About approval of the Procedure for provision of data from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming

According to Articles 11, 12 Laws of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" order:

1. Approve enclosed:

1) the Procedure for provision of data from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming;

2) Changes in some orders of the Ministry of Justice of Ukraine.

2. Recognize invalid:

the order of the Ministry of Justice of Ukraine of July 31, 2013 No. 1556/5 "About approval of the Regulations on procedure for access of courts of law to data of the Unified State Register of Legal Entities and physical persons of entrepreneurs", registered in the Ministry of Justice of Ukraine on August 5, 2013 on No. 1324/23856 (with changes);

the order of the Ministry of Justice of Ukraine of March 31, 2015 No. 466/5 "About some questions of provision of data from the Unified State Register of Legal Entities and physical persons entrepreneurs", registered in the Ministry of Justice of Ukraine on March 31, 2015 for No. 349/26794 (with changes).

3. Determine that before implementation of the software of the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming, to provide forming and seal of requests for receipt of data from this register, such requests are sent by the applicant by filling of the form of the established form in Ukrainian with printing letters with the handle or by means of the commonly accepted technical means.

4. To the technical administrator of the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming to take the measures necessary for implementation of this order.

5. To department of private law () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

6. This order becomes effective from the date of its official publication.

7. To impose control over the implementation of this order on the first deputy Minister Sevostyanova N. I.

Procedure for provision of data from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming

I. General provisions

1. This Procedure establishes conditions, the bases and the procedure of provision of data from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the Unified state register), the rights and obligations of the subjects participating in the specified procedure.

2. In this Procedure terms are used in the following values:

request - the document of Ukraine of sample confirming declaration of will of person on receipt of the statement, statement from the Unified state register or documents containing in registration case, in paper form;

the applicant - physical person, the legal entity, persons interested to receive data from the Unified state register, or persons authorized by them;

the authorized person of the subject of state registration - the official or person who is in employment relationships with the subject of state registration who according to the legislation got the ID of access to the Unified state register only for the purposes of acceptance of request and issue of the statement from the Unified state register or documents containing in registration case, in paper form, and in case of provision of the statement from the Unified state register - the official of territorial authority of the Ministry of Justice of Ukraine;

the center of provision of administrative services - the center of provision of administrative services formed according to the Law of Ukraine "About administrative services".

Other terms in this Procedure are used in the values given in the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" other regulatory legal acts adopted according to this Law.

3. The information from the Unified state register is provided by means of software of maintaining this register in the paper or electronic forms having identical legal force and contains the exclusive reference on the Unified state register, except the documents containing in registration case and is provided in paper form.

In paper form are provided:

the statement from the Unified state register for putting down of apostille which is provided by the state registrar of territorial authority of the Ministry of Justice of Ukraine, on sheets A4 (210 x 297 millimeters) without use of special forms with putting down of the sign and seal of the state registrar;

the statement from the Unified state register by results of the carried-out state registration which is provided by the state registrar of legal entities, physical persons entrepreneurs and public forming (further - the state registrar) on sheets A4 (210 x 297 millimeters) without use of special forms with putting down of the sign and seal of the state registrar or the seal determined by the Law of Ukraine "About notariate" (if the state registrar is the notary);

the statement from the Unified state register which is provided by the state registrar (except the state registrar of the Ministry of Justice of Ukraine or its territorial authority), the authorized person of the center of provision of administrative services, the notary, on sheets A4 (210 x 297 millimeters) without use of special forms and without putting down of the sign and seal;

the documents containing in registration case of the corresponding legal entity, public forming which has no status of legal, physical person entrepreneur (further - registration case) which are provided by the state registrar of the subject of state registration which according to the law is authorized to store registration cases in paper form, by production of copies of such documents with putting down of the sign and seal of the state registrar on each page.

Are electronically provided:

data from the Unified state register through the portal of electronic services of the legal entities, physical persons entrepreneurs and public forming who do not have the status of the legal entity (further - the portal of electronic services) or with use of the Single state web portal of electronic services;

data from the Unified state register in format of the database or in other format in real time based on the contracts signed with the technical administrator of the Unified state register.

4. For provision of data from the Unified state register the payment in the amount of, established by the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" is levied.

5. The statement, the statement from the Unified state register in paper form, extraction and other information from the Unified state register are electronically provided irrespective of the storage location of registration case in paper form.

6. Data from the Unified state register are submitted within the terms established by the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" or in the cases provided by this Law in the terms determined by the agreement signed with the technical administrator of the Unified state register.

II. Provision of the statement, statement from the unified state register in paper form

1. The statement, the statement from the Unified state register in paper form (except the statement by results of the carried-out state registration) are provided on demand about provision of the extract from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming, about provision of the extract from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (appendices 1, 2) the applicant by the address to the authorized person of the subject of state registration, the center of provision of administrative services or the notary.
