Based on provisions of Articles 5 and 6 of the Maritime Code of the Republic of Moldova approved by the Law No. 599-XIV of September 30, 1999 (The official monitor of the Republic of Moldova, 2001, Art. No. 1-4, 2), with subsequent changes and amendments, and also for the purpose of execution of Item 85 of the National plan of action for implementation of the Agreement on association the Republic of Moldova – the European Union for 2014-2016, approved by the Order of the Government No. 808 of October 7, 2014. (The official monitor of the Republic of Moldova, 2014, Art. No. 297-309, 851), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on establishment of requirements to oil tankers with the double body or the standards of designing equivalent for one-case oil tankers it (is applied).

2. To impose control over the implementation of this Resolution on the Ministry of Transports and Road Infrastructure

3. This Resolution becomes effective after one year from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on establishment of requirements to oil tankers with the double body or standards of designing equivalent for one-case oil tankers

I. General provisions

1. The regulations on establishment of requirements to oil tankers with the double body or to standards of designing equivalent for one-case oil tankers (further – the Provision) shift Regulations (EU) No. 530/2012 of the European Parliament and Council of June 13, 2012 about acceleration of introduction of requirements to oil tankers with the double body or to standards of designing equivalent for one-case oil tankers, L172 published in the Official magazine of the European Union of June 30, 2012.

2. This Provision is applied to:

1) to oil tankers with a deadweight at least 5 000 tons:

a) floating under the flag of the Republic of Moldova;

b) in independence of under what flag float, coming or leaving port or maritime terminal or standing on anchor in the zone which is under jurisdiction of the Republic of Moldova;

2) to oil tankers with a deadweight of 600 tons and more, but less than 5000 tons, equipped with tanks or compartments with double bottom, according to the rule 19.6.1 of appendix I to MARPOL 73/78 (The International convention on prevention of pollution of courts accepted in London on November 2, 1973, and the Protocol (MARPOL) 73/78, to it accepted in London on February 17, 1978 ratified by the Law No. 189-XVI of July 28, 2005) and side tanks or compartments according to the rule 19.3.1 and with observance of requirements concerning distance of "w" stated in the rule 19.6.2 of the corresponding appendix:

a) floating under the flag of the Republic of Moldova;

b) regardless of under what flag float, coming or leaving port or maritime terminal or standing on anchor in the zone which is under jurisdiction of the Republic of Moldova.

3. This Provision is not applied to the warships, auxiliary vessels belonging to the state or operated by it and used only for government non-commercial services.

II. Determinations

4. For the purposes of this provision the following determinations are used:

1) the oil tanker – the oil vessel, according to determination from the rule 1.5 of appendix I to MARPOL 73/78;

2) complete gross deadweight – unit of measure, according to determination from the rule 1.23 of appendix I to MARPOL 73/78;

3) the oil tanker of 1 category – the oil tanker with a deadweight of 20000 tons and more for transportation of crude oil, fuel oil, diesel fuel, heavy fuel and lubricants; and also the tanker with a deadweight of 30000 tons and more, transporting other types of hydrocarbon, except above-stated, not meeting the requirements of rules 18.1-18.9, 18.12-18. 15, 30,4, of 33,1, of 33,2, of 33,3, of 35,1, of 35,2 and 35,3 of appendix I to MARPOL 73/78;

4) the oil tanker 2 categories – the oil tanker with a deadweight of 20000 tons and more for transportation of crude oil, fuel oil, diesel fuel, heavy fuel and lubricants, or the tanker with a deadweight of 30 000 tons and more, transporting other types of hydrocarbon, except above-stated, meeting the requirements of rules 18.1-18.9, 18.12-18. 15, 30,4, of 33,1, of 33,2, of 33,3, of 35,1, of 35,2 and 35,3 of appendix I to MARPOL 73/78; meeting the requirements of protectively located tanks of the isolated ballast (SBT/PL)

5) the oil tanker 3 categories - the oil tanker with a deadweight of 5000 tons and more, but less, than in the category specified in subitems 3 and 4 of this Item;

6) the one-case oil tanker - the oil tanker which is not conforming to the requirements of the double body or equivalent standards of designing provided by rules 19 and 28.6 of appendix I to MARPOL 73/78;

7) the oil tanker with the double body – the tanker:

a) with a deadweight of 5000 tons and more, meeting the requirements concerning the double body or to the equivalent standards of designing provided by rules 19 and 28.6 of appendix I to MARPOL 73/78, or meeting the requirements of the rule 20.1.3 of the conforming appendix; or

b) with a deadweight at least 600 tons, but less than 5000 tons, equipped with tanks or compartments with double bottom, according to requirements of the rule 19.6.1 of appendix I to MARPOL 73/78 and side tanks or compartments according to the rule 19.3.1 and with observance of requirements concerning distance of "w" ordered by the rule 19.6.2 of the corresponding appendix;

8) age - the age of the ship expressed in number of years and estimated from the moment of its delivery;

9) heavy diesel fuel - diesel fuel which concept is determined by the rule 20 of appendix I to MARPOL 73/78;

10) fuel oil - heavy distillates or remaining balance of crude oil and mix of these products as it is determined by the rule 20 of appendix I to MARPOL 73/78;
