About approval of the Instruction "About procedure for application of the digital signature in payment system of the Kyrgyz Republic"

According to articles 7 and 43 of the Law "About National Bank of the Kyrgyz Republic" and the Law "About Payment System of the Kyrgyz Republic" Board of National Bank of the Kyrgyz Republic decides:

1. Approve the Instruction "About procedure for application of the digital signature in payment system of the Kyrgyz Republic" it (is applied).

2. Declare invalid the resolution of Board of National Bank of the Kyrgyz Republic "About the Instruction about procedure for application of the digital signature in payment system of the Kyrgyz Republic" of November 6, 1999 No. 66/10.

3. To legal management:

- publish this resolution on the official site of National Bank of the Kyrgyz Republic;

- after official publication to send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State register of regulatory legal acts of the Kyrgyz Republic.

4. This resolution becomes effective after fifteen days from the date of official publication.

5. To management on work with documents to bring this resolution to the attention of the relevant structural divisions, regional managements and representative office of National Bank in Batken Province.

6. To management of payment systems to bring this resolution to the attention of commercial banks, operators of payment systems and payment institutes of the Kyrgyz Republic.

7. To impose control of execution of this resolution on the Vice-chairman of National Bank of the Kyrgyz Republic L.Dzh. To Orozbayev.

The instruction about procedure for application of the digital signature in payment system of the Kyrgyz Republic

Chapter 1. General provisions

1. This Instruction establishes procedure for creation, registration, use and storage of the digital signature for members of payment service provider of the Kyrgyz Republic.

2. The digital signature represents the tool by means of which the member of payment service provider confirms authenticity and integrity of the electronic payment document.

3. The digital signature unambiguously determines the member of payment service provider who signed the electronic payment document.

Chapter 2. Terms and determinations

4. The terms and determinations used in this Instruction correspond to terms and the definitions given in the laws "About Payment System of the Kyrgyz Republic", "About the Electronic Document and the Digital Signature", the Concept of safety in bank institutions of the Kyrgyz Republic No. 7/5, approved by the resolution of Board of National Bank of the Kyrgyz Republic of April 28, 1998 and the Provision "About Interbank Electronic Payment Documents" approved by the resolution of Board of National Bank of the Kyrgyz Republic of June 24, 1999 No. 47/4.

5. In addition in this Instruction the following terms and determinations are used:

The key carrier is the carrier intended for safe storage of the closed key and the certificate of the digital signature of the owner.

PIN code - personal confidential code of the owner of the key carrier, password analog.

Chapter 3. Order of registration

6. The role of the Administrator of system of the digital signature (further - the Administrator) National Bank is assigned to employees of Department of information protection of Management of safety and information protection (further - OIZ UBIZ).

7. Each member of payment service provider signs the interbank Agreement on exchange of electronic payment documents.

8. Each member of payment service provider designates the order of the head of two responsible persons having the right to sign electronic payment documents on behalf of the member of payment service provider.

9. The responsible person of the member of payment service provider represents to National Bank of the Kyrgyz Republic (further - National Bank) the letter signed by the head of the organization - the member of payment service provider according to whom in National Bank the procedure of registration for these responsible persons is carried out.

10. The administrator registers name of the responsible person and his power in certification center of National Bank, and then writes down this information in memory of the key carrier. The letter of the participant remains at the Administrator of National Bank and is filed in case.

11. The closed and opened keys generated by certification center are unique for each responsible person of the member of payment service provider. The closed key registers directly in memory of the key carrier. The procedure of generation and record of the closed key does not allow possibility of its external reading or reproduction.

12. The PIN code gets out, registered and used by exclusively responsible person of the member of payment service provider. This person bears the personal responsibility for ensuring confidentiality of the PIN code.

13. It is not allowed to make record of the PIN code on any medium in form, available to reading.

14. The key carrier which underwent the procedure of registration together with the certified certificate is transferred by the Administrator of National Bank to the responsible person of the member of payment service provider under the delivery-acceptance certificate.

15. The administrator of National Bank provides availability and integrity of open keys to all members of payment service provider.

16. Authenticity of open key of the member of payment service provider makes sure the appropriate electronic certificate signed by the digital signature of certification center of National Bank.

Chapter 4. Procedure for creation and use of the digital signature

17. Electronic payment documents are processed according to the formats established by National Bank. The file of electronic payment documents can include one or several electronic payment documents.

18. Each electronic payment document, document package or the file is signed by the digital signature of the responsible person of the member of payment service provider which certifies all payments or messages provided in this file / packet.

19. The digital signature is created on condition of availability of the key carrier registered in accordance with the established procedure and the correct input of the PIN code confirming powers on use of this key carrier.
