About approval of the Order of registration of physical persons and legal entities to which consular services are rendered

According to paragraphs 21, 33 Item 6 and Item 11 of the Regulations on the Ministry of Foreign Affairs of the Republic of Tajikistan approved by the order of the Government of the Republic of Tajikistan of December 28, 2006 I dispose No. 593:

1. Approve the Order of registration of physical persons and legal entities to which consular services are rendered it (is applied).

2. This Order to provide for legal verification and state registration to the Ministry of Justice of the Republic of Tajikistan.

3. This Order to enact after legal verification, state registration and official publication.

4. Control over the implementation of this Order to assign to the First Deputy Minister and the Head consular department.

Order of registration of physical persons and legal entities to which consular services are rendered

1. General provisions

1. The order of registration of physical persons and legal entities to which consular services are rendered (further - the Procedure) regulates rules of registration, re-registration, accounting and execution of the registration sheet performed by the Head consular department of the Ministry of Foreign Affairs of the Republic of Tajikistan (further - the Head consular department) and determines preserving and information analysis about the registered and re-registered persons.

2. The basic concepts used in this Procedure:

- registration - record about physical persons who are not individual entrepreneurs, legal entities and individual entrepreneurs, branches and representations of foreign legal entities in the Republic of Tajikistan and the international public associations (further - petitioning) in the Head consular department;

- re-registration - repeated registration of legal entities, individual entrepreneurs, branches and representations of foreign legal entities in the Republic of Tajikistan and the international public associations;

- accounting - collection and information analysis about registration and re-registration, and also about rendering consular services by the management petitioning in the Main thing consular;

- registration leaf - the approved document form (according to appendix 1) which is issued to the petitioning persons and is the basis for rendering consular services in the Head consular department.

3. Registration and re-registration is required for rendering the following consular services:

- registration of visa support and visa of the Republic of Tajikistan;

- consular legalization and apostilization of documents and acts;

- putting down of mastic stamp of "hizmata" for trip to People's Republic of China.

4. Consular services are provided without registration to Executive office of the President of the Republic of Tajikistan, the Office of Majlisi milli and the Office of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan, the Constitutional court of the Republic of Tajikistan, the Supreme Court of the Republic of Tajikistan, the Supreme economic Court of the Republic of Tajikistan, the Prosecutor General's Office of the Republic of Tajikistan, Council of justice, the ministries, the state committees, bodies in case of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan, to the National Bank of Tajikistan, local executive bodies of the government, diplomatic representations, consular establishments and the international organizations accredited in the Republic of Tajikistan.

5. For the petitioning persons who were not registered or re-registration, according to this Procedure, consular services are not performed.

6. For registration and re-registration in the Head consular department the consular fee in the amount of, established by the legislation of the Republic of Tajikistan is levied.

2. Order of registration and term of its action

7. For registration for registration of visa support and the visa of the Republic of Tajikistan the following documents are submitted:

a) For physical persons:

- statement; - passport copy;

- copy of the Certificate on assignment of identification taxpayer number;

- the receipt on payment of the consular fees for registration.

b) For the international public associations:

- the petition with seal and the signature of the head;

- the copy of the registration certificate in the Republic of Tajikistan;

- the power of attorney about appointment of the representative to the Head consular department;

- certificate of field of activity;

- copy of the Certificate on assignment of identification taxpayer number;

- the receipt on payment of the consular fees for registration;

c) For legal entities and individual entrepreneurs:

- the petition with seal and the signature of the head;

- notarized copies of constituent documents of the legal entity;

- copy of the registration certificate of the legal entity and individual entrepreneur;

- the copy of the statement from the Unified state register of registration of legal entities;

- copy of the Certificate on assignment of identification taxpayer number;

- the copy of the license for the activities connected with employment of citizens of the Republic of Tajikistan outside the Republic of Tajikistan and the activities connected with employment of foreign citizens in the territory of the Republic of Tajikistan (for legal entities);

- copies of licenses which according to the legislation of the Republic of Tajikistan are granted for implementation of allowing types of activity to legal entities and individual entrepreneurs;

- passport copy of the head of the legal entity or individual entrepreneur;

- form sample, seal and the signature of the head of the legal entity or individual entrepreneur or person replacing it;

- the power of attorney about appointment of the representative to the Head consular department;

- the reference from the Tax Committee under the Government of the Republic of Tajikistan or its territorial authorities about not debt of the legal entity and the individual entrepreneur;

- plan of involvement of foreign specialists;

- the receipt on payment of the consular fees for registration.

8. For registration on implementation of consular legalization and apostilization of documents and acts it is necessary to submit the following documents:

a) For physical persons:

- statement;

- passport copy;

- copy of the Certificate on assignment of identification taxpayer number;
