Agreement on cooperation and interaction between the Ministry of safety of the Russian Federation and Committee for State Security of the Republic of Kazakhstan

of March 23, 1992

The ministry of safety of the Russian Federation and Committee for State Security of the Republic of Kazakhstan which are hereinafter referred to as by the Parties, respecting sovereignty and the state independence of the Russian Federation and the Republic of Kazakhstan;

expressing interest in implementation of equal and mutually beneficial cooperation, in protection of mutual vital interests;

considering that as a result of uncoordinated actions damage can be caused to interests of safety of the Russian Federation and the Republic of Kazakhstan;

expressing the firm intention to follow the principles of the international security;

proceeding from the imperative need of accurate regulation of the new relations between the Ministry of safety of the Russian Federation and Committee for State Security of the Republic of Kazakhstan,

agreed in the following:

1. The parties develop the general principles of the organization and implementation of joint activities for the purpose of the most effective and mutually advantageous use of operational and other opportunities for the benefit of safety of the Russian Federation and the Republic of Kazakhstan.

2. Each other shall inform the parties on the revealed prospecting and blasting aspirations of foreign intelligence agencies and foreign organizations to the Russian Federation and the Republic of Kazakhstan, and also to the Joint Armed Forces deployed in their territory timely. If necessary jointly perform measures for the prevention and suppression of high treasons, the stipulated by the legislation Russian Federation and the Republic of Kazakhstan; on protection of economic interests, fight against smuggling, corruption and organized crime of interstate and interregional nature, the international terrorism and drug trafficking. For present purposes protocols and agreements on specific problems and lines of work can be signed.

3. The parties perform if necessary investigation and search operations in the territory of the Russian Federation and the Republic of Kazakhstan only by mutual consent. Interact and give each other help in search and detention of the persons who committed crimes or suspected of making of crimes which investigation is referred to competence of agreement parties.

4. The parties coordinate measures and perform interaction in questions of safety of the objects of defense industry, the Joint Armed Forces, nuclear power, space-rocket complex, special and military transportations, fight against air terrorism, and also for mobilization preparation which are in the territory of their countries.

5. The parties shall exchange operational data for the purpose of satisfaction of information requirements of the Ministry of safety of the Russian Federation and Committee for State Security of the Republic of Kazakhstan. Quickly inform on the possible extreme and emergency situations affecting sovereignty, territorial integrity, defense capability, economic and ecological safety of the Russian Federation and the Republic of Kazakhstan. On the basis of requests free of charge represent each other the data containing in operational archives, operational accounting and databanks not causing damage to interests of safety of both republics (Protocol N 1 to this agreement).

6. The ministry of safety of the Russian Federation on contractual basis gives methodical and practical help to Committee for State Security of the Republic of Kazakhstan in the solution of questions of technical and information and analytical supply of operating-technical and criminalistic activities, and also performs development, production, delivery, implementation and repair of special technical means according to requests of Committee for State Security of the Republic of Kazakhstan.

7. The parties interact in the field of professional education of personnel of security service, their preparation, retraining and advanced training on the basis of settlement (Protocol N 2 to this agreement).

8. The parties undertake obligations to make agreed decisions concerning movement of workers for further service from the Ministry of safety of the Russian Federation in Committee for State Security of the Republic of Kazakhstan and vice versa, and also on providing the political, social and personal rights of workers and pensioners of security service, members of their families according to rules of international law, the legislation of the Russian Federation and the Republic of Kazakhstan (Protocol N 2 to this agreement).

9. The parties shall develop and approve planned rotation of employees of bodies of military counterintelligence for service including on contractual basis, in system of the Ministry of safety of the Russian Federation and Committee for State Security of the Republic of Kazakhstan.

10. The parties according to requests give each other help in the solution of questions of material logistics (Protocol N 3 to this agreement).

11. The parties undertake the obligation not to transfer to other countries the operational materials received from each other, results of research and development of special nature, operating-technical means, and also information causing damage to safety to the Russian Federation and the Republic of Kazakhstan.

12. The parties shall observe requirements of conspiracy and not allow disaggregation of actions, the used operational forces and means, objects of studying and development, and also leakage of other secrets of the partner under this agreement.

13. For coordination and the solution of the questions arising in the course of cooperation and interaction, the Parties can exchange in case of need representatives or create joint temporary work groups.

14. This agreement becomes effective from the moment of its signing.

15. By mutual consent of the Parties changes and additions can be made to this agreement.

16. The either party can declare the exit from this Agreement by the written notice of it of other Party. The Agreement is in that case terminated after six months from the date of the notification.

This agreement is constituted in duplicate, everyone in the Russian and Kazakh languages. Both texts are equally authoritative. Signed in Uralsk on March 23, 1992.
