About approval of Rules of commercial accounting of amount and (or) lot of solid utility waste

According to article 5 of the Federal law "About Production Wastes and Consumption" Government of the Russian Federation decides:

1. Approve the enclosed Rules of commercial accounting of amount and (or) lot of solid utility waste.

2. This resolution is applied to activities of operators for the address with solid utility waste from the date of the beginning of implementation by the regional operator of activities for the address with solid utility waste according to the agreement on the organization of activities for the address with solid utility waste signed by public authority of appropriate subject of the Russian Federation and the regional operator according to the address with solid utility waste.

Rules of commercial accounting of amount and (or) lot of solid utility waste

I. General provisions

1. These rules establish procedure for commercial accounting of amount and (or) lot of solid utility waste with use of the gages conforming to requirements of the legislation of the Russian Federation about ensuring unity of measurements (further - gages), or settlement method for the purpose of implementation of agreement settlements in the field of the address with solid utility waste.

2. The amount and (or) weight are subject to commercial accounting:

a) solid utility waste in places of their accumulating:

the sorted solid utility waste;

unassorted solid utility waste;

large-size waste;

b) the solid utility waste transported by operators according to the address with solid utility waste;

c) the solid utility waste arriving on objects of processing, neutralization and (or) burial of solid utility waste (further - objects) and transported from such objects.

3. The regional operator according to the address with solid utility waste represents to executive body of the subject of the Russian Federation with which it signed the agreement concerning the organization of activities for the address with solid utility waste, data on amount and (or) on lot of cumulative solid utility waste, and also solid utility waste concerning which were performed transportation, processing, utilization, neutralization and (or) burial, in the form established by the specified agreement, monthly if other frequency of submission of the specified data is not provided by this agreement.

4. For the purpose of comparison of amount and lot of solid utility waste the average density of solid utility waste calculated as the relation of amount of the solid utility waste accepted from owners of solid utility waste (without solid utility waste which commercial accounting is performed proceeding from their weight), to lot of such waste transferred to objects of processing, utilization, neutralization and waste disposal for the last expired calendar year, and in the absence of such data - as the relation of the established annual standard rate of accumulating in volume indicators to the annual standard rate of accumulating is determined by weight (further - the average density of solid utility waste).

II. Commercial accounting of amount and (or) lot of solid utility waste

5. Commercial accounting of solid utility waste is performed:

a) in the settlement way proceeding from:

standard rates of accumulating of the solid utility waste expressed in quantitative indices of amount;

quantity and amount of containers for accumulating of the solid utility waste established in places of accumulating of solid utility waste;

b) proceeding from lot of solid utility waste determined with use of gages.

6. For the purpose of implementation of settlings with owners of solid utility waste commercial accounting of solid utility waste is performed according to the subitem "an" of Item 5 of these rules.

7. For the purpose of implementation of settlings with operators according to the address with the solid utility waste performing activities for transportation of solid utility waste, commercial accounting of solid utility waste is performed according to Item 5 of these rules.

8. In case of separate accumulating of solid utility waste for the purpose of implementation of agreement settlements in the field of the address with solid utility waste commercial accounting of solid utility waste is performed according to the paragraph third the subitem "an" of Item 5 of these rules.

9. For the purpose of implementation of settlings with operators according to the address with the solid utility waste owning on the property right or on other legal cause objects (further - owners of objects), commercial accounting of solid utility waste is performed according to the subitem "b" of Item 5 of these rules.

10. Owners of objects shall during 1 year from the date of entry into force of these rules equip the objects belonging to them with gages of lot of solid utility waste.

11. If object is not equipped with gage or the gage failed (defective), commercial accounting of lot of solid utility waste is performed proceeding from the average density of solid utility waste and the amount of solid utility waste determined:

a) within 30 days after factual determination of exit of gage out of operation (defects) - proceeding from the established vehicle body capacity taking into account coefficient of the most admissible compression of waste (in the presence of such coefficient) according to technical documentation on the vehicle;

b) after 30 days after factual determination of exit of gage out of operation (defects) or in the absence of gage - proceeding from the established vehicle body capacity reduced twice taking into account coefficient of the most admissible compression of waste (in the presence of such coefficient) according to technical documentation on the vehicle.

12. The gage is considered failed (defective) in case:

a) not displays by gage of results of measurement;

b) availability of signs of unauthorized intervention in work of gage;

c) violations of the control seals or signs of checking applied on gage;

d) mechanical damage of gage;

e) excesses of the admissible error of indications of gage established in technical documentation on gage;

e) expirations of intertesting interval of checking of gage.

III. The admission of gage to operation

13. For the admission to operation of the gage established on object, the owner of object creates the commission on the admission of gage to operation (further - the commission) in the following structure:

a) representative of the owner of object;

b) the representative of regional operator according to the address with solid utility waste;
