About approval of the Regulations on procedure for monitoring of activities for the standardization performed by national authority on standardization

Based on Item b) parts (2) article 19 of the Law No. 20 of March 4, 2016 "About national standartization" (The official monitor of the Republic of Moldova, 2016, No. 90-99, the Art. 170) and the subitem 6) lit.j) Item 7 of the Order of the Government on approval of the Regulations on the organization and functioning of the Ministry of Economics, structure and extreme number of its central office No. 690 of 13:01. 2009, with subsequent changes and amendments (The official monitor of the Republic of Moldova, 2009, No. 166-168, Art. 768), ORDER:

1. Approve Regulations on procedure for monitoring of activities for the standardization performed by national authority on standardization according to appendix to this order.

2. Repeal the Order of the Ministry of Economics No. 216 of 19.12.2013 about procedure for supervision of activities of national authority for standardization (The official monitor of the Republic of Moldova, 2014, No. 24-26, the Art. 99).

3. Publish this order in the Official monitor of the Republic of Moldova.

Regulations on procedure for monitoring of activities for the standardization performed by national authority on standardization

I. Purpose and scope

1. This Provision establishes procedure for monitoring of activities for the standardization performed by the Moldavian institute on standardization as National authority on standardization (further – NOS), and establishes tasks of the Ministry of Economics as the central industry body of the public management responsible for quality infrastructure (further - the Ministry of Economics), and NOS in the course of monitoring implementation.

2. Monitoring of activities for standardization is performed by the department of the Ministry of Economics responsible for quality infrastructure based on the item b) parts (2) article 19 of the Law No. 20 of March 4 2016 2 "About national standartization".

II. General provisions

3. The purpose of monitoring of activities for standardization - to promote strengthening of institutional capacity of NOS, as for implementation of activities for national standartization according to the European, international and interstate requirements and practice.

4. Object of monitoring are activities of NOS concerning:

1) accomplishment of the National program for standardization;

2) accomplishment of functions as the member of the European, international and interstate standardization organizations;

3) cooperation with national authorities on standardization of other countries;

4) coordinating of activities of technical committees on standardization;

5) implementation of the income and expenditure budget.

5. For the purpose of monitoring of accomplishment of the deyatelnost established in item 4 of this provision, NOS quarterly and annually submits to the Ministry of Economics reports on accomplishment of the Plan of activities of NOS.

6. The Ministry of Economics has the right to require, when necessary, and other additional or detailed information concerning the deyatelnost listed in item 4 of this provision and also information concerning other objects which belong to activities of NOS.

III. Monitoring of activities for standardization

7. Monitoring of activities for the standardization specified in item 4 of this provision is performed by means of consideration and the analysis of quarterly and annual reports on accomplishment of the Plan of activities of NOS.

8. For the purpose of monitoring of implementation of the National program for standardization the Ministry of Economics:

1) approves the National program for standardization for the proposal of the representative of the Ministry of Economics - the permanent member as a part of Council for standardization;

2) is performed by monitoring of dynamics of implementation of the National program for standardization, analyzing the reports submitted by NOS concerning:

a) the approved Moldavian standards;

b) the European, international, interstate standards and standards of other countries accepted as the Moldavian standards;

c) the cancelled conflict and/or obsolete Moldavian standards.

9. Monitoring of procedure for accomplishment of NOS of functions of the member of the European, international and interstate standardization organizations is performed by means of the analysis of the reports on accomplishment of the Plan of activities concerning;

1) participations in activities of the European, international and interstate standardization organizations to whom NOS represents the Republic of Moldova as the member;

2) participations in activities of mirror European, international and interstate technical committees;

3) accomplishment of the measures provided in decisions of governing bodies of the European, international and interstate standardization organizations as for activities of NOS;

4) accomplishment of the actions relating to development of the European and international standards.

10. Monitoring of procedure for cooperation with national authorities on standardization of other countries is performed by means of the analysis of the reports concerning participation in the activities performed by national authorities on standardization of other countries or in cooperation with these countries including the actions provided by the agreements on cooperation signed between NOS and the relevant organizations.

11. Monitoring of process of coordination of NOS of activities of national technical committees on standardization (further - shopping mall), including national shopping malls, mirror in relation to the European, international and interstate shopping malls, is performed by means of the analysis of the submitted activities reports of these shopping malls.

12. For the purpose of monitoring of accomplishment of the income and expenditure budget the central industry body of public management responsible for quality infrastructure:

1) is annually approved by the income and expenditure budget NOSE;

2) is performed by monitoring of accomplishment of the income and expenditure budget by means of the analysis of the report of NOS concerning expenses and development of the financial resources allocated to destination.

IV. Obligations of the Ministry of Economics and NOS in the course of monitoring

13. In the course of monitoring of activities for standardization the Ministry of Economics has the following obligations:

1) monitors observance by the Moldavian institute on standardization of the conditions and requirements established for National authority on standardization;
