For the purpose of accomplishment of provisions of Item b) article 3 of the Code of road transport No. 150 of July 17, 2014 (The official monitor of the Republic of Moldova, 2014, Art. No. 247-248, 568) DECIDES: the Government

1. Approve Rules of motor transportation carriages of goods it (is applied).

2. Rules of motor transportation carriages of goods become effective in 30-day time from the date of publication in the Official monitor of the Republic of Moldova.

3. To the Ministry of Economy and Infrastructure in 3-month time from the date of entry into force of these rules to bring the regulations into accord with this Resolution.

4. To impose control over the implementation of this resolution on the Ministry of Economy and Infrastructure.

Rules of motor transportation carriages of goods

I. General provisions

1. Rules of motor transportation carriages of goods (further – Rules) determine procedure for the organization of motor transportation carriages of goods in the territory of the Republic of Moldova and are applied to all companies registered in the territory of the Republic of Moldova and performing activities of the motor transportation operator and also foreign motor transportation operators according to bilateral agreements, international conventions and agreements which party is the Republic of Moldova, except for:

a) the physical persons performing motor transportation transportations by own road vehicles for personal reasons;

b) the companies performing activities for motor transportation transportations within the national communication with use only:

- road vehicles which top admissible speed does not exceed 40 km/h;

- the road vehicles used by the services of armed forces, services of civil protection, fire engineering services and forces responsible for maintenance of public order, or leased by them without driver when transportation belongs to functions of these services and is performed under their control;

- the road vehicles used in case of emergency situations or in salvage operations including for non-commercial transportation of the humanitarian assistance;

- special road vehicles of medical assignment;

- the special emergency repair road vehicles operating in radius of 100 km from the main location;

- vehicles for road tests for the purpose of technological improvement, repair or content, and also the new or re-equiped road vehicles not put even into operation;

- vehicles or structures of vehicles which extreme admissible total mass does not exceed 3,5 of ton, traded on for motor transportation carriages of goods;

- the commercial vehicles of historical nature which are traded on for public conveyance or loads;

- the vehicles of agricultural purpose and vehicles intended for forestry.

2. The international motor transportation carriages of goods are performed according to international treaties and agreements and intergovernmental agreements which party the Republic of Moldova is, and also according to its national legal system. If the national legal system contradicts the international legislation, regulations of international agreements and conventions are applied.

3. Depending on object of transportation, transportation of certain categories of loads is regulated according to special rules on transportation of certain categories of loads.

4. Motor transportation operators can render the following types of service in the field of motor transportation carriages of goods:

- motor transportation carriages of goods on paid basis within the national communication;

- motor transportation carriages of goods on paid basis in the international message;

- motor transportation carriages of goods on own account.

5. For the purpose of these rules the following concepts and terms are used in value:

the customer - physical person or legal entity for benefit of which transaction on transportation which pays the freight charge is performed;

the shipping request of load – the written request constituted by the consignor to the motor transportation operator in whom precedent conditions of carrying out transaction are determined by transportation;

container – the transport equipment (cage, the removable tank or other similar adaptation):

- having permanent nature and owing to this fact rather strong to serve for reuse;

- specially designed for simplification of carriage of goods by one or several modes of transport without intermediate reloading of loads;

- designed so that its overload, in particular from one mode of transport on another was facilitated;

- designed so that it could be loaded and unloaded easily;

- meter, and also the normal equipment and accessories of container having unobstructed capacity at least one cubic provided that they are delivered together with it; the term "container" does not include either regular packaging, or vehicles;
