1. Approve the Procedure and conditions of wages determination for calculation of pension of the government employee which are applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

3. This resolution becomes effective from the date of entry into force of the Law of Ukraine of November 17, 2011 No. 4050-VI "About public service".

Procedure and conditions of wages determination for calculation of pension of the government employee

1. These the Procedure and conditions establish the mechanism of wages determination for appointment and recalculation of pension of the government employee according to the Law of Ukraine of November 17, 2011 No. 4050-VI "About public service" (further the Law).

2. The official pay rate, the allowance for rank or qualification class, the class rank or special rank, length of service in case of wages determination for award of pension are considered in the sizes established on the date of award of pension on the last post provided by Items 1 - 7 and 12 parts two of article 35 of the Law.

At the request of officials of local self-government who worked at elective offices in local government bodies eight and more years or during complete two and more convocations, since convocation of 1990, and also persons determined by items 4 and the 7th Section IX "Final and transitional provisions" of the law the payments provided by paragraph one of this Item are considered in the sizes established on the date of award of pension on the last held elective office or position of public service which they held on the date of entry into force of the Law.

3. The amount of other payments (except official pay rate, the allowance for rank or qualification class, the class rank or special rank, length of service), join in the salary for award of pension which is determined:

in case of the request for award of pension during the period from January 1, 2014 to December 31, 2015 inclusive and after this date provided that for the period since January 1, 2014 person has no 24 calendar months of work on the positions granting the right to such type of pension before the request for award of pension, - for all complete calendar months of work since January 1, 2014 before date of the address. The average monthly amount of the specified payments is determined by division of total amount of the payments received for the complete months fulfilled during this period on the positions granting the right to such type of pension on number of these months since January 1, 2014 before date of the address. At the request of person for calculation of the average monthly amount of the specified payments incomplete months can be considered;

in case of the request for award of pension after January 1, 2016 - for the last complete 24 calendar months of work on the positions granting the right to such type of pension, in a row before the request for award of pension, but not earlier than January 1, 2014, irrespective of availability of breaks during this period at the specified work. The average monthly amount of the specified payments in 24 complete calendar months of work is determined by division of total amount of these payments on 24. At the request of person for calculation of the average monthly amount of the specified payments incomplete months can be considered;

in case of the request for award of pension during the period from January 1, 2014 to December 31, 2018 inclusive and after this date provided that for the period since January 1, 2014 person has no 60 calendar months of work on the positions granting the right to such type of pension, in a row before the request for award of pension - for all complete calendar months of work since January 1, 2014 before date of the address. The average monthly amount of the specified payments is determined by division of total amount of the payments received for the complete months fulfilled during this period on the positions granting the right to such type of pension on number of these months. At the request of person for calculation of the average monthly amount of the specified payments incomplete months can be considered;

in case of the request for award of pension after January 1, 2019 - for any 60 calendar months of work on the positions granting the right to such type of pension, in a row before the request for award of pension since January 1, 2014 irrespective of availability of breaks during this period at the specified work. The average monthly amount of the specified payments for 60 complete calendar months is determined by division of total amount of these payments on 60. At the request of person for calculation of the average monthly amount of the specified payments incomplete months can be considered.
