In sotvetstviye with paragraph 5 of article 12 of the Law of the Republic of Tajikistan "About state registration of real estate and the rights to it" and the paragraph 33 items 4 of the Provision of the State committee on land management and to geodesy of the Republic of Tajikistan approved by the order of the Government of the Republic of Tajikistan of May 3, 2010 No. 225 of POSTANOVLYAYU:

1. Approve the Bases of appointment and procedure for technical inventory count of real estate, and also verifications of characteristics of real estate when making registration actions it (is applied).

2. In accordance with the established procedure, to provide this resolution to the Ministry of Justice of the Republic of Tajikistan for the state registartion.

3. Enact this resolution after state registration and official publication.

4. To impose control of execution of this resolution on deputy chairmen.

1. General provisions

1. The bases of appointment and procedure for technical inventory count of real estate, and also verification of characteristics of real estate when implementing registration actions (further this Procedure) 33 items 4 of the Provision of the State committee on land management and to geodesy of the Republic of Tajikistan approved by the order of the Government of the Republic of Tajikistan of the May 3, 2010, No. 225 and determining the bases of appointment and procedure for technical inventory count of real estate, and also verification of characteristics of real estate when making registration actions are developed based on article 12 of the Law of the Republic of Tajikistan "About state registration of real estate and the rights to it" and the paragraph.

2. Basic concepts

2. In this Procedure the following basic concepts are used:

- technical inventory count - collection, recovery and processing of data on availability, the location, structure, the area and other characteristics, condition, real estate value on the basis of results of inspection of real estate in nature;

- technical data sheet - the technical document which is constituted by results of technical inventory count or verification of characteristics of real estate, containing description of actual state of the real estate unit, data on the area and other its characteristics, cadastral number, accession number, the address (locations) and other data on real estate;

- outline - the schematic plan constituted manually in case of accomplishment of field works without scale, but with observance of proportion. In outline the sizes on all structures which are available on the parcel of land, barriers, engineering constructions, site borders, engineering networks, wells, data on the address of object, the name of the user, the owner, date scheduling and so forth are reflected, and also it shall be signed by the contractor and checking;

- mezzanine - the platform occupying the upper part of amount of the room, intended for placement of auxiliary storage and other facilities;

- the barrack - one or two-storeyed buildings intended for temporary residence with the common kitchen and the bathroom is constructed generally of wooden, stone and pise-walled construction materials;

- verandah - the opened or glazed room attached to the building or which is built in it;

- domestic constructions - constructions of auxiliary, economic appointment. Fences, gate, toilet, wells, drainpipes, domestic coverings, canopy and other similar objects concern to them;

- household - the residential and non-residential building, construction and other real estate units which are on the isolated parcel of land;

- loggia - the room blocked and protected from three parties opened in external space, serving for rest, solntsezashchita or other climatic factors;

- letters - conventional signs of designation of the building and construction, by drawing letters, figures and other signs used in technical data sheet of real estate;

- attic - the superstructure located over middle part of the building and having the smaller area from below the located floors;

- the building - object of town-planning activities of the construction system consisting from the designs bearing protecting or combined forming the closed amount which depending on functional purpose intends for accommodation and stay of people, for accomplishment of various type of production processes;

- the main building - the building which has advantage on architectural form and construction before other structures which are on one parcel of land.

On one parcel of land can be one and more main buildings;

- the auxiliary building - the structure which is on one parcel of land and being of secondary importance in comparison of the main structure.

The subsidiary structure usually has simple appearance, and in case of work on technical inventory counts internal dimensions of rooms are not measured. The storage room, garage, canopy, the cellar, kitchen, bath, domestic covering and to that similar belong to auxiliary buildings and are measured from outer side of border;

- constructions - object of town-planning activities, volume, plane or linear construction system, consisting from the bearing, protecting or combined designs which intends for accomplishment of production processes of various type, storage of materials, products, the equipment, and also for temporary stay of people, movement of people, freights and other;

- the apartment house - the building consisting of two and more apartments having exit to the parcel of land and the common use facilities applying to the apartment house;

- the individual apartment house (further the apartment house) - the free-standing building with auxiliary structures consisting of the living rooms intended for satisfaction of domestic and other needs of citizens. The apartment house, except living rooms, consists of corridor, kitchen, bathroom, domestic and other constructions;

- the apartment - the part of the building intended for accommodation of family of various numerical structure or one person, which is containing residential and utility rooms and having separate exit to ladder aperture, gallery in corridor or outside;

- the residential and non-residential building - any object constructed on the earth or underground intended for long operation, which creation acknowledged complete according to the legislation of the Republic of Tajikistan, firmly connected with the earth which movement without disproportionate damage to its appointment is impossible, appointment which location and the sizes are described in documents of the single state register of real estate and the rights to it;

- the certain residential and non-residential building - the internal spatial part of the residential and non-residential building separated other adjacent parts of structure by overlappings, walls, partitions, having independent entrance from the auxiliary building (lobby, corridor, gallery, ladder march or the platform, the lift hall, etc.) or from the territory public (the house adjoining territory, the street, etc.) is direct or through other building, the territory by establishment of the servitude, appointment, the location in structure which area is described in documents of the single state register of real estate and the rights to it. The isolated residential building can have entrance from the subsidiary building (corridor, hall, etc.);

- objects of construction in progress - the preserved construction object which creation as the residential and non-residential building is authorized according to the legislation of the Republic of Tajikistan, but it is not complete, having strong communication with the earth, appointment which location and the sizes are described in documents of the single state register of real estate and the rights to it;

- object of special purpose - the real estate unit, data on which in case of their distribution can cause damage to homeland security, defense capability and the vital interests of the Republic of Tajikistan; - the room - the part of the apartment house or apartment intended for direct accommodation.

The room shall be heated, lit and to have the external height of at least 2,5 of meter and the area of at least 6,0 of sq.m;

- the corridor - the part of structure binding residential and other rooms, regardless of the importance and osveshchayemost corridor is auxiliary structure. The area of corridor is included into the building total usable space;

- the extension - the part of the building located outside of walls of the main structure and rather main is auxiliary and can have communication from one and more walls of the main structure. Usually the extension has internal pass to the main structure. The kitchen room, additional premises, hall, verandah and others belong to such structures.

The extension shares on heated and not heated. The area of the heated extensions joins in housing stock;

- hall - the part of the room having direct exit to ladder, corridor and so forth;

- bay window - the part of the room leaving the facade plane, in parts or in full glazed, improving it illumination. Generally happens semicircular, triangular and many-sided;

- the room - the space in the building having certain functional purpose and limited by building constructions;

- penthouse - the garret under roof, abrupt with break, used for housing and the economic purposes;

- the mansard floor - the floor in garret space which facade is fully or partially educated surface (surfaces) of inclined or broken roof at the same time the line of crossing of the plane of roof and facade shall be at height no more 1,5 of m of the level of half of the mansard floor;

- basement store - the floor at which floor is located lower than the level of the sidewalk or blind area, at distance more than half of height of the room;
