The agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on cooperative principles and conditions of relations in the field of transport

of March 23, 1992

The government of the Russian Federation and the Government of the Republic of Kazakhstan, hereinafter referred to as "Contracting parties", being guided by aspiration to further development of cooperation in the field of transport, wishing to facilitate implementation of freight and passenger traffic between both countries, and also transit across their territories to the third countries,

agreed as follows:

Article 1.

Contracting parties will develop and deepen mutual economic and sci-tech cooperation in the field of all modes of transport.

Article 2.

Each of Contracting Parties will provide in the territory, on the principles of reciprocity, favorable conditions for functioning of all modes of transport of other Contracting Party transporting passengers and loads between both countries and transit across their territories.

Article 3.

The transportations of passengers and loads performed by carriers of one of Contracting Parties on the territory of other Contracting Party based on this agreement and also the vehicles which are carrying out these transportations are exempted from taxes and the state charges connected with use or content of roads and other means of communication, ownership or use of vehicles, and also taxes and fees on the income and on profit received from transportations.

Article 4.

1. Contracting parties agreed to keep the existing rules, provisions, instructions, standards and specifications regulating work of transport.

2. Change, and also introduction of the new regulating documents infringing on interests of other Contracting Party are made under approval between competent authorities of Contracting Parties.

3. Contracting parties will aim to provide standardization of the transport legislation existing in their territories.

Article 5.

The procedure for the organization of transportation of goods and passengers will be performed by railway, air, sea, river and road transport between both countries and transit across their territories on the basis of the agreements signed by the Ministry of Transport of the Russian Federation (regarding the organization of rail haulings by the Ministry of Railways of the Russian Federation) and the Ministry of transport of the Republic of Kazakhstan.

Article 6.

1. Contracting parties agreed to keep the operating procedure of international carriages established by earlier signed intergovernmental agreements of the USSR with other countries and also operation of Conventions and other Agreements in the field of transport which participant was the USSR.

2. Contracting parties reserve the right to sign the Agreements in the field of transport with other countries which are not infringing on interests of other Contracting Party and, in case of the conclusion of such agreements, will inform of it other Contracting Party.

Article 7.

Contracting parties agreed to promote development of direct commercial ties of transport enterprises and organizations of both countries and creation of joint businesses in the field of transport.

Article 8.

Contracting parties agreed that training of engineers, technicians and other specialists of mass professions of transport will be performed by single technique, and the qualification documents issued about the termination of educational institution will have legal force in the territories of both states.

Article 9.

Calculations and payments between transport organizations and firms of both Contracting Parties will be made according to the agreements on calculations and payments existing between Contracting Parties.

Article 10.

The questions which are not settled by this agreement, and also international agreements which participants are both Contracting Parties will be solved according to the domestic legislation of each of Contracting Parties.

Article 11.

For the purpose of ensuring accomplishment of this agreement, and also in case of difficulties in transportations between both countries, the Ministry of Transport of the Russian Federation (and regarding the organization of rail haulings the Ministry of Railways of the Russian Federation) and the Ministry of transport of the Republic of Kazakhstan will be performed by direct contacts and to hold, as required, bilateral meetings for development of mutually acceptable decisions.

Article 12.

This agreement becomes effective from the date of its signing and will be effective before the expiration of 90 days from the date of when one of Contracting Parties reports to other Contracting Party by notification about the intention to terminate the Agreement.

It is made in Uralsk on March 23, 1992 in duplicate, everyone in the Russian and Kazakh languages, and both texts are equally authoritative.
