About drugs and psychotropic (psychoactive) substances

This Law governs the relations connected with drug trafficking and psychotropic (psychoactive) substances and also for the purpose of ensuring health of citizens, safety of the state and society establishes the legal basis of state policy according to the prevention of their illicit trafficking and fixed assets of fight against drug addiction.
Operation of this Law extends to the processes providing legal drug trafficking and psychotropic (psychoactive) substances, and also preventing their illicit trafficking in the territory of the Republic of Armenia.
1. The legislation of the Republic of Armenia on drugs, psychotropic (psychoactive) substances and their precursors, medicines consists of this Law, other laws and legal acts.
2. If the international ratified treaty of the Republic of Armenia establishes other regulations, than those which are provided by this Law then are applied regulations of the international treaty.
In this Law the following basic concepts are used:
drugs – any substances of natural or synthetic origin, their medicines, plants which, according to the legislation of the Republic of Armenia and international treaties of the Republic of Armenia, including the Single convention of the UN "About drugs" 1961, are included in the List, the drugs which are subject to control in the Republic of Armenia, psychotropic (psychoactive) substances and their precursors;
psychotropic (psychoactive) substances – any substances of natural or synthetic origin, their medicines, plants which, according to the legislation of the Republic of Armenia and international treaties of the Republic of Armenia, including the Convention of the UN "About psychotropic substances" 1971, are included in the List of the drugs, psychotropic (psychoactive) substances and their precursors which are subject to control in the Republic of Armenia;
precursors of drugs and psychotropic (psychoactive) substances (further – precursors) – substances which are used during the obtaining, production, production, conversion of drugs and psychotropic (psychoactive) substances, according to the legislation of the Republic of Armenia, international treaties of the Republic of Armenia, including the Convention of the UN "About fight against illicit trafficking in drugs and psychotropic substances" 1988, included in the List of the drugs, psychotropic (psychoactive) substances and their precursors which are subject to control in the Republic of Armenia;
medicines – mix of the substances which are in any physical condition which contains one or several drugs or the psychotropic (psychoactive) substances included in the List of the psychotropic (psychoactive) substances and their precursors which are subject to control in the Republic of Armenia;
legal drug trafficking, psychotropic (psychoactive) substances and their precursors – development, production, production, conversion, wholesale trade, transportation, storage, leave, realization, acquisition, use, delivery, distribution, export, import and destruction of drugs, psychotropic (psychoactive) substances and their precursors, according to the legislation of the Republic of Armenia;
drug trafficking, psychotropic (psychoactive) substances and their precursors – the drug trafficking, psychotropic (psychoactive) substances and their precursors performed with violations of the law of the Republic of Armenia (further – drug trafficking, psychotropic (psychoactive) substances);
drug addiction – the disease caused by the use of drugs and (or) psychotropic (psychoactive) substances according to the classification of diseases operating in the Republic of Armenia;
sick drug addiction – person who received the diagnosis "drug addiction" as a result of the physical examination conducted in the procedure established by this Law;
analogs (equivalents) of drugs and psychotropic (psychoactive) substances – the substances forbidden for turnover in the Republic of Armenia having synthetic or natural origin not included in the List of the drugs, psychotropic (psychoactive) substances and their precursors which are subject to control in the Republic of Armenia which chemical composition and properties are similar to the chemical composition and properties of those drugs and psychotropic (psychoactive) substances which psychostimulating action they reproduce;
hemp - the blossoming or fructifying heads konoplevy from which pitch, irrespective of the name used for them was not extracted;
hemp plant - any plant of sort of konoplevy (Cannabis);
hemp pitch - the separated pitch purified or crude, received from hemp plant;
shank of plant of industrial hemp - the separated part of plant of hemp (stalk with leaves) used for vegetative reproduction;
industrial hemp - the hemp plant provided for the purposes provided by this Law in which content of kannabidiol (CBD) exceeds content of tetrahydrocannabinol (THC) at the same time percentage of tetrahydrocannabinol (THC) is equal in the weight which is selected for test or below percent 0,3;
cultivation of industrial hemp - all process of cultivation of plant of hemp;
process of conversion of industrial hemp - extraction of pitch of industrial hemp from plants from which it turns out and also processes by means of which turn out oil, paper, construction materials, threads or other processed materials;
the real beneficiary - person who is the real beneficiary in sense of the Law "About Anti-money Laundering and Terrorism Financing";
the interconnected person - person who is considered interconnected with person in sense of Items 25-27 of part 1 of article 3 of the Law "About State Registration of Legal Entities, the State Accounting of the Allocated Divisions, Organizations of Legal Entities and Individual Entrepreneurs";
derivatives of drugs and psychotropic (psychoactive) substances (further - derivatives) - materials of synthetic or natural origin which are not included in the separate lines in the list of drugs, psychotropic (psychoactive) substances their precursors which are subject to supervision in the Republic of Armenia which chemical structure was formed by change (formal replacement) of one or several atoms of hydrogen, halogens or hydroxyl groups in chemical structure of the corresponding drug or psychotropic substance, either unambiguous or two-digit atoms or substitutes (except for hydroxyl and carboxyl groups) in which the total quantity of atoms of hydrogen shall not exceed amount of atoms of hydrogen in initial chemical structure of the corresponding drug or psychotropic substance. If the same substance can be considered derivative several drugs or psychotropic substances, it is recognized to derivatives of that drug or psychotropic substance which change of chemical structure requires inclusion of the minimum quantity of substitutes or atoms.
1. The composition (list) of the drugs, psychotropic (psychoactive) substances and their precursors which are subject to control in the Republic of Armenia affirms the Government of the Republic of Armenia. Changes in composition of drugs and psychotropic (psychoactive) substances are made according to the procedure, established by the Government of the Republic of Armenia.
2. Depending on methods and control facilities as a part of drugs, psychotropic (psychoactive) substances and their precursors the following lists are selected:
1) drugs and psychotropic (psychoactive) substances (The list 1) which turnover in the territory of the Republic of Armenia is forbidden (further - the forbidden substances);
