About quality and safety of food products
This Law determines the legal basis of providing the population with high-quality and safe food products.
Requirements of this Law extend also to perfumery, cosmetic goods and tobacco products.
In this law the following basic concepts are applied:
safety food to veterinary, veterinary and sanitary, phytosanitary rules and regulations;
dietary supplements to food - concentrates natural or identical natural biologically active agents received in case of conversion of food staples or artificial method and intended for direct acceptance with food or introductions in structure of foodstuff;
the sanitary and epidemiologic conclusion - the document certifying compliance of food products and the equipment intended for its production and use, to health regulations, regulations and hygienic standard rates;
identification of foodstuff and food staples - establishment of compliance of foodstuff and food staples to the distinctive characteristics determined by regulating and (or) technical documentation for products of specific type and the name;
quality of food products - set of characteristics which cause consumer properties of food products and ensure its safety for life and human health;
the address of food products - the activities connected with production, procurement, purchase, conversion, delivery, storage, transportation and realization of food products;
food products - food staples (including ethyl alcohol), foodstuff (including alcoholic beverages) and their ingredients, substances, materials, including auxiliary and packaging, and the products from them contacting to food staples and foodstuff;
nutritional supplements - the natural or synthesized substances, connections which are purposely entered into foodstuff for the purpose of giving by it of the set properties and (or) their preserving;
foodstuff - the products made from food staples and used in food in the natural or processed type;
products of baby food - the specialized foodstuff answering to physiological features of children's organism (up to three years);
food staples - objects of vegetable, animal, microbiological, and also mineral origin, the water used for production of foodstuff;
realization of food products - sale, delivery and other forms of transfer of food products under certain conditions;
expiration date (use term) of food products - period of time during which the food products are suitable for use in case of observance of requirements of regulations and safety rules in case of its storage, transportation, realization and after which it can pose hazard to life and human health;
toksikologo-hygienic examination - complex of the laboratory researches of food products intended for comparison to the existing regulations and rules;
packaging, auxiliary materials and products from them - the means applied for the purpose of protection of food products against external impacts in the course of the address;
falsification of food products - intentional change of properties and characteristics of food staples and foodstuff or their substitution;
energy drinks - the drinks containing caffeine in the quantity exceeding 150 mg/l, and (or) other components in quantity sufficient for rendering the toning effect on human body.
The legislation on quality and safety of food products consists of this Law and other acts of the legislation of the Republic of Uzbekistan.
Legal regulation of quality and safety of food products in the Republic of Karakalpakstan is performed as well by the legislation of the Republic of Karakalpakstan.
If the international treaty of the Republic of Uzbekistan establishes other rules than provided by this Law, then rules of the international treaty are applied.
Public administration in the field of quality assurance and safety of food products is performed by Service of sanitary and epidemiologic wellbeing and public health of the Republic of Uzbekistan, the State committee of veterinary science and development of livestock production of the Republic of Uzbekistan, the State inspectorate for quarantine of plants under the Cabinet of Ministers of the Republic of Uzbekistan, the Uzbek agency of standardization, metrology and certification and other bodies (further - state supervision bodies) determined by the legislation.
Public administration in the field of quality assurance and safety of food products includes:
state registration of food products and the equipment intended for its production and use in contact with foodstuff;
certification of food products;
state supervision and control;
planning of actions for quality assurance and safety of food products.
The state regulation in the field of quality assurance and safety of food products is performed by establishment sanitary, veterinary, veterinary health regulations and regulations, phytosanitary regulations, rules and hygienic standard rates, state standards, specifications (further - regulations and rules) containing quality requirements and safety of food products, to conditions of its production, procurement, purchase, conversion, delivery, storage, transportation and realization.
Regulations and rules on quality and safety of food products affirm state bodies according to the procedure, established by the legislation, and are obligatory for the legal entities and physical persons operating in the sphere of the address of food products.
Food products, and also the equipment intended for its production and use in contact with foodstuff can be made, be imported on the territory of the Republic of Uzbekistan, be implemented and be applied after assessment of their compliance to requirements of regulations and rules on quality and safety of food products and their state registration.
State registration of the food products and the equipment allowed to the address in the territory of the Republic of Uzbekistan made in the Republic of Uzbekistan and imported is performed by bodies of the state sanitary inspection in case of issue of the sanitary and epidemiologic conclusion.
It is not allowed:
state registration of different types of food products under the identical name;
repeated registration of the same type of food products under one or various names;
registration of foodstuff, food, fodder and the dietary supplements to food containing narcotic substances.
