1. Approve the enclosed Regulations on confirmation of exception of negative impact on the environment of subjects to placement of waste.

2. Realization of the powers of Federal Nature Management Supervision Service provided by this resolution is performed within the number of employees of central office and territorial authorities of Federal Nature Management Supervision Service, and also budgetary appropriations provided to Service in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

Regulations on confirmation of exception of negative impact on the environment of subjects to placement of waste

1. This Provision establishes procedure for confirmation of exception of negative impact on the environment of subjects to placement of waste.

2. The exception of negative impact on the environment of subjects to placement of waste is confirmed by results of monitoring of the state of environment which is carried out by owners of subjects to placement of waste, and also persons in ownership or in use of which there are subjects to placement of waste, in the territories of subjects to placement of waste and within their impact on the environment according to the procedure, the stipulated in Article 12 Federal Laws "About Production Wastes and Consumption" (further respectively - persons operating subjects to placement of waste, monitoring).

3. Reasons for exception of negative impact on the environment of subjects to placement of waste are the data of tool measurements with use of technical systems and devices with measuring functions testimonial of observance of the standard rates of quality of the environment established for chemical, physical and biological indicators of state of environment, including standard rates of threshold limit values of chemicals.

4. Standard rates of quality of the environment shall be observed in the territories of subjects to placement of waste and within their impact on the environment. Norms of quality of the environment are determined in the following places of sampling:

a) for atmospheric air and soils - on border of the parcel of land on which subject to placement of waste is located;

b) for superficial water objects - in the place of release of the sewage arriving from subject to placement of waste in water object;

c) for underground water objects - on border of the parcel of land on which subject to placement of waste, in the direction of current of underground waters is located.

5. In the absence of the established standard rates of quality of the environment background values of the corresponding physical, chemical or biological indicators of condition of components of the environment in the territory adjacent to subject to placement of waste are applied to assessment of its condition.

6. Persons operating subjects to placement of waste prepare the report on results of carrying out the monitoring containing the data confirming exception of negative impact on the environment of subjects to placement of waste (further - the report) which is the basis for decision making by the relevant territorial authority of Federal Nature Management Supervision Service about confirmation of exception of negative impact on the environment of subjects to placement of waste.

7. The report is drawn up on paper in 2 copies, one of which is stored at person operating subject to placement of waste, and the 2nd copy of the report together with its electronic version on the electronic medium and the cover letter in notifying procedure is represented annually, till January 15 of the year following after accounting year in territorial authority of Federal Nature Management Supervision Service in the location of subject to placement of waste.

8. The report can be presented in the form of the electronic document signed by the simple digital signature according to requirements of the Federal Law "About the Digital Signature".

9. The documents which arrived in territorial authorities of Federal Nature Management Supervision Service, stipulated in Item the 7th this provision, are registered in electronic document management system and (or) on paper in accordance with the established procedure.

10. The territorial authority of Federal Nature Management Supervision Service in time which is not exceeding 30 days from the date of receipt of the report performs comparison of information stated in it to the available data on condition and environmental pollution in the territory of subject to placement of waste and within its impact on the environment, received from territorial authority of Federal Service for Hydrometeorology and Environmental Monitoring within the interaction and exchange of information at the regional level provided by the agreement on cooperation of Federal Nature Management Supervision Service and Federal Service for Hydrometeorology and Environmental Monitoring or by carrying out the necessary tool measurements executed by the federal state budgetary institution which is under authority of Federal Nature Management Supervision Service.

By results of the specified comparison the territorial authority of Federal Nature Management Supervision Service in week time makes the decision on confirmation (non-confirmation) of exception of negative impact on the environment of subject to placement of waste and informs on it person which submitted the report in electronic form or by mail.

11. The bases for decision making about non-confirmation of exception of negative impact on the environment of subject to placement of waste are:

a) absence in the report of these tool measurements testimonial of observance of standard rates of quality of the environment in the territory of subject to placement of waste and within its impact on the environment;

b) exceeding of background values of physical, chemical or biological indicators of condition of components of the environment in the territory adjacent to subject to placement of waste, in the absence of the established standard rates of quality of the environment;

c) non-compliance with standard rates of quality of the environment in the territory of subject to placement of waste and within its impact on the environment and (or) in the place of release of the sewage arriving in superficial water object from subject to placement of waste.
