About approval of Rules of reference of gemstones to unsuitable for production of jewelry and other products from precious metals and (or) gemstones

1. Approve the enclosed Rules of reference of gemstones to unsuitable for production of jewelry and other products from precious metals and (or) gemstones.
2. Declare invalid the order of the Government of the Russian Federation of November 23, 1998 No. 1365 "About criteria and procedure for reference of gemstones to unsuitable for production of jewelry" (The Russian Federation Code, 1998, No. 48, the Art. 5933).

1. These rules establish criteria and procedure for reference of gemstones to unsuitable for production of jewelry and other products from precious metals and (or) gemstones.
2. Criteria of reference of gemstones to unsuitable for production of jewelry and other products from precious metals and (or) gemstones are their dimensional, color and quality characteristics.
3. To the gemstones unsuitable for production of jewelry and other products from precious metals and (or) gemstones, belong:
a) the natural diamonds mined from subsoil, line items "board" and "drilling" irrespective of their dimensional and weight group;
b) waste of gemstones:
the natural diamonds recuperated from the multichip diamond tool, sitovy classes "-3+2" and below;
the waste which is formed in case of any kind of processing of natural diamonds, sitovy classes "-3+2" and below;
crumb of gemstones, and also the waste which are formed in case of any kind of processing of gemstones (except natural diamonds), the linear sizes less than 2 mm.
4. Reference of the natural diamonds mined from subsoil, line items "board" and "drilling" to unsuitable for production of jewelry and other products from precious metals and (or) gemstones according to established procedure of sorting, primary classification and primary assessment of gemstones is made by the organizations performing sorting, primary classification and primary assessment of gemstones.
5. Reference of waste of gemstones to unsuitable from precious metals and (or) gemstones is made for production of jewelry and other products by the organizations and (or) the individual entrepreneurs acquiring and using gemstones.
Establishment of compliance of characteristics of waste of gemstones to the criteria determined by the subitem "b" of Item 3 of these rules is performed with use of the measuring instruments and the equipment which underwent checking and calibration according to requirements of the legislation of the Russian Federation about ensuring unity of measurements.
The class of the natural diamonds recuperated from the multichip diamond tool and also the waste which is formed in case of any kind of processing of natural diamonds is determined by Sitova by rassev on sets.
The linear sizes of crumb of gemstones, and also the waste which is formed in case of any kind of processing of gemstones (except natural diamonds), are established by means of measuring instruments with a margin error of no more 0,1 of mm.
