenship) accepted the petition for the termination of foreign citizenship (citizenship) authorized body of such state of the document on the termination of nationality (citizenship) of person in the time established by the legislation of foreign state (except cases when to person it was refused the termination of nationality (citizenship) or within two years from the date of submission of the petition if term is not established, or absence in the legislation of foreign state of the procedure of the termination of his nationality (citizenship) at the initiative of person or non-realization of such procedure;

the declaration on refusal of foreign citizenship of person which in the procedure established by the legislation of Ukraine signed the contract for passing of military service in the Armed Forces of Ukraine to the Public special service of transport or National guard of Ukraine - the document, in which the foreigner who in the procedure established by the legislation of Ukraine passes military service under the contract in the Armed Forces of Ukraine to the Public special service of transport or National guard of Ukraine or in the procedure established by the legislation of Ukraine passed military service under the contract in the Armed Forces of Ukraine, the Public special service of transport or National guard of Ukraine , the contract of which is stopped, and discharged from military service on the bases provided by subitems "a", "b", "v" of Items 1, of 2, subitems "a", "b" of Item 3 parts five of article 26 of the Law of Ukraine "About military obligation and military service" certifies the refusal of nationality (citizenship) of other state or grazhdanstvo (citizenship) of other states;

the declaration on refusal of foreign citizenship of person having outstanding merits in front of Ukraine or acceptance of which in citizenship of Ukraine is of state interest to Ukraine, - the document in which the foreigner who has outstanding merits in front of Ukraine or acceptance of which in citizenship of Ukraine is of state interest to Ukraine, certifies the refusal of nationality (citizenship) of other state or grazhdanstvo (citizenship) of other states;

the declaration on refusal of foreign citizenship of person which passes in the procedure established by the legislation of Ukraine / passed military service under the contract in the Armed Forces of Ukraine, the Public special service of transport or National guard of Ukraine and is awarded by the state award of Ukraine, - the document in which the foreigner who in the procedure established by the legislation of Ukraine passes military service under the contract in the Armed Forces of Ukraine, the Public special service of transport or National guard of Ukraine or who in the procedure established by the legislation of Ukraine passed military service under the contract in the Armed Forces of Ukraine, the Public special service of transport or National guard of Ukraine which contract is stopped and is discharged from military service on the bases provided by subitems "a", "b", "v" of Items 1, of 2, subitems "a" Item 3 parts five of article 26 of the Law of Ukraine "About conscription and military service", it is also awarded by the state award of Ukraine, certifies the refusal of nationality (citizenship) of other state or grazhdanstvo (citizenship) of other states;
