Concept of forming of the total market of gas of the Eurasian Economic Union

I. General provisions

This Concept is developed for the purpose of realization of Item 2 of article 83 of the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement).

This Concept is aimed at providing forming with state members of the Eurasian Economic Union (further respectively - state members, the Union) the total market of gas of the Union providing:

mutual trade in gas between participants of the total market of gas of the Union;

gas transportation, the total market of gas of the Union and the gas intended for delivery to consumers belonging to participants in the total market of gas of the Union, on gas-transport systems.

Forming of the total market of gas of the Union is integral part of economic integration within the Union and is aimed at providing favorable conditions for free movement of goods, services, technologies and the capitals between state members.

Forming of the total market of gas of the Union is performed taking into account:

obligations of the state members determined by international treaties;

features of functioning and development of gas markets of state members;

first-priority ensuring internal needs for gas of state members;

legislations of state members;

international experience of forming of the total markets of gas.

II. Determinations

For the purposes of this Concept concepts which mean the following are used:

"internal requirements for gas" - the gas amounts necessary for consumption in the territory of each of state members;

"the domestic market of gas of state member" - set of trade and economic relations of the business entities in the territory of state member in the sphere of transportation and supply of gas who are acting on the basis of the legislations of state member;

"gas" - the gas mixture of gaseous hydrocarbons and other gases consisting generally of methane and transported in the compressed gaseous state on gas-transport systems;

"gas-transport systems" - the constructions for gas transportation including trunk gas pipelines and related single engineering procedure objects except gas distribution networks;

"access to gas-transport systems" - provision of right to use of the gas-transport systems managed by subjects of natural monopolies of state members for gas transportation;

"the infrastructure organizations" - operators of the gas-transport systems located in the territories of state members and operators of the exchange biddings;

"transportation and supply of gas between state members" - transportation and supply of gas from the territory of one state member on the territory of other state member;

"the total market of gas of the Union" - set of trade and economic relations of business entities of state members in the sphere of transportation and supply of gas between state members;

"the operator of the exchange biddings" - the legal entity rendering services in implementation of stock wholesale trade by gas in the territory of state member and providing execution of the agreements signed when implementing this trade by interaction with operators of the gas-transport systems located in the territories of state members;

"the operator of gas-transport system" - the legal entity who is the owner of gas-transport system or owning gas-transport system on other legal cause and exercising supervisory control of gas-transport system, gas transportation on gas-transport system;

"gas supply" - transfer of gas from the supplier of gas to the consumer of gas on the conditions established by the relevant agreement;

"the supplier of gas" - the legal entity performing supply of gas in the territories of state members;

"the consumer of gas" - the legal entity registered in the territory of state member and acquiring gas for own, production or other economic needs;

"free capacities" - technologically possible free capacities of trunk gas pipelines of state members determined according to single rules of access to the gas-transport systems located in the territories of state members;

"subjects of the total market of gas of the Union" - participants of the total market of gas of the Union and the infrastructure organizations providing functioning of the total market of gas of the Union;

"gas transportation" - movement of gas on gas-transport system from collection point to Item of delivery or transfer of gas to other gas-transport systems;

"gas transportation services" - services in movement of gas in gas-transport systems.

"participants of the total market of gas of the Union" - the suppliers of gas and consumers of gas registered in the territories of state members and if necessary authorized by state member on delivery and (or) purchase of gas in the total market of gas of the Union.

Other concepts are used in this Concept in the values determined by the Agreement.

III. Purposes, principles and tasks of forming of the total market of gas of the Union

Main objectives of forming of the total market of gas of the Union are:

increase in energy security of state members;

increase in reliability, availability and quality of gas supply of consumers of gas in the territories of state members;

increase in cost efficiency of use of the gas-transport systems located in the territories of state members.
