1. Approve the enclosed Rules of use of geological information on subsoil which owner is the Russian Federation.

2. Realization of the powers provided by this resolution is performed by the corresponding federal executive bodies within the number of employees of their central office and territorial authorities, and also budgetary appropriations provided by it in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

Rules of use of geological information on subsoil which owner is the Russian Federation

1. These rules determine procedure and conditions of use of geological information on subsoil which owner is the Russian Federation (further - geological information).

2. Public authorities of the Russian Federation, public authorities of subjects of the Russian Federation, local government bodies, federal fund of geological information and its territorial funds, funds of geological information of subjects of the Russian Federation, physical persons and legal entities can act as users of geological information.

3. The Federal Agency on Mineral Resources and its territorial authorities, public authorities of the Russian Federation and public authorities of subjects of the Russian Federation use geological information in the information purposes for implementation of management of the state fund of subsoil, maintaining the state inventory of fields and shows of minerals, the state stock balance of minerals, the state register of works on geological studying of subsoil, the state register of the subsoil plots provided in use and licenses to use subsoil, preventions of natural hazards and the phenomena and elimination of their effects, ensuring defense of the country and safety of the state, the organization and implementation of the state control (supervision).

4. The federal fund of geological information and its territorial funds, funds of geological information of subjects of the Russian Federation use geological information for information and analytical ensuring activities of Federal Agency for Subsoil Management and its territorial authorities, public authorities of the Russian Federation and public authorities of subjects of the Russian Federation by means of information exchange, and also perform provision of geological information to physical persons and legal entities based on the decision of Federal Agency for Subsoil Management or its territorial authorities according to the procedure, established by the Ministry of Natural Resources and Environmental Protection of the Russian Federation, except as specified, provided by this Item.

Receipt of the decision of the Federal Agency for Subsoil Management or its territorial authorities about provision of geological information provided by paragraph one of this Item is not required in case of provision to physical persons and legal entities of the geological information which is not limited in access in accordance with the legislation of the Russian Federation and being stored in federal fund of geological information and its territorial funds, funds of geological information of subjects of the Russian Federation.

The federal fund of geological information and its territorial funds, funds of geological information of subjects of the Russian Federation perform provision of geological information based on the request of the interested person.

5. Physical persons and legal entities use geological information according to requirements of the legislation on subsoil, about information, information technologies and about information security, about the state secret and trade secret, and also about export of geological information only for the purposes specified in case of its obtaining.

6. Geological information is provided to physical persons and legal entities (further - applicants) based on the request directed:

in federal fund of geological information and its territorial funds, funds of geological information of subjects of the Russian Federation concerning the geological information which is not limited in access in accordance with the legislation of the Russian Federation and being stored in federal fund of geological information and its territorial funds, funds of geological information of subjects of the Russian Federation;

in Federal Agency for Subsoil Management or its territorial authorities concerning the geological information which is not specified in the paragraph the second this Item.

The applicant has the right to submit the request by means of use of means of the federal state information system "Single Fund of Geological Information on Subsoil" or the federal state information system "Single Portal of the State and Municipal Services (Functions)".

The geological information on subsoil placed on electronic media and provided in the federal state information system "Single Fund of Geological Information on Subsoil" is provided by ensuring connection to the specified federal information system after passing of the procedure of authorization, including by means of use of the federal state information system "Single System of Identification and Authentication in the Infrastructure Providing Information and Technological Interaction of the Information Systems Used for Provision of the State and Municipal Services Electronically".

7. Geological information is provided by the following methods:

a) on papers by means of acquaintance of applicants with its content with the right of statements and vykopirovka;

b) on electronic media by means of acquaintance of applicants with electronic documents and materials with the right of production of electronic images of information documents and materials for copying on electronic media of applicants;

c) on other material carriers (including samples of rocks, core, reservoir liquids, fluids) by means of acquaintance of applicants with them with the right of carrying out the researches which are not breaking integrity and ensuring safety of the provided material carriers.

8. When using geological information safety of material carriers of geological information shall be ensured.

9. The payment for provision of geological information is not levied.
