About approval of the Regulations on Committee on public procurements of the Ministry of Finance of the Republic of Kazakhstan

1. Approve the enclosed Regulations on Committee on public procurements of the Ministry of Finance of the Republic of Kazakhstan.

1) official publication of this order in information system of law of Ad_let;

Regulations on Committee on public procurements of the Ministry of Finance of the Republic of Kazakhstan

1. General provisions

1. The committee on public procurements of the Ministry of Finance of the Republic of Kazakhstan (further - Committee) is the department of the Ministry of Finance of the Republic of Kazakhstan performing within competence of the central executive body realizable functions in the sphere of the organization and carrying out single public procurements according to the budget programs and (or) goods, works, services determined by authorized body.

2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

The committee is legal entity in form of business of republican public institution, has seals and stamps with the name in state language, forms of the established sample, and also, according to the legislation, accounts in bodies of treasury of the Ministry of Finance of the Republic of Kazakhstan.

13. Task of Committee is providing the organization and carrying out single public procurements according to the budget programs and (or) goods, works, services determined by authorized body.

14. Functions of Committee:

1) the organization and carrying out public procurements for the list of the budget programs and (or) goods, works, services determined by authorized body;

2) consideration of the task for the organization and carrying out public procurements containing the documents established by Rules of implementation of public procurements;

3) development and approval of the draft of the tender documentation (auction documentation) based on the task provided by the customer containing the documents established by Rules of implementation of public procurements;

4) determination and statement of structure of the contest committee (auction commission);

5) modification and (or) amendments in the tender documentation (auction documentation);

6) placement on the web portal of public procurements of the announcement of carrying out public procurements;

7) the direction to the customer of requests and notes from persons automatically registered on the web portal of the public procurements which received the tender documentation (auction documentation) to the draft agreement about public procurements and (or) the technical specification of the tender documentation (auction documentation);

8) determination of the winner of public procurements by method of tender (auction);

9) decision making about recognition of potential suppliers by unfair participants of public procurements according to the Law of the Republic of Kazakhstan of December 4, 2015 "About public procurements;

10) the direction of claims in court for recognition of suppliers by unfair participants of public procurements, in cases stipulated by the legislation;

11) implementation of forming and maintaining registers in the sphere of public procurements;

12) consideration of appeals of physical persons and legal entities concerning the organization and carrying out public procurements;

13) participation in project development of regulatory legal acts and international treaties of the Republic of Kazakhstan within competence of the Ministry of Finance of the Republic of Kazakhstan;

14) approval of regulatory legal acts on the questions entering competence of Committee and with direct competence on their approval of acts of the Ministry of Finance of the Republic of Kazakhstan, except for the regulatory legal acts affecting rights and freedoms of man and citizen.

15. Rights and obligations of Committee:

1) to develop and accept orders within the competence;

2) to develop offers on practical use of work experience of foreign countries;
