For the purpose of realization of parts 2 and 3 of article 12 of the Law of the Republic of Tajikistan "About production wastes and consumption" I dispose:
1. Approve the enclosed "Criteria of reference of dangerous wastes to class of danger to the surrounding environment" it (is applied).
2. This Order to provide to the Ministry of Justice of the Republic of Tajikistan for state registration and to enact it after state registration and official publication.

1. Criteria of reference of dangerous wastes to class of danger to the surrounding environment are intended for individual entrepreneurs and legal entities in the course of whose activities dangerous wastes for the surrounding environment are formed and which shall confirm reference of this waste to specific class of danger to the surrounding environment
2. The class of danger of waste is established on extent of possible harmful effects on the surrounding environment in case of the direct or mediated impact of dangerous waste on it according to the Criteria given in Appendix 1 to table 1.
3. Reference of waste to class of danger to the surrounding environment can be performed settlement or experimental by methods.
4. In case of reference of withdrawal waste by producers by calculation method to the 5th class of danger, its confirmation by experimental method is necessary. In the absence of confirmation of the 5th class of danger by experimental method withdrawal can be referred to the 4th class of danger.
5. Reference of waste to class of danger to the surrounding environment is performed by calculation method based on the indicator (K) characterizing degree of danger of withdrawal in case of its impact on surrounding the environment, calculated on the amount of indicators of danger of the substances constituting withdrawal for the surrounding environment (Ki). The list of components of withdrawal and their quantitative content are established on composition of initial raw materials and engineering procedures of its conversion or by results of the quantitative chemical analysis.
6. The exponent of danger of component of withdrawal (Ki) is calculated as ratio of concentration of components of withdrawal (Ci) with coefficient of its degree of danger to the surrounding environment (Wi); coefficient of degree of danger of component of withdrawal to the surrounding environment is the conditional indicator in number equal to quantity of component of withdrawal below which value it does not make negative impacts on surrounding the environment. Dimension of coefficient of degree of danger to the surrounding environment conditionally is accepted as mg/kg.
7. For determination of coefficient of degree of danger of component of withdrawal to the surrounding environment on each component of withdrawal degrees of their danger to the surrounding environment for different environments according to Appendix 1 by table 2 are established.
8. The list of the indicators used for calculation of Wi joins indicator of information support for accounting of lack of information on primary exponents of danger of components of withdrawal to the surrounding environment. The indicator of information support is calculated by division of number of the established indicators (n) on 12 (n - quantity of the most significant primary indicators of danger of components of withdrawal to the surrounding environment). Points are appropriated to the following ranges of change of indicator of information support:

9. On the established degrees of danger of components of withdrawal to the surrounding environment in different environments the relative parameter of danger of component of withdrawal for the surrounding environment (Xi) division of score in all respects on number of these parameters is calculated.
10. The coefficient of Wi is calculated on one of the following formulas:
Wi for the most widespread components of dangerous wastes are given in Appendix 2.
11. The exponent of danger of component of withdrawal to the surrounding environment (Ki) is calculated by formula:

13. The components of waste consisting of such chemical elements as oxygen, nitrogen, carbon, phosphorus, sulfur, silicon, aluminum, iron, sodium, potassium, calcium, magnesium, titanium in the concentration which are not exceeding their content in the main types of soils belong to almost harmless components with GPA (Xi) equal 4, and, therefore, in the coefficient of degree of danger to the surrounding environment (Wi) equal 1000000. The components of waste of natural organic origin consisting of such connections as carbohydrates (cellulose, starch and other), proteins, nitrogen-containing organic compounds (amino acids, amides and other) that is the substances which are found in wildlife belong to the class of almost harmless components with GPA (Xi) equal 4, and, therefore, in the coefficient of degree of danger to the surrounding environment (Wi) equal 1000000. For other components of waste the exponent of danger to the surrounding environment is calculated on above-established procedure (Items 7 - 12).
14. Reference of waste to danger class is performed by calculation method on exponent of danger of withdrawal to the surrounding environment according to Appendix 1 by table 3.
15. The experimental method of reference of waste to class of danger to the surrounding environment is performed in the specialized laboratories accredited for these purposes.
16. The experimental method is used in the following cases:
- for confirmation of the reference of waste to the 5th class of danger established by calculation method;
