About approval of the Procedure for carrying out electronically sales of subjects to small privatization at auction, including by reduction of price

According to the paragraph to third part one of article 3 of the Law of Ukraine "About privatization of the small state companies (small privatization)" for the purpose of ensuring implementation of modern technologies of sale of subjects to privatization of state-owned property at electronic auctions, attraction of more wide range of potential buyers I order:

1. Approve the Procedure for carrying out electronically sale of subjects to small privatization at auction, including by reduction of price which is applied.

2. Approve Changes in the Procedure for sale of subjects to small privatization by the redemption, at auction (including by reduction of price, without announcement of the price), on tender with openness of the offer of the price by the principle of auction, approved by the order of Fund of state-owned property of Ukraine of April 02, 2012 No. 439, registered in the Ministry of Justice of Ukraine on May 14, 2012 on No. 753/21066, which are applied.

3. Approve Changes in the order of Fund of state-owned property of Ukraine of April 17, 1998 No. 772 "About approval of the Procedure for representation and consideration of the application about inclusion in the list of objects, privatizeable, and statements for privatization concerning objects of state-owned property of groups A, D and Zh", registered in the Ministry of Justice of Ukraine on June 26, 1998 for No. 400/2840 (with changes) which are applied.

4. To provide to management of privatization of objects of groups A, D and Zh submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

5. This order becomes effective from the date of its official publication.

Procedure for carrying out electronically sales of subjects to small privatization at auction, including by reduction of price

I. General provisions

1. This Procedure is developed for the purpose of ensuring implementation of modern technologies of sale of subjects to privatization of state-owned property at electronic auctions, attraction of more wide range of potential buyers.

2. This Procedure determines the mechanism of the organization and carrying out sale of subjects to small privatization at auction, including by reduction of price (further - auction), electronically.

3. Sale of subjects to small privatization at electronic auction is performed with observance of requirements of the legislation on protection of the economic competition and the legislation on privatization.

The item 4 is excluded according to the Order of Fund of state-owned property of Ukraine of 26.04.2016 No. 867, with respect thereto Items 5 - 14 to consider respectively items 4 - 13

4. In this Procedure terms are used in such value:

electronic auction - sale of subjects to small privatization which consists in transfer of property to the buyer who during sale in real time on the Internet offered the highest price;

the customer of auction - Fund of state-owned property of Ukraine or regional department of Fund of state-owned property of Ukraine;

the price offer - the proposal on subject to privatization which the participant of auction submits according to this Procedure.

Other terms used in this Procedure are used in the value given in the Law of Ukraine "About privatization of the small state companies (small privatization)" and the Procedure for sale of subjects to small privatization by the redemption, at auction (including by reduction of price, without announcement of the price), on tender with openness of the offer of the price by the principle of auction, No. approved by the order of Fund of state-owned property of Ukraine of April 02, 2012 439, registered in the Ministry of Justice of Ukraine on May 14, 2012 on No. 753/21066 (further - the Procedure for sale of subjects to small privatization).

5. The decision on carrying out sale of subjects to small privatization is electronically made by the customer of auction and drawn up by the order.

6. Information on carrying out sale of subjects to small privatization prepares electronically and published in official printing publications of privatization authority, local printing editions, posted on the official site of the customer of auction according to requirements of article 15 of the Law of Ukraine "About privatization of the small state companies (small privatization)" and Item 1.8 of the Section I of the Procedure for sale of subjects to small privatization. In the information message surely it is specified that the auction is held electronically.

7. The organizer of auction which will be attracted with the customer of auction is determined taking into account the following requirements:

availability of the contract with Fund of state-owned property of Ukraine on the organization of sale of the property which is in state-owned property;

availability of electronic resource which provides the organization and holding the auction electronically in the round-the-clock mode, the free admission of participants to participation in electronic auction, equal conditions for all participants of electronic auction, search and viewing of complete and reliable information about holding the auction electronically, data protection, blocking of unauthorized actions for receipt of information on the objects offered for sale, the course of electronic auction and its participants.

The customer of auction in case of the choice of the organizer of auction also considers possibility of installation on the hardware and software of the customer of auction with the right of administration by the customer of auction of electronic resource, possibility of provision to the customer of auction for storage of backup copy of electronic auction, availability at the organizer of auction of experience of implementation of similar electronic resource.

The organizer of auction shall provide observance of requirements of the legislation on protection of the economic competition and the legislation on privatization.
