About information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Pension fund of Ukraine

According to article 13 of the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming", to the Law of Ukraine "About obligatory national pension insurance" and for the purpose of ensuring information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Pension fund of Ukraine PRIKAZYVAYEM:

1. Approve the Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Pension fund of Ukraine which is applied.

2. Determine that:

1) before introduction of information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Register) and information systems of the Pension fund of Ukraine in real time such interaction is performed in working hours taking into account technical capabilities of the Register and information systems of the Pension fund of Ukraine according to the legislation, but with interval no more than 2 hours;

2) before implementation of exchange of documents electronically between the Register and information systems of the Pension fund of Ukraine on representation of requests by the state registrars of legal entities, physical persons entrepreneurs and public forming and transfers to the Register of data on lack (availability) of debt on payment of insurance means to the Ukraine Pension fund and Social Insurance Funds such data are transferred by the Pension fund of Ukraine to the Register taking into account technical capabilities of the Register and information systems of the Pension fund of Ukraine, namely:

about availability of debt on payment of insurance means in the Pension fund of Ukraine and Social Insurance Funds - by the direction of notifications on availability of the objections against carrying out state registration of the termination of the legal entity as a result of its liquidation provided to the state registrar;

about absence of debt on payment of insurance means in the Pension fund of Ukraine and Social Insurance Funds - by the direction of notifications on withdrawal of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation.

3. The state registrar of legal entities, physical persons entrepreneurs and public forming uses the data provided by the subitem 2 of Item 2 of this order, which arrived from the Pension fund of Ukraine before introduction of the corresponding exchange of documents electronically between the Register and information systems of the Pension fund of Ukraine.

4. Declare invalid the order of the Ministry of Justice of Ukraine, the Ministry of social policy of Ukraine of September 28, 2015 No. 1830/5/967 "About information exchange between the Unified State Register of Legal Entities and physical persons entrepreneurs and information systems of the Pension fund of Ukraine", registered in the Ministry of Justice of Ukraine on October 5, 2015 on No. 1194/27639.

5. To the technical administrator Reestra and the Pension fund of Ukraine to take the adequate measures necessary for implementation of this order.

6. To department of private law of the Ministry of Justice of Ukraine () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

7. This order becomes effective from the date of, its official publication following behind day.

Procedure for information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming and information systems of the Pension fund of Ukraine

1. This Procedure determines the mechanism of information exchange between the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Register) and information systems of the Pension fund of Ukraine, including exchange of documents electronically (further - Information exchange).

In this Procedure it is necessary to understand requests of the subject of state registration, data on lack (availability) of debt on payment of insurance means in the Pension fund of Ukraine and Social Insurance Funds as the term "documents electronically" - in day of receipt of request from the subject of state registration, data on lack (availability) of debt on payment of insurance means in the Pension fund of Ukraine and Social Insurance Funds - within 30 calendar days from the date of receipt of data on carrying out registration action concerning the beginning of holding the simplified procedure of state registration of the termination of the legal entity as a result of its liquidation, and also other documents electronically provided by the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming".

2. Information exchange is performed at the central level electronically by information and telecommunication means with use of means of technical and cryptographic information security according to requirements of the legislation concerning information security.

3. Information exchange according to this Procedure is performed free of charge.

4. Information exchange is provided by the technical administrator Reestra and the Pension fund of Ukraine.

5. The means of technical and cryptographic information security having the certificate of conformity or the positive expert opinion by results of state examination in the sphere of technical and cryptographic information security are applied to information security.
