About transit of exceptional loads and the military contingents

Article 1. Purpose of this Law

This Law governs the public relations in the field of protection of interests and safety of the Republic of Uzbekistan in case of transit of exceptional loads and the military contingents.

Article 2. Basic concepts

In this Law the following basic concepts are applied:

exceptional loads - arms, military equipment, military property, dangerous goods, and also objects which turnover in the territory of the Republic of Uzbekistan is under the state control;

the applicant - person who addresses for receipt of permission to transit of exceptional loads and the military contingents;

transit - movement through the territory of the Republic of Uzbekistan under control of authorized bodies of exceptional loads and the military contingents any kind of transport, the points of departure and which appointments are outside the Republic of Uzbekistan;

permission to transit - the document granting the right to transit of exceptional loads and the military contingents;

the owner of permission to transit - person who got permission to transit of exceptional loads and the military contingents;

dangerous goods - substances, materials, products, waste which owing to properties and features inherent in them in the presence of certain factors can in the course of transportation, of handling works to be cause of explosion, the fire or damage of the transported loads, technical means, devices, buildings and constructions, other objects, and also damnification of life and to human health, the environment;

arms and military equipment - complexes of different types of weapon and means of ensuring of its fighting application, including the delivery system, system of targeting, start-up, management, and also other special technical means intended for equipment of armed forces, ammunition and their components, spare parts, devices and components to devices, educational weapon (prototypes, exercise machines and simulators of different types of arms and military equipment);

military property - systems of ensuring life activity of staff of armed forces, materials of special purpose and the special equipment for their production, collective and individual remedies from weapons of mass destruction, prophylactics and treatments of effects of use of weapons of mass defeat, the special rear equipment, military uniform of clothes and its attributes;

the military contingent - staff of military forming and military personnel of foreign states, and also the persons which are called up for military service or who are transferring to the reserve in these states.

Article 3. Legislation on transit of exceptional loads and military contingents

The legislation on transit of exceptional loads and the military contingents consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about transit of exceptional loads and the military contingents then are applied rules of the international treaty.

Article 4. State control of transit of exceptional loads and military contingents

The state control of transit of exceptional loads and the military contingents includes:

issue of permissions to transit;

control of observance by the owner of permission to transit or person of requirements of the legislation authorized by it;

control of observance of safety requirements in case of transit of exceptional loads and the military contingents, stipulated by the legislation;

collection, processing and information analysis about transit of exceptional loads and the military contingents.

Article 5. Management in the field of transit of exceptional loads and the military contingents

Management in the field of transit of exceptional loads and the military contingents is performed by the Cabinet of Ministers of the Republic of Uzbekistan and bodies authorized by it.

Article 6. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of transit of exceptional loads and the military contingents

Cabinet of Ministers of the Republic of Uzbekistan:

performs coordination of activities of governing bodies in the field of transit of exceptional loads and the military contingents;

establishes procedure for issue, prolongation of effective period and cancellation of permissions to transit;

approves lists of the exceptional loads prohibited to transit and also exceptional loads which transit is performed only in the presence of permission;

determines procedure of the state control of transit of exceptional loads and the military contingents;

can create the special structure providing coordination of activities of governing bodies in the field of transit of exceptional loads and the military contingents and also control of implementation of this Law;

performs other powers according to the legislation.

Article 7. The bodies authorized by the Cabinet of Ministers of the Republic of Uzbekistan in the field of transit of exceptional loads and the military contingents

The bodies authorized by the Cabinet of Ministers of the Republic of Uzbekistan (further - authorized bodies):

draw the conclusions on issue of permission to transit;

draw the conclusions that the load of the applicant does not fall under the state control in case of its transit;

exercise control over the implementation of conditions of permissions to transit;

has the right to carry out regular and selective inspections of locations of exceptional loads and the military contingents in case of their transit, conditions and condition of transit, and also to stop the transit performed in defiance of established procedure;

perform other powers according to the legislation.

Article 8. Permission to transit

Transit of exceptional loads and the military contingents is made based on the permission to transit issued by the Cabinet of Ministers of the Republic of Uzbekistan or the body authorized by it.

For receipt of permission to transit the applicant addresses to the Cabinet of Ministers of the Republic of Uzbekistan or the body authorized by it with the corresponding statement and appendix to it of necessary documents.

The decision on issue or on refusal in issue of permission to transit is accepted in time, not exceeding thirty days from the date of receipt of the statement. In necessary cases this term can be prolonged.

Permission to transit of exceptional loads is issued by several batches on each batch separately.
