About approval of the Concept of the mechanism of production and issue of allowing documents and the Action plan on implementation of decisions for single window

For the purpose of implementation of the National development strategy "Moldova 2020" approved by the Law No. 166 of July 11, 2012. (The official monitor of the Republic of Moldova, 2012, No. 245-247, the Art. 791), with subsequent changes and amendments, the Strategy of reform of regulatory framework of the business activity for 2013-2020 approved by the Order of the Government No. 1021 of December 16, 2013. (The official monitor of the Republic of Moldova, 2013, Art. No. 297-303, 1129), the Government DECIDES:

1. Approve:

The concept of the mechanism of production and issue of allowing documents, according to appendix No. 1;

The action plan on implementation of decisions for single window, according to appendix No. 2.

1-1. Assign the following subjects of legal relationship of the Automated information system of production and issue of allowing documents (further - AIS PVRD):

The owner and the holder - public organization "Agency of Electronic Control"

Loggers – the bodies issuing allowing documents according to the Law No. 160/2011 on regulation of business activity, bodies of local public authority according to the Law No. 231/2010 on domestic trade, other suppliers of public services according to the Law No. 234/2021 on public services and also officials, representatives to perform the functions provided in regulations and to provide within the competence respect for interests of the Government in different areas.

2. To the Ministry of Economic Development and digitalization as the body responsible for execution of the Order of the Government No. 1021 of December 16, 2013. "About approval of Strategy of reform of regulatory framework of business activity for 2013-2020 and the Action plan on its realization in 2016-2017" to provide necessary technical assistance on implementation of the Concept of the mechanism of production and issue of allowing documents and the Action plan on implementation of decisions for single window.

3. To the public bodies which are engaged in implementation of decisions for single window:

undertake necessary measures for the purpose of accomplishment of the actions specified in the Action plan on implementation of decisions for single window;

report quarterly and at the scheduled time to the Ministry of Economic Development and digitalizations on implementation of the Action plan on implementation of decisions for single window;

assign persons responsible for coordination and monitoring of implementation of the Action plan for implementation of decisions for single window, as a part of relevant organs, informing on it the Ministry of Economic Development and digitalizations.

4. Provide to the state office coordination and monitoring of accomplishment of the Action plan on implementation of decisions for single window, generalizing information and representing it quarterly to the Government at the scheduled time.

5. Accomplishment of the Action plan on implementation of decisions for single window to perform by financial means of foreign donors, and also within the financial assignments provided in the government budget.

6. Bodies of local public authority are recommended to undertake measures for the purpose of accomplishment of the Action plan for implementation of decisions for single window.

6-1. The public organization "Agency of Electronic Control" accepts AIS PVRD in the property on the basis of results of the report on the testing of functional and nonfunctional requirements of AIS PVRD which is carried out by the AIS PVRD company developer.

7. To impose control over the implementation of this resolution on the State office.

Concept of the mechanism of production and issue of allowing documents

Chapter I. Introduction

1. Need of creation of the mechanism of production and issue of allowing documents is dictated by present complexity of the procedure, issue of allowing documents that creates considerable loading for entrepreneurs in case of receipt of allowing documents. Process of issue of allowing documents strongly differs in the different public bodies issuing such documents; procedures of issue of allowing documents are not provided to the single standard for all public institutions, and there are no mechanisms providing transparency of all process of issue of allowing documents. Because of complexity of process of regulation of business activity, need of ensuring continuous implementation of reform of regulated base of business activity, on the MPVRD platform and on technological framework of the Automated information system of production and issue of allowing documents (further - AISPVRD) any necessary functionality can be developed or included in it. Thus, in the sense of this Concept and concepts and/or mechanisms / programs developed on the basis of this concept or for its purposes, all functionality and concepts are applicable not only to allowing documents, but also to other functionality concerning work with other acts / documents and ensuring, with respect thereto, interoperability between the different information objects and/or subjects belonging to the sphere of business activity and to adjacent spheres.

2. The mechanism of production and issue of allowing documents offered in this concept (further – MPVRD) will promote simplification of process of issue of allowing documents both for entrepreneurs, and for the public bodies issuing them. It is offered to all public bodies issuing allowing documents to use unified information system on process control of reception of applications for issue of allowing documents, communication and information exchange between the public bodies which are engaged in issue of allowing documents and also standardization of some processing of statements and issue of allowing documents. The bodies of public management performing now process of issue of allowing documents by means of information systems shall develop electronic interfaces with the offered information system which would allow filing of applications electronically.

3. MPVRD will form basis for single window of issue of allowing documents and integrates the most modern tools of information technologies for the purpose of saving of time, money and administrative efforts of entrepreneurs during filing of application and receipt of allowing documents. The offered information system within MPVRD will become the central Item for connection of public bodies and coordination of their actions by means of which organizations will be able to exchange data for the purpose of reducing number of data which need to be provided to applicants for receipt of allowing documents.

4. Use of unified information system for production and issue of allowing documents, in addition to above-mentioned benefits and functions, will establish the mechanism for performance monitoring of work of public bodies in the course of issue of allowing documents and will designate decisions on optimization for the purpose of improvement and simplification of issue of permissions.
