1. Approve the enclosed technique of determination of basic rural settlements.

2. Declare invalid the order of the First deputy Premier-Ministra of the Republic of Kazakhstan - the Minister of Regional Development of the Republic of Kazakhstan of September 18, 2013 No. 234/ODES "About Approval of Technique of Determination of Basic Rural Settlements" (registered in the Register of the state registration of regulatory legal acts for No. 8821, No. 325 published in the Kazakhstanskaya Pravda newspaper on November 28, 2013 (27599).

3. To department of regional policy and development of local self-government of the Ministry of national economy of the Republic of Kazakhstan to take necessary measures for timely approval of the List of basic rural settlements.

4. To provide to department of regional policy and development of local self-government of the Ministry of national economy of the Republic of Kazakhstan:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of item 4 of this order.

5. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

6. This order becomes effective after ten calendar days after day of its first official publication.

Technique of determination of basic rural settlements

1. General provisions

1. This technique of determination of basic rural settlements (further - the Technique) is developed according to the Development program of regions till 2020 approved by the order of the Government of the Republic of Kazakhstan of June 28, 2014 No. 728.

2. The technique establishes algorithm of actions of local executive bodies of area together with akimats of areas (the cities of regional value) by determination of basic rural settlements (further - OSNP).

2. Criteria of determination of OSNP

3. OSNP are determined from among rural settlements (further - SNP):

1) the being centers of rural districts, villages and settlements, not being part of the rural district;

2) having the high or average potential of social and economic development with the level of potential not lower than 50 points;

3) located in radius at least 20 kilometers from the city or the district center;

4) with population is at least arithmetic-mean indicator of the area among the centers of the rural districts, villages and settlements which are not part of the rural district.

4. In case of determination of OSNP it is considered:

1) the central arrangement in system of settlements and the optimum radius of scope of group of settlements is preferential;

2) the basic company is preferential (large farm-production and others.);

3) the border arrangement is preferential;

4) arrangement from other OSNP at distance at least 50 kilometers;

5) the developed social and engineering infrastructure;

6) the territory for perspective development and building (availability of free lands, lack of the limiting factors);

7) transport availability to the markets;

8) favorable ecological situation.

3. Algorithm of actions of local executive bodies

5. The local executive body of the area (the city of regional value) according to criteria of determination of OSNP of this technique creates and represents the list of OSNP to local executive body of area.

6. The local executive body of area in coordination with authorized body in the field of regional development determines the list of OSNP.

4. Information sources

7. Information sources for determination of OSNP are:

1) data of nation-wide statistical observations;

2) information obtained from local executive bodies during inspection of social and economic condition and perspectives of development of SNP;

3) data of departmental observations.
